All words used in this chapter shall carry their customary meanings except where specifically defined herein. Words used in the present tense shall include the future. The singular numbers shall include the plural, and the plural shall include the singular. The word "shall" is always mandatory, and not permissive; the word "may" is permissive. The words "used" or "occupied" as applied to any land or structures shall be construed to include the words "intended, arranged, designed to be used or occupied." The word "person" shall include an individual, corporation, partnership, incorporated association or any other entity.
The following words and phrases shall have the meaning specified for this chapter:
ABANDONMENT
When the landowner fails to meet the schedule fixed in the tentative approval and does not appear to request an extension prior to the schedule date, or when final approval has been granted and the developer fails to start work within one year, or when work is stopped for a period of one year. If the landowner fails to meet the above deadlines and within such time does not request an extension, abandonment shall be considered to have taken place.
ABUTTING
Having a common border with or being separated from such common border by an alley, right-of-way, or easement.
ACCESS
A means of approach or entry to or exit from a lot, a site or a parcel.
ACCESSORY FARM STRUCTURE
A structure which is on the same lot with, but detached from, the principal farm structure and which is customarily incidental and subordinate to the principal agricultural use of the lot, including barns, silos, stables and the like.
ACCESSORY STRUCTURE
A structure which is on the same lot with, but detached from, the principal building or structure and which is customarily incidental and subordinate to the principal building or structure, including, but not limited to, carports, swimming pools, decks, fences, walls, gazebos, signs, air-conditioning units and the like.
ACCESSORY USE
A use related to the principal use which is customarily incidental and subordinate to the principal use or structure and located on the same lot with such principal use or structure.
ADDRESS MARKER
A marker, not more than two square feet in size, indicating address and/or name of a residential property or indicating the address of a commercial property.
ADJACENT
Within proximity to or sharing a common boundary.
ADULT ENTERTAINMENT ESTABLISHMENT
An establishment in which 20% or more of the net retail floor area offers for sale, for rent or lease, for loan, or for view upon the premises, of pictures, photographs, drawings, prints, images, sculpture, still film, motion-picture film, videotape, or similar visual presentations distinguished or characterized by an emphasis on sexual conduct or sexually explicit nudity, or books, pamphlets, magazines, printed or digital matter or sound recordings containing explicit and detailed descriptions or narrative accounts distinguished or characterized by an emphasis on sexual conduct, or offers sexual devices for sale. This use also includes any business establishment that may or may not dispense food and/or beverages for consumption on the premises and which features live shows for public viewing in which all or some of the performers, both men and women, are displaying nudity or are engaging in sexual conduct, sexual excitement or sadomasochistic abuse (e.g., topless dancers, strippers, etc.).
AGRICULTURAL SALES, ON-SITE
An accessory use to an agricultural use where products grown or produced on the property are offered for sale. This use shall include a seasonal roadside stand.
AGRICULTURE
Growing or producing for use on the lot or for sale domestic livestock, farm grains, feeds or hay, fruits, nursery stock, vegetables, dairy products, poultry, eggs or other crops or produce typical of farm activity in the County of Washington and related use of equipment and accessory farm buildings and structures necessary for the foregoing purposes, including, but not limited to, barns, stables, corn cribs, silos and the like.
ALLEY
A functional service way providing a secondary public means of access to abutting properties.
ALTERATION, STRUCTURAL
See "structural alteration."
AMUSEMENT, COMMERCIAL
An enterprise operated for profit by other than a public entity completely within an enclosed structure for the pursuit of sports, recreation and entertainment activities, including, but not limited to, such establishment as theaters, dance halls, bowling alleys, fitness centers, indoor racquet clubs and the like.
AMUSEMENT, OUTDOOR
An enterprise operated for profit by other than a public entity which is conducted wholly or partly outside an enclosed structure for the pursuit of sports, recreation and amusement activities, including, but not limited to, such establishments as drive-in theaters, arenas, stadia, racetracks, swimming pools, ball fields, parks, tennis courts, miniature golf courses and the like.
APPLICANT
A landowner or developer who has submitted a plan for approval under the terms of this chapter.
ARTERIAL ROAD
A public street which serves large volumes of high-speed and long-distance traffic. Roads classified as arterial in the Township are Pennsylvania Route 136 and Thomas, Venetia, and Linden Roads.
