As used in this chapter, the following terms shall have the meanings indicated:
TOWER
Includes any tower, pole, windmill or other structure, whether attached to a building, guyed or freestanding, designed to be used for and/or for the support of any device for the transmission and/or reception of radio frequency signals, including but not limited to broadcast, shortwave, citizen's band, FM or television, microwave or any wind-driven devices, whether used for energy conversion or creation or not.

No person shall cause, suffer or permit the erection and/or maintenance of any tower upon any lands owned by them in the Town of Ogden unless in conformity with the provisions herein set forth.
A. 
Size. No tower erected or maintained within the Town of Ogden shall exceed 50 feet in height, measured from the average ground surface immediately surrounding the site of the tower. Measurements of height shall include any antennas, extensions or other devices extending above the structure of the tower itself.

B. 
Location.

(1) 
No more than one tower shall be located on any lot and shall be located in the rear yard at ground level.
(2) 
No tower shall be located on any lot unless located so as to have a rear and side lot line setback equal to the height of the tower. Measurements of side and rear lot line setback shall be taken at the base of the tower structure at ground level.
(3) 
If a wind energy conversion system is to be placed on any tower, the minimum work-zone distance between the tower base and a property line or power line is the height of the wind energy system, above ground level, including the blades, plus 10% (i.e., 1.1 times the total height of the wind energy system).

(4) 
Towers which will be used for energy conversion shall be located on the lot so as not to produce a level of noise at any lot line greater than the ambient nighttime level.
(5) 
No tower shall be installed unless approval of the same has been granted by the Zoning Board of Appeals of the Town of Ogden, as hereinafter provided, and a building permit obtained therefor.
