The Zoning Enforcement Officer of the Town of Clayton is the public officer authorized and required to enforce Chapter 235, Zoning, and Chapter 186, Subdivision of Land, and the Town Board of the Town of Clayton hereby finds that in furtherance of the prompt administration and enforcement of Chapter 235, Zoning, and Chapter 186, Subdivision of Land, the Zoning Enforcement Officer is required to secure the appearance in local justice court of individuals violating Chapter 235, Zoning, and Chapter 186, Subdivision of Land, of the Town of Clayton.
Section 10, Subdivision 4, of the Municipal Home Rule Law of the State of New York grants to this Board as the legislative body of the Town of Clayton, the power to delegate to the Zoning Enforcement Officer the authority to issue appearance tickets for violations of Chapter 235, Zoning, and Chapter 186, Subdivision of Land, of the Town of Clayton.
The Zoning Enforcement Officer of the Town of Clayton is hereby authorized to issue appearance tickets pursuant to the provisions of the Criminal Procedure Law of the State of New York to compel the appearance in local justice court of individuals violating any provision of Chapter 235, Zoning, and Chapter 186, Subdivision of Land. The issuance of appearance tickets by the Zoning Enforcement Officer shall be governed by § 150.20(3) of the Criminal Procedure Law of the State of New York, and all appearance tickets issued by the Zoning Enforcement Officer pursuant to the authority delegated herein shall conform to the requirements of those provisions.
