A. The word "fireworks" whenever and wherever
used in this Section, shall mean pyrotechnics or any combustible or
explosive composition, or any substance or combination of substances,
or article prepared for the purpose of producing a visible or audible
effect by use of combustion, explosion, deflagration or detonation
and includes blank cartridges, toy pistols, toy cannons, or toy guns
in which explosives are used; firecrackers, roman candles, sparklers,
skyrockets and other fireworks which contain any explosive or flammable
compound or any other explosive substance, and classified as Class
1.4G explosives, except cap guns or simulated weapons used at athletic
events or military funerals or public military functions.
B. Fireworks may only be discharged in accordance
with the following:
1.
Such discharge shall occur on an
individual's own property, or on the property of another where permission
has been granted.
2.
Fireworks may be discharged from
9:00 A.M. until 11:00 P.M. from July 3 through July 5.
3.
The discharge of fireworks shall
only occur in a manner that will ensure that the fireworks will not
leave the property from which they are discharged.
4.
No bottle rockets, as defined herein,
shall be discharged within the City limits except in an approved fireworks
display.

C. No fireworks shall be sold in the City of Smithville without a permit issued in accordance with Section
610.110(C).
D. Any violation of these provisions shall be punishable in accordance with Section
100.220 of this Code.
