That from and after the effective date of this Part, it shall
be unlawful for any person, persons, partnership, firm organization
or corporation(s) to solicit funds for any charitable purpose or for
any other purpose whatsoever, or (b) to solicit orders or vend, peddle,
or hawk any articles, either in a public place or places, or by entering
in or upon private property within the boundaries of Wrightstown Township,
Bucks County, Pennsylvania, without first having registered and obtained
an identification card from the Code Enforcement Officer or Township
Administrator, except that this section shall not apply to farmers
selling their own products, nor to any manufacturer or producer selling
or distributing bread or bakery products, meat and meat products or
milk and dairy products, nor to commercial travelers or sales representatives
selling to dealers or retailers in the usual course of business. This
Part shall not apply to such events as Halloween or home garage sales.
This Part shall not apply to political candidates who are campaigning
for public office.

Upon satisfactorily furnishing the information required under §
13-402 or
13-403, aforesaid, the applicant shall be registered by the Code Enforcement Officer or Township Administrator in a book of registration maintained for that purpose, but such registration shall not be effective for 48 hours, during which time the Police Department may investigate the applicant. Upon the expiration of this forty-eight-hour period, if the applicant meets all legal requirements, as set forth in §§
13-402 and
13-403, the Code Enforcement Officer or Township Administrator shall issue an identification card or cards bearing an identification number, to the applicant(s) as provided in §
13-406.

Upon approval of the application(s) set forth in the preceding section,
the Code Enforcement Officer or Township Administrator shall issue
an identification card, bearing the name of the individual, the firm
or charitable organization he/she represents, the goods, wares, merchandise
to be peddled or the funds to be solicited for, his/her address, sex,
color, height, weight, color of hair and eyes and said identification
card shall display a Police Department photograph of the registrant.
Possession of an identification card shall not permit trespass on
private property.

Upon approval of the application(s) set forth in the preceding sections,
the Code Enforcement Officer or Township Administrator shall notify
all applicants of said approval and advise said applicant of the following
fees: All persons, partnerships, firms, organizations or corporations
soliciting orders, vending, peddling or hawking any articles within
the boundaries of Wrightstown Township shall pay a fee for each identification
card holder and the said fee shall be payable to the Township of Wrightstown
in an amount established by resolution of the Board of Supervisors
which may be amended by resolution from time to time. Said fee as
established by the Board of Supervisors shall be for a one-year period
for each individual identification card holder. This section shall
exclude fees for groups such as Boy/Girl Scouts and paperboys/girls.

Any identification card issued under the terms of this Part
may be revoked at any time by the said Code Enforcement Officer or
Township Administrator if the applicant furnished false information
in his/her application or if the applicant is arrested for a crime
involving moral turpitude after the issuance of such identification
card or if the applicant is arrested for disorderly conduct, in violation
of the Pennsylvania Crimes Code, 18 Pa.C.S.A. § 5503.

All identification cards, if and when issued by the said Code
Enforcement Officer or Township Administrator shall bear an expiration
date affixed by the Code Enforcement Officer or Township Administrator
but the said registrant may make application for a new identification
card to be issued at any time after the expiration date of an identification
card he/she has previously held.

All identification cards, if and when issued by the Code Enforcement
Officer or Township Administrator, shall bear the signature of the
issuing authority, the Code Enforcement Officer or Township Administrator.

It shall be unlawful for any person(s) to solicit funds or to take order for or vend, peddle, hawk, or offer for sale any goods, wares or merchandise within the boundaries of Wrightstown Township, with the exception of those persons mentioned in §
13-401 of this Part, without having in his/her possession the identification card hereinbefore mentioned.

The Wrightstown Township Board of Supervisors shall post appropriate
signs at specific locations where they can be observed by all who
enter the boundaries of the Township of Wrightstown and said signs
shall be of such height, color, and lettering so as to advise the
traveling public that the Township of Wrightstown is a zoned community
and all solicitors must obtain a permit.

Any person soliciting for any organization, or any person offering
for sale or vending, hawking, peddling any goods, wares or merchandise
without first having registered and obtained the identification card
aforesaid or any person, firm, or corporation who shall violate any
provision of this Part, upon conviction thereof in an action brought
before a magisterial district judge in the manner provided for the
enforcement of summary offenses under the Pennsylvania Rules of Criminal
Procedure, shall be sentenced to pay a fine of not less than $35 nor
more than $1,000 plus costs and, in default of payment of said fine
and costs, to a term of imprisonment not to exceed 90 days. Each day
that a violation of this Part continues or each section of this Part
which shall be found to have been violated shall constitute a separate
offense.
