This chapter and these regulations shall be known and may be cited as the "East Fallowfield Township Subdivision and Land Development Ordinance of 1982."

1. 
This chapter is adopted for the following purposes:
A. 
To assist in the orderly, efficient, and integrated development of land in accordance with the Comprehensive Plan, East Fallowfield Zoning Ordinance [Chapter 27], and 537 Sewage Facilities Plan.
B. 
To promote thereby the health, safety, and general welfare of the residents of the Township.
C. 
To facilitate the safe and efficient movement of traffic and to assure that streets in and bordering a subdivision or land development shall be coordinated and of such widths and grades and in such locations as deemed necessary to accommodate prospective traffic and facilitate fire protection.
D. 
To ensure coordination and conformance of subdivision and land development plans with the public improvement plans of the Township.
E. 
To ensure equitable handling of all subdivision and land development plans by providing uniform standards and procedures to be followed.
F. 
To ensure that land which is subject to environmental constraints such as floodplains and steep slopes shall be either made safe for the proposed use of land or shall be set aside for uses which shall not endanger life or property or further aggravate, disrupt, or increase the existing condition.
G. 
To ensure sound community growth and the safeguarding of the interests of the homeowners, the subdivider, the investor, and the local government by assuring that streets shall be graded and improved, and walkways, curbs, gutters, street lights, fire hydrants, water and sewage facilities, and other improvements shall be installed where appropriate, in an acceptable manner.
H. 
To provide open spaces through the innovation in design and layout of the land.

As stated in Article V, § 501, of Act 247, Pennsylvania Municipalities Code, as amended, 1972, P.L. 333, No. 93, and 1974, P.L. 566, No. 194, 53 P.S. § 10501, the Board of Supervisors may regulate subdivisions and land development within the Township by enacting a Subdivision and Land Development Ordinance.

1. 
The Board of Supervisors shall have jurisdiction and control of subdivision and land development within the Township limits. In order that the actions of the Board of Supervisors under this chapter may be correlated and consistent with all relevant data and procedures, the Board of Supervisors hereby designates the Township Planning Commission as the agency of the Board of Supervisors:
A. 
To which all applications relating to either preliminary or final plan approval for subdivision and/or land development shall be referred upon initial submission to the Board of Supervisors for review.
B. 
With which applicants shall hold all preliminary consultants relating to the plans.
C. 
Which shall make recommendations to the Board of Supervisors concerning approval, rejection, modification, and conditions of approval or reasons for disapproval of such plans.
D. 
Which shall make recommendations to the Board of Supervisors concerning the interpretation of and the granting of modifications to provisions and standards of this chapter.

In interpreting and applying the provisions of this chapter, all requirements shall be held to be minimum requirements for promoting the above purposes (§ 22-102). Where the provisions of this chapter impose greater restrictions than those of any other statute, ordinance, or regulation, the more restrictive regulations shall be controlling.
