The Chief of Police is the chief administrator and executive
officer of the Police Department and shall have the control of the
government, administration, disposition and discipline of the Police
Department and the police force of said Department.
The Chief of Police shall make, adopt and enforce such reasonable
rules, orders and regulations, not inconsistent with the Constitution
and the laws of the State of New York, and these rules and regulations
as may be necessary to effect the prompt and efficient exercise of
all powers conferred by law and the performance of all duties imposed
upon any person in the Police Department.
The Chief of Police may order any and all members of the Police
Force to active duty as the Chief may deem proper when an emergency
arises, which in the Chief's judgment requires the service of extra
police officers, as per § 971 of the Unconsolidated Laws
of the State of New York. The Chief will report, in writing, the Chief's
actions as relates to said emergency calls.
The Chief of Police will report to the scene of all serious
and extreme fires, riots and unlawful assemblies within the City,
when physically able.
All transfers or permanent details or assignments will be made
by the Chief of Police.
The Chief of Police shall instruct the commanding officers in
all their duties and ensure that they give similar instructions to
their commands.
The Chief of Police shall properly divide the Police Force and
arrange for day, night and special police service shifts. The commanding
officer in charge shall, subject to the approval of the Chief of Police,
designate the beats, posts and the patrol duties of each member under
the officer's command.
The Chief of Police shall, upon the appointment of a new member
to the Police Department, provide the new member with a copy of the
rules and regulations and operating policies of the Police Department.
All complaints or questions as to Department policy shall be
taken up with the Chief of Police.
A. The Chief of Police shall keep, or cause to be kept, suitable records
in which the following will be entered:
(1) The name, age and address of all members and employees of the Police
Department.
(2) The date and appointment to the Police Department.
(3) When dismissed or discharged and for what reason.
(5) Any violations of rules and regulations or laws of the State of New
York or any federal violations.
(6) Any commendations or letters of exceptional police duty.
B. The above will be placed in the personnel file of each member of
the Department.
The Chief of Police shall make a monthly report to the Mayor
of the City of Plattsburgh on the activities of the Department.
The Chief of Police may issue general orders which are not in
conflict with these departmental rules and regulations from time to
time as necessary. The Chief of Police will supply each member of
the Department with a copy of any general orders. A violation of a
general order will be considered a breach of the rules and regulations
of the Department and an act of insubordination by any member of the
Department that violates a general order.
The Chief of Police will assure the accurate preparation, maintenance
and forwarding of all reports and records as relates to the operation
of the Police Department.
The Chief of Police shall cause all books and records required
to be kept in conformity with the rules and regulations of the Police
Department, to be checked daily.
The Chief of Police shall account for the property assigned
and issued for the use of the members of the Department and shall
be responsible for the proper care, economical use, sufficiency and
serviceability thereof and shall make frequent inspections of same.
The Chief of Police shall submit the annual budget of the Police
Department to the Mayor of the City of Plattsburgh.
A. The Chief of Police shall carefully investigate any reported death
or injury of any member of the Department that occurs while a member
is acting in the discharge of the member's duties, and the Chief of
Police shall forward a full written report to the Mayor of the City
of Plattsburgh.
B. The Chief of Police shall make, or cause to be made, an investigation
of the circumstances of any injury of a member of the Department.
This shall include an interview and statement of any and all witnesses.
The Chief shall make a report of the results of the investigation
showing whether or not, in the Chief's opinion, such injury was sustained
in the performance of the police duty or whether negligence on the
part of the injured officer or member of the Department contributed
to the injury.
The Chief of Police, may, at the Chief's discretion, suspend
from duty and file charges, under § 75 of the Civil Service
Law of the State of New York, against any member of the Department
when, after thorough investigation, it is established that said member
violated the rules and/or regulations of the Police Department. A
copy is to be forwarded immediately to the Mayor of the City of Plattsburgh.
The Chief of Police shall, when a member of the Police Department
severs connection with the Department, secure all the equipment furnished
to said member by the City of Plattsburgh. In the event that any of
the equipment has been lost or damaged beyond repair, said member
shall replace or reimburse the City of Plattsburgh the full value
of said equipment.
The Chief of Police shall cause the prisoners who have been
arrested and detained at the Police Department to be processed in
the courts of proper jurisdiction as required by the laws of New York
State.

A probationary police officer is one appointed from an active
Civil Service eligibility list and must serve an eight-week to 78-week
probationary period pursuant to Civil Service Law and other applicable
state laws.
The Chief of Police shall establish evaluation programs, establish
objectives, draft specifications for equipment and develop plans to
meet the departmental needs.
The Chief of Police shall control all expenditures and purchases
by the Police Department.
The Chief of Police shall cooperate with all law enforcement
agencies and officers in matters of mutual interest.
The Chief of Police shall supply outside service by members
of the Police Department only as set forth in §§ 209-f
through 209-m of the General Municipal Law of the State of New York.
The Chief of Police shall ensure the security and care of prisoners
and of the sick, injured or unconscious person and shall obtain medical
care as needed.
The Chief of Police may, with the approval of the Mayor of the
City of Plattsburgh, excuse from one tour of duty a member of the
Department who has performed any exceptional act or deed of particular
merit which, in the Chief's opinion, deserves recognition. A brief
but comprehensive report shall be forwarded to the Mayor, and a copy
will be placed in the employee's personnel file.
