Drilling and blasting in the Town of Thompson
shall be governed by and be performed in accordance herewith.

No drilling or blasting shall be permitted in
the Town of Thompson unless a permit therefor shall be issued by the
Town Clerk. Such permit shall be in a form as shall be approved by
the Town Board by resolution. There shall be paid at the time of the
filing of the permit application a nonrefundable fee as set by resolution
of the Town Board.
Each applicant for a permit shall provide evidence
of liability insurance in such amount as shall be recommended by the
Town Engineer and/or the Town Building Inspector, naming the Town
as an additional insured under the applicant's insurance policy and
evidenced by a certificate of insurance issued in the name of the
Town.
Prior to the commencement of any drilling or
blasting operation, a meeting shall be held at the Town Hall with
the Town Engineer, Town Building Inspector, contractor, project blaster
and owner of the property involved or his duly designated representative
as to the method, manner and procedure of the proposed blasting operation.
Blasting shall be performed only at such time
as the Town Engineer and/or Town Building Inspector shall approve
and designate. The contractor or project blaster shall perform the
blasting operations in accordance with any restrictions which may
be imposed by the Town in connection therewith. Whenever explosives
shall be used, they shall be of such character and strength as shall
be permitted by statute, rule or regulation pertaining thereto. The
Town specifically reserves the right to limit and/or specify the maximum
size of any blasting charge.

The contractor shall employ only experienced
supervisors and workmen in the handling, loading and firing of explosives.
The contractor shall in all respects comply with the requirements
of Industrial Code Rule 39 of the State of New York, Department of
Labor, Industrial Board of Appeals, and the applicable sections of
the New York State Labor Law, which provide for the possession, handling,
storage and transportation of all explosives.
