This chapter is to establish in Jackson Township a mandatory storage, collection, transportation and disposal program for municipal solid wastes and establish and implement a mandatory collection system for recyclable materials as required by the Municipal Waste Planning, Recycling and Waste Reduction Act, Act 101 of 1988,[1] as amended by Act 140 of 2006, or other acts thereafter.

A. 
Definitions. As used in this chapter, the following terms shall have the meanings indicated:
ACT 101
The Municipal Waste Planning, Recycling and Waste Reduction Act, Act 101 of 1988,[1] as amended by Act 140 of 2006, or hereafter amended.
ALUMINUM
All food and beverage cans made of the lightweight, ductile and malleable metallic substances or elements commonly known as aluminum. This description excludes aluminum foil, trays, plates and miscellaneous aluminum products.
ASHES
The residue resulting from the burning of wood, coal, coke or other combustible material.
AUTHORITY
The York County Solid Waste and Refuse Authority or its replacement or successor.
BRUSH (YARD WASTE)
All vegetative garden residue, shrubbery and tree trimmings, exclusive of grass clippings and leaves.
COLLECTOR
An individual, partnership, firm or corporation which has been licensed by the York County Solid Waste Authority to collect and transport municipal waste and recyclable materials.
COMMENCEMENT DATE
January 1, 2014, the date upon which Township's mandatory municipal waste and recycling program begins.
COMMERCIAL ESTABLISHMENT
Any office, hotel, motel, boardinghouse and any building, group of buildings or part of a building occupied or capable of being used for the conduct of a business, commercial, industrial or institutional purpose.
COMMINGLED
Recyclable materials which have been segregated from regulated municipal waste but which have not been separated into different types of recyclable materials and which have been placed in a recycling container for the purpose of collection.
COMMUNITY ACTIVITIES
Events sponsored in whole or in part by a municipality, or conducted within a municipality and sponsored privately, which include, but are not limited to, fairs, bazaars, socials, picnics and organized sporting events that will be attended by 200 or more individuals per day.
COMPOSTING
A microbial degradation of organic waste to produce a relatively nuisance-free product of potential value as a soil conditioner.
CONTRACTOR
An individual, corporation or partnership with whom the Township shall enter into or contract for collection, transportation, and disposal of municipal waste.
CORRUGATED PAPER
Layered paper or cardboard in which one or more layers is pressed into parallel grooves or ridges and which is normally used for wrapping, packing, shipping and/or the storage of dry materials.
COVERED DEVICES
A covered computer device and covered television device marketed and intended for use by a consumer as defined by PA Act 108 of 2010, also known as the Covered Device Recycling Act.[2]
CURBSIDE
The correct location for the placement of refuse containers and recycling containers for the purposes of collection by a collector, which shall be adjacent to the residential unit and no more than five feet from the public street used by collection vehicles.
DESIGNATED RECYCLABLE MATERIALS
Those recyclable materials designated in this chapter.
GARBAGE
All animal and vegetable wastes resulting from the handling, preparation, cooking and/or consumption of food.
GLASS
The hard, brittle and transparent or partially transparent substance produced by fusion of silica and silicates or sand containing soda and lime and/or other chemicals and substances usually or conveniently included in the manufacture of glass. For the purposes of this chapter, the term "glass" shall mean only those materials commonly known as glass bottles or containers, including all food and beverage containers made of glass, whether clear or colored, of one gallon or less capacity. The term "glass" excludes containers of a greater capacity than one gallon, glass which is not in the form of bottles or containers, glass which is laminated, wired or mirrored, ceramics and crystal.
HIGH GRADE OFFICE PAPER
Printed or unprinted sheets, shavings or cuttings of sulphite or sulphate ledger, bond, writing or other paper having similar fiber and filler content, including, but not limited to, stationery, copy paper and computer paper. Treated, coated, padded and heavily printed stock is not included.
LARGE ITEM
Large or bulky items not normally collected as part of the normal municipal waste collection services. Large items include but are not limited to refrigerators, stoves, dishwashers, hot-water heaters, washing machines, dryers, freezers, televisions, air conditioners, chairs, rolled carpet, desks, bureaus, tables, mattresses, box springs, bed frames, sofas, lawn mowers, bathtubs, toilets, sinks, windows, window screens, doors and similar household items, and tire rims, with tires removed.
