This chapter shall be known as the "Town of Urbana, Steuben County, New York, Manufactured Home and Manufactured Home Park Law" and may be cited as "Local Law 1 for the Year 1990."
The purpose of this chapter is to promote the health, safety and general welfare of the inhabitants of the Town of Urbana, Steuben County, New York, by regulation of the design, layout, construction and operation of manufactured home parks.
A. 
Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
B. 
In addition, or as an alternative to the above-provided penalties, the Town Board may also maintain an action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this chapter.
Should any provisions of this chapter be in conflict with existing regulations applicable to the Town of Urbana, then the more restrictive shall apply.
As used in this chapter, the following terms shall have the meanings indicated:
AWNING
A shade structure supported by posts or columns and partially supported by a manufactured home installed, erected or used on a manufactured home lot.
CARPORT
An awning or shade structure for a vehicle or vehicles which may be freestanding or partially supported by a manufactured home.
HEALTH AUTHORITY
A legally designated health authority or an authorized representative of the Town of Urbana.
INTERNAL STREET
A private way which affords principal means of access to abutting individual manufactured home lots and community service buildings.
LICENSEE
Any person licensed to operate and maintain a manufactured home park under the terms of this chapter.
MANUFACTURED HOME
A structure, transportable in one or more sections, which is eight body feet or more in width and 32 body feet or more in length, built on a permanent chassis and designed to be used as a dwelling, with or without a permanent foundation, when connected to the required utilities, and including the plumbing, heating, air-conditioning and electrical systems contained therein. A "manufactured home" shall have been built in conformity with the National Mobile Home Construction and Safety Standards Act of 1974.
MANUFACTURED HOME LOT
A designated portion of a manufactured home park designed for the accommodation of one manufactured home and its accessory buildings or structures for the exclusive use of the occupants.
MANUFACTURED HOME PARK
A tract of land which is used for the placement of two or more manufactured homes for occupancy, excluding sales yards where manufactured homes are displayed but not occupied as a residence.
MANUFACTURED HOME STAND
That part of an individual lot which has been reserved for the placement of the manufactured home, appurtenant structures or additions.
OCCUPIED LOT
A manufactured home lot with a manufactured home in place on the stand thereon.
PARK
A manufactured home park.
PERMIT
A written document issued by the enforcing agency permitting the construction, alteration or expansion of a manufactured home park.
PERSON
Any natural individual, firm, trust, partnership, association or corporation.
