"SECTION 01: Title.

"The Wrightstown Township Subdivision and Land Development Ordinance,
marked Exhibit "A", attached hereto and incorporated herein by reference
shall be the subdivision and land development ordinance for Wrightstown
Township (the "SALDO"). The SALDO shall establish rules, regulations,
and standards governing the subdivision and development of land within
Wrightstown Township, setting forth the procedures to be followed
by the Board of Supervisors and Planning Commission in administering
these rules, regulations and standards, and setting forth the penalties
for the violation thereof.

"SECTION 02: Short Title.
| ||||
"The regulations shall be known and may be cited as the Ordinance
shall be known as and may be cited as the Wrightstown Township Subdivision
and Land Development Ordinance.

"SECTION 03: Purpose.
| ||||
"The regulations are adopted for the following purposes:
| ||||
"A.
|
To further the goals and policies of the Newtown Area Joint
Municipal comprehensive Plan, the following vision statement derived
from the residents of Wrightstown Township is established:

"Wrightstown Township seeks to establish and maintain a sustainable
community that balances the rights of property owners to reasonably
use their land with the community's expressed goal to conserve and
preserve its natural and historical character for the benefit of all,
present and future, residents.

"To that end, Wrightstown Township will:
| ||||
"(1)
|
Aggressively conserve and preserve the natural and historic
resources necessary to protect the health, safety and welfare of the
residents from unreasonable risks and nuisances caused by the environmental,
economic, and transportation impacts associated with unbalanced land
uses.

"(2)
|
Utilize a holistic approach which emphasizes a thorough evaluation
of the individual and cumulative impacts potentially associated with
significant land use proposals. These will be evaluated in the context
of the current and future projected land uses for surrounding properties
and municipalities.

"(3)
|
Ensure proper provision for stormwater management, water, wastewater
and other community services.
| |||
"(4)
|
Provide for adequate open space, recreation, light, air and
traffic management.
| |||
"(5)
|
Encourage and promote flexibility, economy and ingenuity in
the layout and design of subdivisions and land developments.

"(6)
|
Establish procedures and standards for observance by applicants,
the Planning Commission and Board of Supervisors.

"(7)
|
Provide for the coordination of existing streets and utilities
with new facilities.

"SECTION 04: Interpretation.
| ||||
"A.
|
The provisions of this Ordinance shall be held to be minimum
requirements to meet the above-stated Purposes. Where the provisions
of this Ordinance impose greater restrictions than those of any statute,
other ordinance, or regulation the provisions of this Ordinance shall
prevail. Where the provisions of any statute, other ordinance or regulation
impose greater restrictions than those of this Ordinance, the provisions
of such statute, ordinance or regulation shall prevail.

"B.

Wherever the provisions of this Ordinance mirror language found
in the Pennsylvania Municipalities Planning Code, 53 P.S. § 10101
et seq., and in the event of subsequent modifications that do not
explicitly overrule provisions herein, then the provisions of the
more restrictive statute or ordinance shall apply.

SECTION 05: Severability.
| ||||
It is hereby declared to be the intent of Wrightstown Township
that:

A.

If a court of competent jurisdiction declares any provisions
of this Ordinance to be invalid or ineffective in whole or in part,
the effect of such decision shall be limited to those provisions which
are expressly stated in the decision to be invalid or ineffective,
and all other provisions of this Ordinance shall continue to be separately
and fully effective; and

B.

If a court of competent jurisdiction finds the application of
any provision or provisions of this Ordinance to any lot, building,
tract of land, or other structure to be invalid or ineffective in
whole or in part, the effect of such decision shall be limited to
the person, property, or situation immediately involved in the controversy
and the application of any such provision to other persons, property,
or situations shall not be affected.

SECTION 06: Repealer. The existing Subdivision
and Land Development Ordinance of 1986, as amended, originally adopted
September 15, 1986, by Wrightstown Township, and entitled, Wrightstown
Township Subdivision and Land Development Ordinance of 1986, as amended,
and all supplements and amendments thereto are hereby repealed. Provided,
however, if this Wrightstown Township Subdivision and Land Development
Ordinance is held to be ineffective or invalid by reason of some irregularity
in or impediment to its passage, this repealer shall also be ineffective
as aforesaid. Then and in that event, the Wrightstown Township Subdivision
and Land Development Ordinance of 1986, as amended, together with
its supplements and amendments, would necessarily remain in full force
and effect.
