For the purpose of this chapter certain terms and words are
herein defined. Words used in the present tense include the future,
the singular number includes plural and the plural the singular; the
words "used for" include the meaning "designed for" and vice versa;
the word "shall" is mandatory and not discretionary; and the word
"may" is permissive.
COMMUNITY PARKING AREA
A parking area used exclusively by the residents of the neighborhood
or customers or persons engaged in the conduct of establishments in
the immediate vicinity of its location, or by those for whom such
establishments are conducted.
CORNER LOT
A lot abutting upon two or more streets at their intersection,
having an interior angle of intersection not greater than 135°.
COURT
An open, unoccupied, unobstructed space, other than a yard,
on the same lot as the building.
CURB LEVEL
The level of the curb in front of the center of the building
or portion thereof under consideration. Where no curb level has been
established the level of the ground at the center of the traveled
portion of the street shall be considered the equivalent of the curb
level and where the building does not adjoin the street the average
level of the proposed grade line of the ground immediately adjacent
to the building as shown on the building plans shall be considered
as the curb level.
DEPTH OF LOT
The mean horizontal distance between the front lot line and
the rear lot line.
DWELLING
A building or portion thereof designed for and used exclusively
for residential occupancy, including one-family, two-family and multiple-family
dwellings, but not including apartment hotels, hospitals, hotels,
boarding houses, institutional homes, residential clubs, rooming houses,
tourist courts, trailers, and the like.

DUPLEX — A dwelling designed for or adapted to and used
exclusively by two families, with separate entrances, for each, but
under one roof and with a wall or part wall between, but not interior
connection between the two connected dwellings. A double house shall
be a duplex, and use of the term double house throughout this chapter
shall mean duplex.

MULTIPLE DWELLING — A dwelling designed for or adapted
to and occupied more or less permanently for residence purposes by
several families in which the rooms are occupied in apartments, suites
or groups, each forming a separate residential unit, with its own
kitchen or kitchenette and bathroom with toilet facilities, "excluding,"
however, structures known as row houses, containing more than two
connected one-family houses.

ONE-FAMILY DWELLING — A separate dwelling used or occupied
exclusively by one family.