LEAVES
Leaves and tree trimmings of less than 1/4 inch in diameter and not more than 10 inches in length and similar material, but not including grass clippings and/or brush.
MULTIFAMILY UNIT
A property with five or more residential units, including, without limitation, apartment complexes, condominium complexes, retirement homes and mobile home parks within the Township.
MUNICIPAL WASTE
Any garbage, refuse, industrial lunchroom or office waste and other material, including solid, liquid, semisolid or contained gaseous material resulting from operation of residential, municipal, commercial or institutional establishments and from community activities and any sludge not meeting the definition of residual or hazardous waste in the Solid Waste Management Act[3] from a municipal or institutional wastewater treatment plant. The term does not include designated recyclable materials.
NEWSPRINT
Paper of the type commonly used for the printing of newspapers and newspaper advertising or other supplements, including glossy or coated paper of the type found in magazines and periodicals.
NONRESIDENTIAL UNIT
All commercial, municipal and institutional units and community activities, excluding residential units and multifamily units.
OTHER MUNICIPAL WASTE
Furniture, appliances, building materials, large items and similar waste, but not including designated recyclable materials, regulated municipal waste, leaves or brush.
PERSON
Any individual, firm, partnership, corporation, association, institution, cooperative enterprise, municipality, municipal authority, governmental entity or agency or any other legal entity whatsoever which is recognized by law as the subject of rights and duties.
PLASTICS
Organic, synthetic or processed materials that are thermoplasatic or thermosetting polymers of high molecular weight that can be molded, cast, extruded, drawn or laminated into objects, films or filaments.
POLICIES AND PROCEDURES
The rules and regulations adopted and revised, from time to time, by the Township which govern and pertain to the Township's recycling program and the collection, storage or transportation of municipal waste within the Township.
RECYCLABLE MATERIALS
Any material which would be regulated municipal waste but for source separation and which will be separated, collected and processed into raw materials or products which are beneficially reused (other than as fuel).
RECYCLING
The separation, collection, recovery and sale or reuse of metals, glass, paper, leaves, brush, plastics and other materials which would otherwise be disposed of or processed as regulated municipal waste and the recovery of reusable materials other than a fuel for the creation of energy.
RECYCLING CONTAINER
For residential units, the term "recycling container" shall refer to the container supplied by the Township. For multifamily units and nonresidential units, the term "recycling container" shall refer to a receptacle which is constructed of plastic, metal or fiberglass and has handles of adequate strength for lifting.
RECYCLING FACILITY
A facility designated to receive classified materials for transfer to a processing facility or a processing facility which creates or recovers reusable materials that can be sold or reused by a manufacturer as a substitute for or as a supplement to virgin raw materials.
REFUSE
All solid wastes (except body wastes and recyclable materials), including garbage, rubbish, ashes and trade wastes.
REFUSE CONTAINER
A receptacle which is constructed of plastic, metal or fiberglass, having handles of adequate strength for lifting and having a tight-fitting lid capable of preventing entrance into the container by vectors or a polyethylene bag which is specifically designed for storage and collection, is protected against animal damage and overloading so as to prevent littering or attraction of insects or rodents and has a holding strength capable of withstanding normal stresses until it is collected.
REGULATED MUNICIPAL WASTE
All municipal waste, excluding designated recyclable materials, leaves, brush and other municipal waste.
RESIDENTIAL UNIT
Any single-family detached, semidetached, or townhouse dwelling or a dwelling unit within a multifamily building containing four or fewer dwelling units.
SCAVENGING
The uncontrolled or unauthorized removal of recyclable materials from the curbside.
STEEL AND BIMETALLIC CANS
The ferrous metal food or beverage containers commonly known as tin cans.

B. 
The singular shall include the plural and the masculine shall include the feminine and the neuter.
On or after the effective date of this chapter, only the contractor authorized by the Township shall collect, transport and dispose of municipal waste and recyclable materials from a dwelling unit within Jackson Township.
Each person owning or occupying a residential unit within the Township is required to participate in the mandatory municipal waste disposal program and mandatory collection system for recyclable materials.
No person shall accumulate or store regulated municipal waste or recyclable materials upon private or public property within the Township, except in accordance with the following:
A. 
