[Ord. 2005-2, 4/4/2005]
In addition to all those who may by law have the authority to
enforce and/or prosecute, it is specifically designated that it shall
be the duty of the Borough Council of the Borough of Watsontown to
enforce this chapter.
[Ord. 2005-2, 4/4/2005]
Any person, partnership or corporation who or which has violated
the provisions of this chapter shall, upon being found liable therefor
in a civil enforcement proceeding commenced by the municipality, pay
a judgment of not more than $500 plus all court costs, including reasonable
attorney fees incurred by the municipality as a result thereof. No
judgment shall commence or be imposed, levied or be payable until
the date of the determination of a violation by the Magisterial District
Judge. If the defendant neither pays nor timely appeals the judgment,
the municipality may enforce the judgment pursuant to the applicable
rules of civil procedure. Each day that a violation continues shall
constitute a separate violation, unless the Magisterial District Judge
determining that there has been a violation further determines that
there was a good faith basis for the person, partnership or corporation
violating the ordinance to have believed that there was no such violation,
in which event there shall be deemed to have been only one such violation
until the fifth day following the date of the determination of a violation
by the Magisterial District Judge and thereafter each day that a violation
continues shall constitute a separate violation.
[Ord. 2005-2, 4/4/2005]
This chapter may, from time to time, be revised, modified or
amended as prescribed by local and state laws.
[Ord. 2005-2, 4/4/2005]
The Commission shall keep a record of its findings, decisions
and recommendations relative to all subdivision plans filed with it
for review.
[Ord. 2005-2, 4/4/2005]
Wherever there is a difference between the minimum standards
or dimensions specified herein and those contained in the Watsontown
Borough Zoning Ordinance, or other official regulation, the highest
standard shall apply; provided, however, that in any event the zoning
requirements shall prevail regarding setback requirements and other
land area requirements.