ARTISAN WORKSPACE
An establishment, in conjunction with or without a dwelling, designed for the preparation, instruction, display and/or sale of individually crafted work related to artwork, jewelry, furniture, sculpture, pottery, leathercraft, hand-woven articles, literature or performance of fine arts such as but not limited to drawing, vocal or instrumental music such as a music or art studio.
ASSISTED LIVING FACILITY
A residential facility which provides services and supervision for two or more persons not related to the operator who, because of a handicap or disability, require supervision and services to meet their needs but do not require the services of a nursing home or hospital as defined herein. "Assisted living facility" shall include group care facility and group home. "Assisted living facility" shall not include custodial care facility.
BANK or FINANCIAL INSTITUTION
A business establishment where the principal business is the receipt, disbursement, or exchange of funds and currencies such as banks, savings, loans, credit unions or check cashing establishments. Establishment may or may not offer a drive-through window.
BANQUET HALL
A permanent structure specifically designed and constructed for an assemblage of persons and including catering facilities, for the purpose of hosting weddings, receptions, and other gatherings.

BARN
A building, accessory to a farm, that is used for storing agricultural equipment, hay, grain, and other crops, and often for housing livestock.

BAR OR TAVERN
A business establishment which provides on-site alcoholic beverage sales for drinking on the premises, where food may be served, where live entertainment (not including adult entertainment) may also be provided, and where minors are not admitted unless accompanied by a parent or guardian. This use may include an establishment with on-site brewing that produces less than 15,000 barrels of brewed beverages per year.
BASEMENT
A story having more than 50% of its wall area below the grade of the surrounding ground.
BED-AND-BREAKFAST
A dwelling that is the principal residence of the operator where no more than four bedrooms are offered to transient overnight guests for compensation and where the only meal served and included with the overnight accommodations is breakfast.
BILLBOARD
A sign that conveys information regarding an establishment, an activity, a person, a product, or a service that is unrelated to or unavailable on the premises on which the sign is located; such a sign is a principal use of land.
BOARDER
An individual(s) other than a member of the family occupying the dwelling unit, or part thereof, who, for a consideration, is furnished sleeping accommodations and may be furnished meals or other services as part of the consideration.
BOARDINGHOUSE
A building arranged or used for overnight lodging by three or more persons, but not exceeding 10 persons, with or without meals, for compensation by transient residents arriving upon their own accord. Overnight lodging occurs in individual sleeping rooms with no cooking facilities. A boardinghouse may include common areas and a common kitchen available for use by residents.
BUFFER AREA or BUFFERYARD
A landscaped area of a certain depth specified by this chapter which shall be planted and maintained in trees, grass, ground cover, shrubs, bushes or other natural landscaping material and shall consist of a mix of types and sizes of plant material which within three years of planting meets the standard of providing a year-round visual screen at least six feet in height or an approved existing natural or constructed physical barrier which duplicates the effect of the required buffer area.
BUILDING
A roofed structure enclosed by walls to be used for shelter, enclosure or protection of persons, goods, materials, or animals.
BUILDING COVERAGE
That percentage of the lot area covered by the buildings. In determining building coverage, cornices, eaves and gutters shall be excluded.
BUILDING HEIGHT
The vertical distance from the average elevation at grade level to the highest point of the roof.
BUILDING LINE (SETBACK)
A line parallel to, or concentric with, the right-of-way line of the abutting road right-of-way which is at a distance therefrom equal to the depth of the front yard required for the zoning district in which the lot is located.
BUILDING MATERIALS SALES OR STORAGE
A business establishment specializing in the sale and/or short- or long-term storage of wholesale and/or retail construction supplies and materials for home improvement. This use may include a lot or parcel used for the permanent storage of construction equipment and supplies, but not including the sale of supplies or the repair or sale of heavy equipment.
BUILDING, NONCONFORMING
A lawfully existing building or other structure which contains a conforming use, but which does not comply with the applicable lot size requirements, lot coverage limitations, off-street parking requirements or other dimensional requirements related to the characteristics of the structure or its location on the lot.
BUILDING, PRINCIPAL
See "principal building."
BUILDING, RESIDENTIAL
A building which is used for the residential occupancy of one or more families or group living arrangements.
