The Selectboard of the Town of Casco adopts this article in
accordance with 30-A M.R.S.A. § 3009. The Selectboard finds
that unrestricted parking of motor vehicles on certain portions of
public ways in the Town of Casco creates a traffic hazard and is dangerous
to motorists and pedestrians alike. Unrestricted parking causes traffic
congestion, reduces sight distances for motorists, impedes winter
maintenance, and causes motorists to drive outside the designated
travel lane and into oncoming traffic. The purpose of this article
is to regulate parking as necessary to protect the public health,
safety and welfare.
Words used in this article shall be defined in accordance with
29-A M.R.S.A. § 101; any undefined word shall have its common,
ordinary meaning.
No person shall park a motor vehicle on the following public
ways or portions of public ways, where "No Parking/Tow Away Zone"
signs or signs bearing similar language have been erected by the municipality
or State of Maine:
A. A no-parking zone shall exist on the westerly side of Route 302,
also known as "Roosevelt Trail," beginning at the junction of Sebago
Haven Road and Roosevelt Trail running approximately 400 feet in a
northwesterly direction along the Roosevelt Trail to a point 100 feet
to the northwest of the entrance to the South Casco Post Office entrance.

A motor vehicle parked in violation of this article may be towed
by a wrecker when authorized by the municipality or any law enforcement
agency with jurisdiction in the Town of Casco at the request of and
under the supervision of the appointed Town official or other law
enforcement official duly authorized and appointed by the Selectboard,
Cumberland County or State of Maine. Towing under this section shall
not be allowed unless, at the time of the tow, there is at least one
sign stating that violators may be towed. Within five days of the
tow, the official who supervised the tow shall send to the registered
owner a notice stating the date and time of the tow, the location
where the motor vehicle is impounded, and the requirements for release
of the motor vehicle.
Any person seeking release of a motor vehicle towed pursuant
to this article must first:
A. Pay all towing charges and storage charges; and
B. Present satisfactory evidence of his or her right to possession and
sign a receipt for the vehicle.
No person shall cause, allow or permit a motor vehicle registered
in his or her name to park in violation of this article. The fact
that a motor vehicle is unlawfully parked shall be prima facie evidence
of the unlawful parking of such vehicle by the person in whose name
such vehicle is registered.

This article shall be enforced by the appointed Town official
or other law enforcement official duly appointed and authorized by
the Casco Selectboard. A violation of this article is a civil violation
punishable by a fine of $50. Any person charged with a violation of
this article may waive court action by paying a fee of $15 to the
Town Clerk within 30 days of the violation.
In the event that any provision of this article is declared
by a court to be unenforceable, the remaining provisions continue
in full force and effect. This article shall become effective when
adopted by a majority of the Selectboard.