Regulated municipal waste shall at all times prior to collection be drained and stored in durable, rust-resisting, nonabsorbent, watertight, easily washable containers equipped with handles and tight-fitting covers. Containers are not to exceed 75 pounds in weight when filled.
B. 
Disposal containers. Disposable containers such as paper and polyethylene bags shall be acceptable for storage of municipal waste only if the following conditions are met:
(1) 
Only those bags specially designed for storage and collection shall be used.
(2) 
Bags are protected against precipitation, animal damage and overloading to prevent littering or attracting of vectors.
(3) 
Bags have holding strength capable of withstanding stresses until they are collected.
(4) 
The bag opening is securely closed prior to setting out for collection.
(5) 
Bags shall not exceed 75 pounds in weight when filled.
C. 
Bulk containers. Bulk containers for multifamily units or for commercial, industrial and institutional refuse shall meet the general and individual container requirements previously set forth except for size limitations. Bulk containers shall be sized according to type and quantity of waste production, equipment-handling capabilities and the frequency of collection.
D. 
Open storage. Certain wastes of a nondecomposable nature may be stored temporarily between dates of scheduled municipal waste collection in a manner other than containerization.
E. 
Tires and large items such as furniture and appliances shall be stored so that water accumulation and rodent harborage is not possible.
F. 
If a commercial, industrial or institutional entity utilizes a bulk collection service other than the current Township contractor, the entity shall annually report to the Township by February 1 the volume of municipal waste and recyclables collected, transported and disposed of during the prior calendar year.
G. 
All municipal waste receptacles shall be provided by the owners, tenants or occupants of the premises unless otherwise specified.
H. 
The storage of all municipal waste by residents of Jackson Township shall be practiced so as to prevent the attraction, harborage or breeding of insects, rodents or other vermin and to eliminate conditions harmful to the public health or which create safety hazards, odors, unsightliness or a public nuisance.
I. 
Regulated municipal waste consisting of garbage and similar organic waste materials shall not be permitted to accumulate for a period of time in excess of seven days. All other types of regulated municipal waste shall not be permitted to accumulate for a period of time in excess of 30 days.
J. 
Ashes shall be stored in fire-resistant containers equipped with handles and tight-fitting covers. Ashes containing hot embers shall not be collected until they have been adequately quenched.
K. 
The owner or operator of a multifamily unit or nonresidential unit must establish a collection system for municipal waste at each property. The collection system must include suitable containers for collecting and storing municipal waste separate from recyclable materials and easily accessible locations for the containers, and written instructions must be provided to the occupants concerning the use and availability of the collection system.
L. 
No person shall place municipal waste in any street, alley or other public place, or upon any private property within the limits of Jackson Township, unless it is placed in a proper container for collection. Likewise, no person shall throw or dispose of municipal waste or recyclable material in any stream or any other body of water.
M. 
Any unauthorized accumulation of municipal waste on any premises within Jackson Township is hereby declared to be a nuisance and is prohibited. Failure to remove any existing accumulation of waste within three days after written notice shall be deemed a violation of this chapter.
N. 
Materials may be put curbside for collection no earlier than 6:00 p.m. the day prior to pickup, and empty containers must be removed 8:00 a.m. the day after collection.
O. 
Covered devices must be properly recycled according to the provisions of PA Act 108 of 2010, otherwise known as the Covered Device Recycling Act.[1]

No person shall accumulate or store designated recyclable materials upon private or public property within the Township, except in accordance with the following:
A. 
Designated recyclable materials, if stored outside a building, shall be kept in a recycling container until placed at curbside for collection. If such materials are stored inside a building, they shall be kept in a recycling container or any type of container suitable for the purpose. When designated recyclable materials are placed at curbside for collection, they shall be contained in a recycling container.
B. 
Designated recyclable materials shall not be permitted to accumulate for a period of time in excess of 30 days.
C. 
The owner or operator of a multifamily unit or nonresidential unit shall provide recycling containers at easily accessible locations for the use of the occupants of such unit. The collection system must include suitable containers for collecting and storing municipal waste separate from recyclable materials and easily accessible locations for the containers, and written instructions must be provided to the occupants concerning the use and availability of the collection system.
D. 
In order to minimize littering, magazines, newspapers, wastepaper, tree prunings and brush trimmings, when stored outside of containers, shall be tied securely in bundles of such size as to be readily handled by the collection system.