CAR WASH
A structure used for the purposes of cleaning or reconditioning the exterior and/or interior surfaces of automotive vehicles. Not including an incidental one-bay washing facility in a service station, where washing facilities are purely incidental to the operation of said service station. This use includes any self-operated facility not requiring attendants or employees, regardless of capacity.
CARPORT
Any structure having a roof supported by columns or walls having one or more open sides for the storage of vehicles.
CEMETERY
A lot used for, or intended to be used for, the burial of human and/or domesticated animal remains, including, but not limited to columbariums, mausoleums, and mortuaries when operated in conjunction with the cemetery and within its boundaries.
CHANGE IN USE OR OCCUPANCY
Any substantive change from one use or occupancy to another of a building, structure or lot.
CLEAR SIGHT TRIANGLE
An area of unobstructed vision for vehicle drivers at street intersections defined by lines of sight between points at a given distance from the intersection of street center lines.
CLINIC, MEDICAL OR DENTAL
Any outpatient establishment licensed by the commonwealth where human patients are examined and treated by health care personnel.
CLINIC, VETERINARY
An establishment where animals are examined and treated by licensed veterinarians and which may include kennels for temporary boarding during treatment.
CLUB or LODGE
Any establishment operated by an organization for social, recreational, educational, fraternal or similar purposes, but open only to members and their guests and not to the general public.
COLLECTOR ROAD
A public street which, in addition to giving access to abutting lots, intercepts local streets and provides a route for carrying considerable volumes of local traffic to community facilities and arterial roads.
COMMISSION, PLANNING
The Nottingham Township Planning Commission of Washington County, Pennsylvania.
COMMON AREA
All those areas in a planned development, including open space, owned or leased and maintained by an association or other combination of persons for the benefit of the residents of the planned development and, if owned under the Uniform Condominium Act,[1] including all common elements designated for the use of all dwelling unit owners.
COMMONWEALTH
The Commonwealth of Pennsylvania.
COMMUNICATIONS TOWER
A structure, including any guy wires and one or more antennas, principally intended to support facilities for transmission of broadcast for commercial or public VHF and UHF television or radio broadcast, two-way radio, common carriers, cellular telephone, fixed point microwave, low power television or AM radio, including accessory equipment related to telecommunications. "Communications tower" does not include hobby/personal use antennas and supportive structures for private, noncommercial and amateur purposes, including but not limited to ham radios and citizen band radios.
CONDITIONAL USE
An authorized use which may be granted only by the Supervisors pursuant to standards and criteria prescribed in this chapter, after public hearing, review and recommendations by the Township Planning Commission and public hearing by the Supervisors.
CONFERENCE CENTER
A facility with overnight lodging to accommodate all participants in an event, at which meetings, seminars and conferences are conducted.

CONSTRUCTION
The construction, reconstruction, renovation, extension, expansion, structural alteration or relocation of a structure, including the placement of mobile homes.
CONTRACTOR'S YARD
An establishment that may or may not include administrative offices for a business that provides construction, remodeling, home improvement, land development and related services, which may also involve the outdoor storage of all or part of the materials, equipment or vehicles used in the business and also may include the repair of vehicles owned or operated by the occupant of the land.

CONVENIENCE STORE
A business establishment not exceeding 5,000 square feet of selling area that offers convenience goods for sale, such as prepackaged or preprepared food items, tobacco, periodicals, and other household goods and may or may not offer the sale of fuel/energy for vehicles.
COUNTY
Washington County, Pennsylvania.
COVERAGE
See "lot coverage."
CREMATORIUM
A location containing properly installed, certified apparatus intended for use in the act of cremation.
CUSTODIAL CARE FACILITY
A facility providing custodial care and/or treatment in a supervised, protective environment for persons residing or attending by court placement or supervision. This includes facilities for people on probation or parole who are leaving a correctional facility, or people who are placed in such a facility as a form of alternate sentencing.
CUSTOMARY ACCESSORY USE, NONRESIDENTIAL
A use related to the principal nonresidential use which is customarily incidental and subordinate to the principal use or structure and located on the same lot with such principal use or structure.
CUSTOMARY ACCESSORY USE, RESIDENTIAL
A use related to the principal residential use which is customarily incidental and subordinate to the principal use or structure and located on the same lot with such principal use or structure.
