A. 
No person shall carry on any occupation, trade, business or cottage industry within the City of Gallatin, Missouri, as hereafter in this Chapter enumerated or defined in subsequent Sections herein without first procuring therefor a license so to do from the City of Gallatin, Missouri.
B. 
All occupation, trade, business or cottage industry within the City limits of Gallatin, Missouri, must fill out an application to obtain a City license. On the application, they must place their business State tax number. All City taxes must be current.
C. 
Workers' Compensation Insurance Required Prior To Issuance Of License.
1. 
No license shall be issued for a contractor in the construction industry as required under the provisions of this Article or pursuant to any other ordinance or Code provision of the City of Gallatin, Missouri, by the City of Gallatin, Missouri, to any person or persons, firm, association, organization, partnership or corporation until such person or entity produces a valid copy of a valid certificate of insurance for workers' compensation coverage if the applicant for the license is required to cover his/her or its liability for workers' compensation.
2. 
Nothing in this Section shall be construed to create or constitute a liability to or cause of action against the City of Gallatin, Missouri, in regard to the issuance or non-issuance of any such license or failure to provide evidence of workers' compensation coverage.
3. 
The City Clerk is directed to take appropriate action, including altering the license application form to require a statement of evidence of workers' compensation insurance.
4. 
It is a violation of this Section to provide fraudulent information relative to workers' compensation insurance in order to obtain or induce the issuance of a license thereunder. Any person who violates any provision of this Section shall be deemed guilty of an ordinance violation and, upon conviction thereof, shall be punished by a fine of not more than five hundred dollars ($500.00) or by imprisonment in the City Jail for not more than three (3) months, or by both such fine and imprisonment.
D. 
Each applicant for a business license under this Chapter shall submit a statement from the Missouri Department of Revenue pursuant to Section 144.083.4, RSMo., stating no tax is due, which statement is a prerequisite to the issuance or renewal of a City business license. The statement required by this Section shall be dated within ninety (90) days of submission of the business license application or renewal application.

A. 
Any person, before engaging in any of the following occupations, trades, business or cottage industry within the City of Gallatin, Missouri, shall first procure from said City a license authorizing such person to carry on such occupation, trade or business. 2. 
Electricians.
a. 
It shall be unlawful for any person, firm, company or corporation to carry on and build in the City of Gallatin, Missouri, or to install electrical wiring in any building for new service or to change any electrical voltage service in any building, or the occupation of electrician in installing electrical wiring in any building within the corporate limits of the City of Gallatin, Missouri, without first procuring from said City a license authorizing such person, firm, company or corporation to carry on the business or trade as such an electrician.
b. 
Any person or firms so securing a license from the City of Gallatin, Missouri, to carry on the business of an electrician in performing the services set forth in Subsection (A)(2)(a) hereof shall pay an annual license fee to the City Clerk of twenty-five dollars ($25.00) per year in the same manner and at the same times as provided for the payment of other licenses required of other trades and occupations within the City of Gallatin, Missouri. Provided, however, that such an annual license fee shall cover all employees of any person, firm, company or corporation performing said services as an electrician in the City of Gallatin.
3. 
Hawker Or Huckster. Any person selling, attempting to sell or expose for sale on the streets of Gallatin, Missouri, either from a vehicle, pack or by any other means any goods, wares and merchandise of any kind, including, but not confined to, produce, fish, meats, fruits, berries, melons, eggs, butter and other agricultural produce shall pay to the City Clerk of Gallatin, Missouri, a fee of ten dollars ($10.00) per day for each and every day such applicant shall sell or attempt to sell or expose for sale any of the goods, wares and merchandise herein described. No person described in this Subsection shall sell or offer to sell or hawk or peddle any article or thing on any street comprising the square of the City of Gallatin, Missouri, or within one (1) block from said square, except in the City parking lot and at such other places as may, from time to time, be set aside by the Board of Aldermen. Nothing herein shall apply to any farmer, gardener or fruit or vine grower engaged in selling the produce of his/her farm, garden, orchard or vineyard or to any merchant or dealer having an established place of business or storehouse in the City of Gallatin, Missouri.
A. 
No person following for a livelihood the profession or calling of minister of the gospel, duly accredited Christian Science practitioner, teacher, professor in a college, priest, lawyer, certified public accountant, dentist, chiropractor, optometrist, chiropodist, or physician or surgeon in this City shall be taxed or made liable to pay any municipal or other corporation tax or license fee of any description whatever for the privilege of following or carrying on such profession or calling, and after December 31, 2003, no investment funds service corporation as defined in Section 143.451, RSMo., may be required to pay any such license fee in excess of twenty-five thousand dollars ($25,000.00) annually, any law, ordinance or Charter to the contrary notwithstanding.
B. 
No person following for a livelihood the profession of insurance agent or broker, veterinarian, architect, professional engineer, land surveyor, auctioneer, or real estate broker or salesman in this City shall be taxed or made liable to pay any municipal or other corporation tax or license fee for the privilege of following or carrying on his/her profession unless that person maintains a business office within the City of Gallatin.