E. 
Materials may be put curbside for collection no earlier than 6:00 p.m. the day prior to pickup, and empty containers must be removed by 8:00 a.m. the day after collection.
No person shall accumulate or store leaves upon any private or public property within the Township, except in accordance with the following:
A. 
Leaves for collection shall at all times prior to collection be kept or stored in a refuse container; provided, however, that leaves accumulated during the fall Township leaf collection season may be raked or otherwise deposited uncontained at curbside for collection by the Township.
B. 
Leaves for collection shall not be permitted to accumulate for a period of time in excess of 30 days.
C. 
Leaves may be accumulated and stored on any property by the owner thereof or the occupant of any property with the consent of the owner for the purpose of composting the material for use on the property. Such composting shall take place in a manner to contain the leaves and prevent their intrusion onto other property.
A. 
For collection purposes, except where there is an agreement with the collector to the contrary, municipal waste and recycling containers shall be placed at ground level on the property, not within the cartway of a street or alley, and easily accessible from the side of the street or alley from which collection is made.
B. 
Municipal waste shall be collected at least one time per week, except for large items, which shall be collected as may be agreed upon from time to time by the contracted collector and the Township.
The contractor shall collect municipal waste and recyclable materials in accordance with the terms of the contract between the contractor and the Township, but in no event less than one time per week from each collection point. The contractor shall commence the collection of municipal waste and recyclable materials after 6:00 a.m., prevailing time, and shall complete collection no later than 7:00 p.m., prevailing time, of the same day unless modified by the Board of Supervisors. If the regular collection day shall fall on any of the following holidays, the contractor shall make the collection on the next regular working day after the holiday. The holidays are New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day.
The vehicles and equipment of each collector used in the Township shall be adequate for the purpose to which such vehicles or equipment are being put. Any vehicle used for the collection of municipal waste shall have a watertight enclosed metal body equipped with a compaction device. Any vehicle used for the collection of designated recyclable materials or other municipal waste shall be designed to prevent waste materials from blowing out of or otherwise escaping the vehicle. All vehicles and equipment shall at all times be kept in good repair and operating condition and be reasonably clean and odor free.
A. 
Municipal waste containers shall be picked up at the designated collection points and deposited into the collection vehicles. No municipal waste may be spilled on the roads and streets within the Township, and the contractor must make every effort to prevent scattering of municipal waste, particularly paper, and other light materials, by the wind.
B. 
The contractor must take care not to damage containers belonging to residents or Jackson Township, and in the event of willful or unnecessary damage to such containers, the contractor shall be liable for the same. The contractor shall promptly notify the Township if any residents or property owners claim damage (to containers) other than reasonable wear and tear.
Only a person licensed by the York County Solid Waste Authority of York County, Pennsylvania, or its designee may collect or transport municipal waste and recyclable materials within the territorial limits of said Township.
A. 
All collectors shall utilize vehicles and equipment as described in § 105-10, Collection equipment, of this chapter.
B. 
All regulated municipal waste collected within the territorial limits of the Township shall be transported to and be disposed of only at the resource recovery facility owned by the York County Solid Waste and Refuse Authority on Black Bridge Road in Manchester Township or, in the event that such facility shall not be operating, at a facility designated by the Authority, if any, and otherwise to a facility permitted by the Department of Environmental Protection of the Commonwealth of Pennsylvania.
C. 
All designated recyclable materials collected within the territorial limits of the Township shall be transported to and processed at a recycling facility.
D. 
All other municipal waste collected within the territorial limits of the Township shall be transported to and disposed of at a facility permitted for the disposal of such waste by the Department of Environmental Protection of the Commonwealth of Pennsylvania.
E. 
Collectors shall file with the Township on or before the 15th day of the month succeeding each calendar quarter a report covering the preceding calendar quarter, which shall set forth such reasonable information as the Township shall request, including, but not limited to:
(1) 
The volume of each regulated municipal waste, designated recyclable materials, and other municipal waste collected. The volume of designated recyclable materials shall be broken down into the volume of each designated material.
(2) 
The name and address of any person the collector shall observe who consistently fails to comply with any provision of this chapter.
A. 
All persons within the Township shall separate designated recyclable materials from the municipal waste generated by such person as hereinafter provided.
B. 
