This policy applies only to employees, contractors and public
officers of the Town of Milo.
In the interest of providing a safe and healthy environment
for employees and public visitors to our facilities, and in accordance
with Article 13-E of the Public Health Law, the following smoking
policy has been adopted by the Town of Milo:
A. Smoking is prohibited throughout our facilities except in designated
smoking areas identified by SMOKING PERMITTED signs.
B. "Smoking permitted" areas will be designated only upon written request.
Employees who are interested in having such an area should submit
a request to their department head. The designation or nondesignation
of a "smoking permitted" area by a department head may be subject
to review and approval by the Town Board. Indoor areas which are accessible
to the public will not be considered.
C. Smoking is not permitted in any conference room or meeting room or
any enclosed private office unless all persons in such place consent
to smoking.
D. No person shall carry a lighted cigarette, cigar or pipe or other
smoking material in any indoor hallway, passage or other common area
while walking through such area. The right of a nonsmoker to smoke-free
air will prevail over an employee's desire to smoke.
E. Smoking shall be prohibited at all times in auditoriums, gymnasiums,
rest rooms, elevators, classrooms, hallways, employee medical facilities
and rooms or areas which contain photocopying equipment or other office
equipment used in common, and in company vehicles by more than one
person unless the occupants of such vehicle agree that smoking may
be permitted.
F. Employee cafeterias, lunchrooms and lounges will contain nonsmoking
areas as designated by the Town Board to meet employee demand.
G. The Superintendent of Highways shall designate in the highway garage
or other building in which Town highway employees work a specific
enclosed smoking area (if one is required) clearly marked by a sign
SMOKING PERMITTED.
The smoking policy in Town Courts shall be as promulgated by
the Office of Court Administration.
The copy of this policy shall be posted upon the Town bulletin
board and in each separate building in which Town employees work.