A. 
Definition. As used in this Section, "itinerant merchant" includes all persons who engage in or conduct within the City a temporary or transient business of selling merchandise for a period of not more than one hundred twenty (120) days, but shall not include salesmen selling merchandise to businesses licensed under preceding Sections of this Chapter.
B. 
License; Fee; Term.
1. 
Before beginning business, each itinerant merchant shall apply to and receive from the City Clerk a license for doing business as such and shall, before receiving such license, pay a license fee of twenty-five dollars ($25.00), unless exempt from licensure. Such license shall entitle the holder thereof to conduct the business stated therein for a period of three (3) months from the date of issuance. Such license shall not be transferable or assignable. No license shall be issued for conduct of more than one (1) business or of business at more than one (1) location. All licenses issued thereunder shall state particularly the merchandise to be sold, the location of the business, the full name and permanent address of the merchant and of all persons working for him/her, and the driver's license and tax identification numbers of the merchant.
2. 
The City Clerk is authorized to issue, in lieu of the three-month license, an itinerant merchant one-day license upon receipt of a fee of two dollars ($2.00), and such license shall be valid only for the date stated thereon.
C. 
State Or Federal License Or Proof Of Exemption Necessary. No license shall be issued to an itinerant merchant until his/her State or Federal tax or other license for conducting business as a seller of goods for at least the same times and goods as applied for to the City has been presented to the Clerk who shall inspect and photocopy same and attach the copy to the City license application. The City Clerk shall issue a license without requiring payment of any fee upon the applicant's status as exempt under State or Federal law from all local license fee requirements. Notwithstanding any claim of exemption, it shall be unlawful for any itinerant merchant to engage in or conduct any business in the City without a license therefor.

Where any person engages in more than one (1) form of occupation, trade or business, as provided in Section 605.020, Schedule of Licenses, set out herein, at a single location, under the same ownership, same management, same building and roof for which a license is required, such person shall pay for a license only for the occupation, trade, business or cottage industry requiring the highest tax.

The various occupations, trades, business or cottage industry listed in Section 605.020, Schedule of Licenses, of this Article shall be construed in their broadest sense; in all cases of doubt, such occupation, trade, business or cottage industry listed in the Schedule of Licenses shall be presumed to be applicable to the prospective licensee.

A license shall be required before any person may engage in any of the occupations, trades, business or cottage industry as may be required by this Chapter, and when such licenses have been established on an annual or yearly basis, it shall be effective and in force from July 1 until the 30th day of June. Licenses provided for in this Chapter on a daily or weekly basis shall state the time and dates for which the license is issued.

All applicants for license under the provisions of this Chapter shall apply in person or by agent at the office of the City Clerk in the City of Gallatin, Missouri, and shall pay to such City Clerk the amount of license tax levied on such trade, business, occupation or cottage industry as herein provided for and required. If, upon examination, the City Clerk determines that all of the provisions and requirements of this Chapter have been complied with and that the applicant is entitled to a license, such Clerk shall issue a license to such person which license shall also be signed by the Mayor and/or City Clerk of Gallatin, Missouri, with the Seal of the City thereto affixed.

Every person licensed in any occupation, trade or business under the provisions of this Chapter shall post in a conspicuous place in his/her place of business the license herein provided where such person occupies a place of business; in the event the licensee does not occupy a permanent place of business, such person shall carry such license on his/her person at all times when engaged in the occupation, trade, business or cottage industry for which the license was issued, and every licensee shall exhibit said license so issued on demand by any officer of the City of Gallatin, Missouri, or of any prospective customer.

Each merchant shall renew their license each year on July 1.

Any business operating an establishment within the City limits of Gallatin, Missouri, without a City license is subject to a fine as stated in Section 100.220 of this Code.

A. 
Any license issued by the City pursuant to the provisions of this Chapter may be revoked by the Board of Aldermen for any of the following reasons, as well as for any other reasons specified in this Chapter:
1. 
Any failure to comply with or any violation of any provisions of this Chapter, or any other ordinance of the City regulating the business, occupation or activity licensed, or the Statutes of the State of Missouri by any licensee.
2. 
Violation of the terms and conditions upon which the license was issued.
3. 
Failure of the licensee to pay any tax or obligation due to the City.
4. 
Any misrepresentation or false statement in the application for a license required herein.
5. 
Failure to display the license required herein.
B. 
Revocation of any license shall be in addition to any other penalty or penalties which may be imposed pursuant to these provisions.

A. 
In any case in which a complaint has been made to the Board of Aldermen, or in which the Board of Aldermen have on their own determined that cause may exist for the revocation of a license under the provisions of this Chapter, the following procedures shall be followed:
1. 
The Board of Aldermen shall set a date for a hearing to consider the question of revocation.
2. 
At least sixty (60) days prior to said hearing, written notice shall be mailed to the licensee, by registered mail, return receipt requested, to his/her last known address as shown in the records of the City Clerk advising the licensee of the time, date and place of hearing and of the reason for considering the revocation of his/her license.
3. 
During the pendency of this hearing before the Board of Aldermen, the licensee shall be permitted to continue the operation of his/her business.
4. 
At the hearing set by the Board of Aldermen, the Board of Aldermen shall hear all relevant and material evidence justifying the retention of the license.
5. 
The licensee may be present in person and/or by his/her attorney and may present evidence.
6. 
After hearing the evidence presented, the Board of Aldermen shall vote on the issue of whether the subject license shall be revoked.
7. 
The affirmative vote of a majority of the Board of Aldermen shall be necessary to revoke any license.

The City Clerk shall keep a book in which he/she shall register all licenses granted, showing the date, commencement and termination of each license, to whom granted, for what trade, business, occupation or cottage industry, the location thereof, and the amount of the license tax paid.