Each residential unit, multifamily unit and nonresidential unit and community activities within the Township shall ensure that the designated recyclable materials generated at such unit or activity are processed at a recycling facility.
C. 
In the case of a multifamily unit and a nonresidential unit and community activities, compliance with Subsection B of this section may be obtained by the owner or operator of such unit or activity contracting with a collector or transporting such recyclable material to a recycling facility.
D. 
Compliance with Subsection A of this section may be obtained by contracting with a collector.
A. 
Each residential unit, multifamily unit and nonresidential unit and community activity within the Township shall ensure that the regulated municipal waste generated at such unit or activity is picked up by the Township contractor or disposed of at the resource recovery facility owned by the York County Solid Waste Authority on Black Bridge Road in Manchester Township or, in the event that such facility shall not be operating, at a facility designated by the Authority, if any, and otherwise to a facility permitted by the Department of Environmental Protection of the Commonwealth of Pennsylvania.
B. 
Compliance with Subsection A of this section may be obtained by contracting with a collector.
A. 
Each residential unit, multifamily unit and nonresidential unit and community activity within the Township shall ensure that the brush and/or leaves generated at such unit or activity are disposed of at a facility for the composting of brush and/or leaves as shall, from time to time, be designated by the Township or by placing such brush or leaves at curbside for pickup by the Township during designated spring brush or fall leaf collection seasons.
B. 
However, nothing herein shall require any person to gather leaves or prevent any person from utilizing leaves for compost, mulch, or other agricultural, horticultural, gardening or landscaping purposes.
All residential, nonresidential and multifamily units and community activities shall separate recyclable materials from municipal waste and shall commingle for recycling the following designated recyclable materials:
A. 
Newsprint.
B. 
Aluminum.
C. 
Steel and bimetallic cans.
D. 
Glass (clear and colored).
E. 
Plastics.
F. 
Glossies and magazines.
G. 
Corrugated paper.
H. 
High-grade office paper.
A. 
The owners or occupants of each residential unit shall prepare designated recyclable materials and place such materials at curbside for collection as per § 105-8, Collection practices.
(1) 
All recyclable materials shall be placed in approved containers, each of which cannot exceed 50 pounds in weight.
(2) 
Glass and plastic containers shall have caps and lids removed.
(3) 
Glass and cans shall be rinsed free of contaminants.
(4) 
Glass, aluminum, cans and plastic shall be commingled in a recycling container to be approved and provided by the Township. Plastic garbage bags or other home use containers shall not be utilized as containers for designated recyclable materials.
(5) 
Brush (yard waste) shall be placed in a) no more than three-foot lengths and bundled; b) biodegradable kraft or other paper bags; or c) a maximum thirty-two gallon container. Collection dates and times shall be as determined by the Board of Supervisors.
(6) 
The burning of any recyclable materials, including leaves and brush (yard waste) is strictly prohibited.
B. 
The owner or operator of a multifamily unit or nonresidential unit contracting with a collector for the collection of designated recyclable materials shall prepare such materials for collection in such manner as the collector shall designate.
A. 
Residential units. From the time of placement at curbside of any designated recyclable materials, all such designated recyclable materials shall be and become the property of the contractor. It shall be a violation of this chapter for any person other than the contractor to collect or pick up or cause to be collected or picked up any such designated recyclable materials from the curbside.
B. 
Nonresidential units and multifamily units. From the time of placement for collection of any designated recyclable materials, all such designated recyclable materials shall be the property of the collector or the owner or operator of the nonresidential unit or multifamily unit where such owner or operator elects to transport such materials to a recycling facility. It shall be a violation of this chapter for any person, other than the collector or the owner or operator of such units, to collect or pick up or cause to be collected or picked up any such designated recyclable materials.
A. 
The Board of Supervisors of Jackson Township is authorized to request proposals from and enter into an exclusive contract with a collector for the collection, transportation and disposal of regulated municipal waste, designated recyclable materials and other municipal waste generated by each residential unit within the Township.
B. 
The Board of Supervisors may impose and collect, or authorize the contractor to collect, a fee to pay for said services in the manner provided for in the Second Class Township Code.[1] Such fee shall be adopted from time to time by resolution of the Board of Supervisors.

C. 
If the Board elects to enter into such contract, the following provisions shall apply.