DAY-CARE CENTER
A facility, licensed by the commonwealth, located within a building which is not used as a dwelling unit, for the care during part of a twenty-four-hour day of children under the age of 16 or handicapped or elderly persons.
DAY-CARE HOME
A facility, licensed by the commonwealth, located within a dwelling, for the care on a regular basis during part of a twenty-four-hour day of not more than six children under 16 years of age, excluding care provided to children who are relatives of the provider. Such use shall be secondary to the use of the dwelling for living purposes and persons who do not reside in the dwelling shall not be employed.
dBA
A-weighted decibel, abbreviated "dBA," is an expression of the relative loudness of sounds in air as perceived by the human ear.
DECK
A structure which may or may not be enclosed and which projects out from the main wall of a building or structure and does not have a roof.
DEDICATION
The transfer of property interests from private to public ownership for a public purpose. The transfer may be of a fee simple interest or of a less than fee interest, including an easement.
DENSITY, DWELLING UNIT
See "dwelling unit density."
DENSITY, SITE
A calculation of the number of dwelling units permitted on a site.

DEVELOPMENT
The division of a parcel of land into two or more parcels; the construction, reconstruction, conversion, structural alteration, relocation or enlargement of any buildings; any use or change in use of any buildings or land; or extension of any use of land, for which permission may be required pursuant to this chapter.
DISTRICT, ZONING
An area of parcels in the Township in which regulations under this chapter uniformly apply. The boundaries of each district are shown on the Zoning Map.
DRILLING
Any digging or boring of a new well to explore, develop or produce oil, gas or other hydrocarbons, or to inject gas, water or any other fluid or substance into the earth.
DRILLING EQUIPMENT
The derrick, all parts and appurtenances to such structures, and every piece of apparatus, machinery or equipment used, erected or maintained for use in connection with drilling.
DRIVEWAY
A private area used exclusively for vehicular circulation and ingress and egress to a street by the owner or owners or visitors of the lot.
DWELLING
Any building designed or used as permanent living quarters for one or more families, not including hotels, motels or lodging or boardinghouses.
DWELLING UNIT
One or more rooms which are used as quarters for one family and having permanent facilities for sleeping, cooking and eating, as well as sanitary facilities.
DWELLING UNIT DENSITY
The number of dwelling units authorized by this chapter per acre of land.
DWELLING, MULTIFAMILY
A residential building or portion thereof containing three or more dwelling units.
DWELLING, SINGLE-FAMILY ATTACHED
A residential building which contains at least three, but no more than eight, dwelling units, each for the exclusive use by one family, where each unit has a separate entrance and direct access to the outdoors which is not shared by other dwelling units and which is attached to another dwelling unit by continuous vertical walls without opening from basement to roof.
DWELLING, SINGLE-FAMILY DETACHED
A residential building containing one dwelling unit and which is the only principal building on the lot.
DWELLING, TWO-FAMILY DETACHED
A residential building containing two independent dwelling units, each having a separate entrance, and which is the only principal building on the lot.
EASEMENT
Authorization by a lot owner of the use by another and for a specified purpose of any designated part of the owner's lot.
EMERGENCY SERVICES
A building, structure and/or lot used for the maintenance, fueling, storage, dispatching or parking of vehicles and/or equipment utilized to provide private or public rescue or ambulatory services, fire and/or police services.
EQUESTRIAN FACILITY
A facility maintained for the primary purpose of training or competing horses (or similar equids).
ESSENTIAL SERVICES
The erection, construction, alteration or maintenance by public utilities or municipal or other governmental agencies of underground or overhead gas, electrical, steam or water transmission, disposal or distribution systems, including poles, wires, mains, drains, sewers, pipes, conduits, cables, fire alarm boxes, police call boxes, traffic signals, hydrants, street signs, off-street parking spaces and other similar equipment and accessories in connection therewith reasonably necessary for the furnishing of adequate service by such public utilities or municipal or other governmental agencies or for the public health, safety or general welfare, but not including buildings.
