As used in this chapter, the following terms shall have the
meanings indicated:
APPROVED
Acceptable to the Code Enforcement Officer or other authority
having jurisdiction.
FENCE
Any man-made structure, regardless of composition, that prohibits
or inhibits unrestricted travel or view between properties or portions
of properties or between the street or public right-of-way and a property.
FENCE PANEL/BAY
The space between the posts. In simple styles, such as split-rail
fences, there are only rails in each bay. Other types of fences have
a solid infill-like stockade or a more loosely spaced infill, such
as picket fences.
HEIGHT
The distance measured from the natural grade to the highest
point of any component of a fence. Exceptions are as follows:

Decorative caps. Decorative caps on posts shall not be included
in such measurement as illustrated in Diagram No. 197-2A.

Fence at sloping grounds. For fences at sloping grounds, the measurement of the fence height shall be taken from the up-slope portion of each fence panel/bay as illustrated in Diagram No. 197-2B. However, the fence height as taken from the down-slope portion of each fence panel/bay shall not exceed an additional two feet from the maximum fence height as stipulated in Article
V, Standards, of this chapter.

LAKEFRONT PROPERTY
A property that abuts, adjoins, or is contiguous to Keuka
Lake or Seneca Lake.
MEAN HIGH WATER LEVEL (MHWL)
The approximate average high water level for Keuka Lake and
Seneca Lake as determined by reference from survey data provided by
the United States Geological Service (USGS). According to the New
York State Department of Environmental Conservation, Division of Environmental
Permits, the mean high water level is 715.3 feet for Keuka Lake and
447.25 feet for Seneca Lake.
NATURAL GRADE
The grade unaffected by construction techniques such as fill,
landscaping or berming.
OWNER
Any person, agent, operator, firm or corporation having a
legal or equitable interest in the property as recorded in the official
records of Yates County, New York, as holding title to the property.
RESIDENTIAL PROPERTY
A property that contains a Residential Group R-3 use and
occupancy classification as defined by the New York State Uniform
Fire Prevention and Building Code. Examples of such a use and classification
are one- and two-family dwellings and multiple single-family dwellings
(townhouses).