GARAGE
A building or structure or any portion thereof in which one
or more vehicles are housed, kept or repaired, provided said repairs
are not obnoxious or offensive by reason of the emission of odor,
dust, smoke gas, vibration or noise; not including exhibition, show
or storage rooms for motor vehicles for sale.
HEIGHT OF BUILDING OR STRUCTURE
The vertical distance measured from the curb level to the
highest point of the roof adjacent to the street wall of flat roofs;
to the deck line of mansard roofs; and to the mean height between
eaves and ridge for gabled, hipped or gambrel roofs.
INNER COURT
A court not extending to a street or way or to a front, side
or rear yard.
INTERIOR LOT
A lot the side lines of which do not abut on a street.
LOT, ACCREDITED ZONING
A lot in a Class "A" Residence District which:
(1)
Fronts upon a public street, or a street in a plan of land subdivision
approved by the planning commission.
(2)
Is insufficient in size to meet the requirements for a one-family
dwelling and provide a buildable area of the lot 25 square feet.
(3)
By documentary evidence acceptable to the Building Inspector,
is shown to be, prior to and continuously since the effective date
of this chapter in separate and distinct ownership from all abutting
land.
LOT, BUILDABLE AREA OF
That portion of a zoning lot or an accredited zoning lot
bounded by the required front and rear and side yards. When a yard
is not required the boundary is the lot line.
LOT, BUILDING LINES OF
The lines that bound the buildable area of the zoning lot
or accredited zoning lot, including front and rear and side building
lines.
LOT, ZONING
A lot, occupied or unoccupied by a main building or structure
and/or accessory structures, fronting upon a public street or a street
in a plan of land subdivision approved by the Planning Commission,
and having such open spaces thereon as are required by this chapter
for one of the uses permitted in the district in which it is located.
MAJOR GARAGE
Any garage not included within the definition of minor garage.
MINOR GARAGE
A garage which is an accessory structure or a part of a main
structure, used exclusively for the parking of automobiles with a
capacity of not more than two passenger automobiles and used for storage
of such automobiles only, provided, however, that a minor garage may
have a three-vehicle capacity providing the area of the lot wherein
such minor garage is to be located shall contain not less than 6,500
square feet.
MOTOR PARKING AREA
Any parking area not included within the definitions of community
parking area or minor parking area.
NONCONFORMING USE
A use of a building or structure or land which does not conform
to the regulations of the use district in which it is situated.
OCCUPANCY MIXED
Occupancy of a building or other structure or land for more
than one use.
OUTER COURT
A court extending to a street or way, or to a front, side
or rear yard.
PARKING AREA
An open space other than a street or way, used for the parking
of only automobiles.
PARKING STALL
A space in a parking area, not less than nine feet wide and
20 feet long, reserved for the parking of only one automobile.
PORCH
A roofed or unroofed structure projecting from the front,
side or rear wall of the building, all sides of which shall be open,
except the side adjoining the building.
SIGN
Any surface, fabric, or device bearing lettered, pictorial
or sculptured matter designed to convey information usually and exposed
to public view; or any structure (including billboard or poster panel)
designed to carry the above visual information.
SIGN, ADVERTISING
A sign which directs attention to a business, commodity,
service or entertainment, conducted, sold or offered primarily elsewhere
but having an outlet for the product or service located upon the same
premises where the sign is displayed.
SIGN, BUSINESS
A sign which directs attention to a business, profession
or industry located upon the same premises where the sign is displayed,
and the type of products sold, manufactured, or assembled, but excluding
advertising signs.
SIGN, IDENTIFICATION
A sign used to identify only the name of the individual and/or
the products and/or the nature of a business, profession, or organization
and/or the activities of an institution occupying the premises upon
which it is displayed.
STABLE, COOP or PEN
Any building, structure or portion thereof which is used
for the shelter or care of horses, cattle, fowl or any other animals.
STORY
That portion of a building or structure included between
the surface of any floor and the surface of the next floor above it,
or if there be no floor above it, then the space between such floor
and the ceiling next above it.
STORY, HALF
A story under a gabled, hipped or gambrel roof the wall plates
of which on at least two opposite exterior walls are not more than
two feet above the finished floor or such story.
STRUCTURAL ALTERATION
Any change in the supporting members of a building or structure
such as bearing walls, partitions, columns, beams or girders.
STRUCTURE
Anything constructed or erected, the use of which demands
a location on the soil or attached to something having a location
on the soil.
TERRACE
A natural or artificial embankment between a building and
its lot lines. The "height of terrace" shall be the difference in
elevation between the curb level and the top of the terrace at the
center of the building wall.
THROUGH LOT
An interior lot having a frontage on two streets or ways.
TRAILER
Any vehicle or portable structure equipped for and used as
sleeping or living quarters for one or more persons, mounted upon
wheels and used as a conveyance on highways or streets, and drawn
by its own or other motive power.
TRAILER PARK
Any camp, trailer camp, trailer court, court camp site, lot,
parcel or tract of land, designed, maintained or intended for the
purpose of supplying a location or accommodations for two or more
trailers, and upon which two or more trailers are parked, and shall
include all buildings used or intended for use as part of the equipment
thereof, whether a charge is made for the use of the trailer park
and its facilities or not. Trailer park shall not include automobile
or trailer sales lots in which unoccupied trailers are parked for
the purpose of inspection or sale.
USE, ACCESSORY
A subordinate use which is clearly incidental and related
to that of a main structure or main use of the land.
VARIANCE
A modification of the literal provisions of this chapter
which the Board is permitted to grant when strict enforcement of said
provisions would cause undue hardship owing to circumstances unique
to the individual property on which the variance is sought.
WAY
A strip of land less than 25 feet wide, which provides access
to property, public or in a plan of land subdivision approved by the
Commission, the boundary lines of which include a roadway and/or sidewalk
area.
YARD
An open space on a lot, other than a court, unoccupied and
unobstructed from the ground to the sky.
YARD, FRONT
A yard extending across the full width of the lot and abutting
the front lot line, the required depth of which yard is a prescribed
minimum distance between the front lot line and a line parallel thereto
on the lot.
YARD, REAR
A yard extending across the full width of the lot and abutting
the rear lot line, the required depth of which yard is a prescribed
minimum distance between the rear lot line and a line parallel thereto
on the lot.
YARD, SIDE
A yard extending from the front yard or front lot line where
no front yard is required, to the rear yard or rear lot line when
no rear yard is required, and abutting a side minimum distance between
the side lot line and a line parallel thereto on the lot.
