Planning Board fees shall be as follows:
A. Residence Districts.
(1) Alterations and accessory structures:
(a)
Cost under $50,000: $350.
(3) New structures and alterations on nonresidential use
premises: same as nonresident district.
B. Nonresidence District new buildings and alterations.
(1) For the first $5,000, or fraction thereof, of the
estimated cost of construction: $500; plus
(2) For each additional $1,000, or fraction thereof, of
the estimated cost: $5.
C. Amendments to approve plans or resubmittal: $350.
D. Filing preliminary layout of subdivisions: $1,000;
plus all reasonable engineering/review fees with 10% of project cost
as refundable deposit.
E. Environmental impact statement; SEQR.
(1) The fees for review or preparation of an environmental assessment
form or environmental impact statement involving an applicant for
a permit or approval of an action any board or agency of the village
for preparing or reviewing the environmental assessment form or environmental
impact statement: $1,000, plus all associated costs, including but
not limited to legal fees; planning; traffic; environmental; engineering
or other consulting fees; advertizing of legal notices; and stenographic
minutes of meetings.
(2) Deposit $5,000 to $20,000.
(a)
Any unused portion of said deposit shall be refunded to the
applicant.
F. Optional consultation with architectural consultant to Planning Board.
G. Village Board of Trustees: use and other zoning, building, or planning
uses: $1,000.
H. Board of Zoning and Appeals.
(1) Residential: $750:
(a)
Minor applications; sheds, fences, etc.: $350.
I. All of the above, plus all engineering/legal/review fees with a minimum
refundable deposit.
Building Department fees shall be as follows:
A. Certificates.
(1) Certificate of occupancy:

(4) Extensions (three months each), maximum one year:

Fourth extension: $2,000.
(5) Additional extensions require a new application and payment of full
fees.
C. Plumbing permit fee.
(2) New nonresidential buildings: $1,000.
(3) Alterations and additions to dwellings: $250; sewers:
$250; water connection: $250.
(4) Alterations and additions to nonresidential buildings:
$250.
(5) Plus, for all of the above, a fee for each plumbing
fixture of $50.
(6) Gas piping: $300 plus appliance fee.
E. Residential appliance fee.
(1) Oil burner, gas furnace, fuel tank, central air conditioner
hvac unit and hot water heater: $150.
F. Commercial appliance fee:
(1) Oil burner, gas furnace, fuel tank, central air conditioner
hvac unit and hot water heater: $250.
G. Drywells: $250 for first; $100 for each additional.
H. Tree removal application: $100 (maximum of three trees).
I. Copies: $0.25 each up to legal size; over legal size, $2.
J. Minimum cost of construction calculations.
(1) Single-family residence, alterations: $200/sq. ft.
(2) Single-family residence, addition and new construction: $300/sq.
ft.
(3) Finished basements: $75/sq. ft.
(4) Decks/patios: $35/sq. ft.
(5) Swimming pools: $35/sq. ft.
(6) Office building and retail, additions and new construction: $200/sq.
ft.
(7) Office buildings/medical, additions and new construction: $300/sq.
ft.
(8) Office building and retail, gut and refinish: $100/sq. ft.
(9) Office building/medical, gut and refinish: $150/sq. ft.
(10)
Office building/tenant alteration: $75/sq. ft.
(11)
Office building/medical tenant alteration: $125/sq. ft.
(12)
Public assembly/restaurant alteration: $300/sq. ft.
(13)
Warehouse/storage, new: $100/sq. ft.

Please Note: These rates are a guide and are subject to review
and change by the Superintendent of the Building Department and the
Village of Lake Success Board of Trustees.

A. Refund of fees. Upon expiration or cancellation of
any permit issued under this article, where no construction, excavation,
demolition or other work for which such permit was issued has been
started, the applicant shall be entitled to a refund of 50% of any
permit fee paid and 100% of any certificate of occupancy/completion
fee paid, upon filing a claim for such refund by the Building Inspector
and the Board of Trustees.
B. Filing for alterations and new dwellings. One set
of forms must be filled out, and nine sets of plans with the original
architect's signature and seal, a check for filing fees and a workmen's
compensation certificate must be submitted.
C. Costs. On all applications to the Board of Trustees,
the Board of Appeals and/or the Planning Board, the applicant shall
be liable for and shall pay the following costs which may be incurred
by the Village in processing the application:
(2) Stenographic minutes of meetings and hearings.
(3) Engineering costs for Village Engineer.
(4) Legal fees for the Village Attorney.
(6) Planning, sound, traffic, environmental or other specialized
study or consultant's fees.
D. Deposits.
(1) In addition to the fees required in §§
A111-2 and
A111-3 hereof, the applicant shall deposit with the Village Clerk a sum of money to be used by the Village to defray the costs, listed in Subsection
C hereof, which are actually and necessarily incurred by the Village in processing and reviewing the application. The sum deposited shall be as follows:
(a)
Where an environmental impact statement is required
or an expanded environmental assessment form is required or it appears
to the applicable board that such may be required: the sum of $5,000
to $20,000.
(b)
In all other cases: the sum of $1,000.
(2) In the event that the amount of the deposit is insufficient to cover the costs listed in Subsection
C hereof, the applicant shall, at such time as is fixed by the Village Clerk, deposit with the Village an amount deemed sufficient to defray all such costs. If the amount deposited exceeds the costs listed in Subsection
C which are actually and necessarily incurred by the Village, the unused portion of such deposit shall be returned to the applicant within 60 days after the decision on the application is filed.
E. Action on application. No action shall be taken by
the Board of Trustees, the Board of Appeals and/or the Planning Board
on any application subject to the provisions of this section until
all fees and deposits required hereunder are paid in full.
F. Noncompliance with approved plans. In the event that the applicant has not conformed to the approved plans, the Board may, at its discretion, retain consultants to determine the extent of noncompliance and the applicant shall be liable for all costs incurred by the Village in accordance with Subsection
C.
Charges to purchase certain documents shall
be as follows:
C. Code of the Village of Lake Success: $250.
D. Copies: $0.25 each, up to legal size; $2 each, over
legal size.
E. Exclusions. One copy of the Village resident street
list shall be provided at no charge for each candidate for nomination
for Village office, as well as one copy to previously approved nonprofit
organizations active in the Village.
A. The applicant shall pay the actual fees incurred by
the Village for review or preparation of an environmental assessment
form or environmental impact statement involving an applicant for
a permit or approval of an action of any board or agency of the Village
or preparing or reviewing the environmental assessment form or environmental
impact statement, including but not limited to legal fees; planning,
traffic, environmental, engineering or other consulting fees; advertising
of legal notices; and stenographic minutes of meetings.
B. The applicant shall deposit with the Village at the
time of filing the environmental assessment form or environmental
impact statement the sum of $2,000 to be applied toward such fees.
Any unused portion of said deposit shall be refunded to the applicant.
