As used in this Article, the following terms mean:
ENTER UNLAWFULLY or REMAIN UNLAWFULLY
A person enters or remains in or upon premises when he or
she is not licensed or privileged to do so. A person who, regardless
of his or her purpose, enters or remains in or upon premises which
are at the time open to the public does so with license and privilege
unless he or she defies a lawful order not to enter or remain, personally
communicated to him or her by the owner of such premises or by other
authorized person. A license or privilege to enter or remain in a
building which is only partly open to the public is not a license
or privilege to enter or remain in that part of the building which
is not open to the public.
TO TAMPER
To interfere with something improperly, to meddle with it,
displace it, make unwarranted alterations in its existing condition,
or to deprive, temporarily, the owner or possessor of that thing.
UTILITY
An enterprise which provides gas, electric, steam, water,
sewage disposal, or communication, video, internet, or voice over
internet protocol services, and any common carrier. It may be either
publicly or privately owned or operated.

A. A person commits the offense of trespass in the first degree if he/she
knowingly enters unlawfully or knowingly remains unlawfully on property
owned by the City of Woodson Terrace when the building on such property
is closed.
B. The City hereby authorizes the Public Works Department to erect appropriate
public signage on the following properties owned by the City, which
said signage shall clearly state that persons entering onto that City
owned property when the building on said property is not open for
public use, shall be charged with trespassing:
1.
City Hall, 4323 Woodson Road.
2.
Old Community Center, located at 9351 Guthrie Ave.
3.
Public Works building, an accessory building located at 9648
Ambro.
4.
New Community Center and pool, located at John Brown Park, 4301
Calvert Avenue.
C. Special Rule Regarding Old Community Center. The Old Community Center
set forth as #2 above is generally not open for use, even on weekdays,
except during special events which are scheduled ahead of time. No
person shall enter onto said Old Community Center property unless
to attend a special event at such building. Special events shall have
been scheduled previously by the City Clerk or City Hall staff. No
person shall be charged with trespassing if appropriately attending
such special event.
A person commits the offense of reckless burning or exploding
if he/she recklessly starts a fire or causes an explosion and thereby
damages or destroys the property of another.

A. It
shall be unlawful for any person to openly burn wood, shavings, leaves,
rubbish, manure, straw, garbage, refuse of any kind or another material
within the City.
B. Exceptions:
1. Burning of non-treated wood is permitted in an outdoor fireplace,
fire pit or grill designed for that purpose.
2. The following open burning is permitted for the following purposes
when done in accordance with the regulations of the International
Code Council, International Fire Prevention Code and the appropriate
air pollution control agency and a permit is issued by the Fire Department:
a. On a construction site for warming purposes, in fifty-five (55) gallon
drums with holes on bottom, using only clean wood, no painted or treated
material.
b. On a construction site to heat mortar for masonry work.
C. Any
open burning fire permitted under this Section shall not cause smoke,
ash or particulate matter to remain visible in the air or on surfaces
beyond the property line where the fire is occurring.
It shall be unlawful for any person to deface, remove, damage,
tamper with, interfere with or attempt to remove any stop sign or
any other traffic signal placed or installed pursuant to authority
of any ordinance of the City of Woodson Terrace.
Any person who shall paint, post, place, hang, suspend or affix
any advertisement, card, poster, sign, banner or streamer, of any
nature, or for any purpose, or who shall cause the same to be done
on or to any curbstone, flagstone or any other portion of any street
or sidewalk, or upon any tree or lamp post standing or erected on
any public street, alley or other public place, or upon any pole erected
upon any public street, alley or other public place, which pole is
used to carry telephone wires or cables, electric light wires or other
electric conductors, or to any hydrant, bridge or other public structure
within the City of Woodson Terrace shall be deemed guilty of a misdemeanor.
Provided however, that nothing herein shall apply to any official
notice required by law or ordinance to be posted by public officer.