(1) 
All persons owning or occupying any residential unit within the Township shall dispose of all regulated municipal waste, designated recyclable materials and other municipal waste generated by each such unit only through the service of the contractor with the Township.
(2) 
The handling, collection, transportation and disposal of such municipal waste and recyclable materials shall be in accordance with the provisions of this chapter and the terms and conditions of the contract between the Township and the contracting collector.
(3) 
The per-unit service fee shall include collection of or from four or fewer containers per week.
(4) 
Where there is a use in a home in addition to a residence, and the combination of uses generates four or fewer containers per week, the owner of said property shall not be charged for more than one use, provided the owner shall have so requested in writing, and provided that the operation of the separate use shall employ no one other than a residential occupant of the premises.
(5) 
Reasonable notice of such exclusive contract and the terms and conditions thereof, including the effective date, shall be given by the Township to the owner of all residential units within the Township.
A. 
Nothing in this chapter shall be construed to impair the obligations of any existing contracts.
B. 
No renewal or modification of any existing contract and no new contract for the storage, collection, transportation, processing or disposal of regulated municipal waste or designated recyclable materials shall be entered into after the effective date of this chapter unless such renewal or modification or new contract shall conform to the requirements of this chapter.
A. 
Each owner and/or occupant of a residential unit (as defined in this chapter) within the Township that participates in the municipal waste disposal program shall be required to pay to the contractor a quarterly or semiannual fee for the collection, transportation and disposal of municipal waste and recyclable materials. This fee shall be paid regardless of the amount or type of municipal waste and recyclable materials put out for collection. The quarterly or semiannual fee charged by the contractor shall be established by a contract to be entered into between the Township and the contractor pursuant to public bidding requirements. The Township accepts no responsibility whatsoever for the collection of the fee to be charged to the owner and/or occupant of each residential unit. The contractor shall be solely responsible for the collection of the quarterly or semiannual fees.
B. 
All fees which remain unpaid 30 days after the invoice date shall be deemed to be delinquent. All delinquent accounts shall have added to them a penalty of $10. Thereafter, the ten-dollar fee shall be imposed once during each quarter that the delinquent balance remains unpaid. The Township or contractor is authorized to waive such penalty, in whole or in part, if either party believes it is in the best interest of the Township to do so.
C. 
If the owner and/or occupant of a residential unit shall fail to pay any charges or fees after the same become delinquent, the Township Solicitor is authorized, pursuant to the Pennsylvania Municipal Claims Act,[1] to enter a lien against the real estate upon which the residential unit is situate in the amount of the fees and charges or aggregate of fees and charges, plus penalties and costs of entry.

D. 
If the owner and/or occupant of a residential unit shall fail to pay any charges or fees after the same become delinquent, the Township Solicitor and/or contractor are authorized to file a civil suit against the owner and/or occupant for the collection of refuse fees, related charges, penalties, interest, and costs of collection, including reasonable attorney's fees, and an administrative fee of $50.
E. 
The existence or exercise of any remedy under this section shall not prevent the Township from exercising any other remedy provided under this chapter or the Township's policies or procedures or available at law or equity.
Any person, partnership, firm or corporation who or which has violated or permitted the violation of any provisions of this chapter shall, upon conviction thereof in any action brought before a District Justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, be sentenced to pay a fine of not more than $1,000 plus costs, and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this chapter continues, or each section of this chapter which shall be found to have been violated, shall constitute a separate offense.
For purposes of the obligations established by this chapter or the Township's policies and procedures, and for purposes of any fine, penalty, imprisonment or other sanction, the terms "person," "residential unit," "multifamily unit" and "nonresidential unit" shall include officers and directors of any corporation or legal entity having officers and directors and refer to and impose joint and several liability upon both the persons residing in or occupying any such residential, multifamily or nonresidential units and the owner, landlord or condominium owners' association of such premises.
The provisions of this chapter are severable, and if any section, sentence, clause, part or provisions hereof shall be held to be illegal, invalid or unconstitutional by any court of competent jurisdiction, such decision of the court shall not affect or impair the remaining sections, sentences, clauses, parts or provisions of this chapter. It is hereby declared to be the intent of Jackson Township that this chapter would have been enacted if such illegal, invalid or unconstitutional section, sentence, clause, part or provision had not been included herein.