FARM
The use of land which shall include, but not be limited to, the tilling of the soil, the raising of crops, horticulture, apiculture (beekeeping), floriculture, viticulture and gardening. The production, keeping or maintenance, for sale, lease or personal use, of plants and animals useful to man, including but not limited to forages and sod crops; grains and seed crops; dairy animals and dairy products, poultry and poultry products: livestock, including beef cattle, sheep, swine, mules, or goats, or any mutations or hybrids thereof, including the breeding and grazing of any or all of such animals/plants: bees and apiary products; fur animals; trees and forest products: fruits of all kinds, including grapes, nuts and berries; vegetables; nursery, floral, ornamental and greenhouse products; or lands devoted to a soil conservation program. This use does not include commercial farms or equestrian facilities.
FARM ANIMALS
Animals (such as cows, horses, pigs, sheep, goats, llamas, and the like) kept or raised especially on a farm and for profit.
FARM, COMMERCIAL
Intensive agricultural uses involving farm animals that include but are not limited to slaughter areas; processing of manure; concentrated animal feeding operations; production of animal goods for wholesale; or any use considered a confined livestock operation or concentrated animal feeding operation pursuant to federal regulations. The intensity of such uses may be described by the high concentration of farm animals, amount of animal waste produced or handled, amount of animal feed consumed, or other factors such that the use is distinguishable as a commercial farm from a typical farm or a typical farm in Nottingham Township. Such use does not include hobby farm or farm.
FARM, HOBBY
An agricultural land use that includes the keeping of farm animals or the growing of crops for sale, with a minimum of three acres where agricultural activities are conducted by the residents thereof, but where such activities are not the principal source of employment or income for the property owner.
FENCE
A fabricated barrier used to enclose an area of land.
FINANCIAL INSTITUTION
See "bank."
FLAG
Any fabric, banner or bunting containing distinctive colors, patterns or symbols used as a symbol of a government political subdivision, religious, education or corporate organization if such flags are displayed for noncommercial purposes.
FLOOD
A temporary inundation of normally dry land areas.
FLOODPLAIN
All land within the floodplain identified by the US Army Corps of Engineers Study for Nottingham Township shall be considered floodplain land.
FLOOR AREA
The sum of the gross horizontal area of the several floors of a principal building or buildings on the same lot. All dimensions shall be measured between exterior faces of walls.
FOOTCANDLE
A unit used to measure the amount of light falling on a surface at a point on a surface which is one foot from, and perpendicular to, a source of illumination that produces one uniform candela.
FORESTRY
The management of forests and timber lands when practiced in accordance with accepted silvicultural principles, through developing, cultivating, harvesting, transporting and selling trees for commercial purposes, which does not involve any land development.
FRONTAGE
The portion of a lot between the building facade and the lot line that fronts the thoroughfare or a civic open space or the privately held portion between the building facade and the lot line.
FUNERAL HOME or MORTUARY
A building licensed by the commonwealth that contains a suitable storage room for the deceased and may include embalming facilities and rooms for the display of burial ceremonies of the deceased, but excludes crematories.
GARAGE
A building or structure part thereof, used or intended to be used for the parking and storage of motor vehicles.
GARAGE, PRIVATE
An accessory structure or part of a principal building used only for the storage of private motor vehicles and other personal effects of the occupants of the principal structure.
GARAGE, PUBLIC
Any garage, other than a private garage, available to the general public which is used for storage, parking, or rental of motor vehicles, but which is not used for the repair or maintenance of motor vehicles.
GARAGE, REPAIR
A building, or part thereof, used for the servicing and repairing of motor vehicles, including engine overhaul and body work where all storage of parts and dismantled vehicles and all repair work is conducted entirely inside an enclosed building.
GARDEN CENTER, NURSERY or GREENHOUSE
An establishment related to growing and sales of ornamental plants including the following:
A. 
A business enterprise which conducts the retail of plants grown off-site or on-site, as well as accessory items (but not power equipment such as gas or electric lawnmowers and farm implements) directly related to their care and maintenance. The accessory items normally sold are clay pots, potting soil, fertilizers, insecticides, hanging baskets, rakes and shovels.
B. 
A facility whose roof and sides are made largely of glass or other transparent or translucent material and in which the temperature and humidity can be regulated for the cultivation of delicate or out-of-season plants for subsequent sale or enjoyment.
GAS
Any fluid, either combustible or noncombustible, which is produced in a natural state from the earth and which maintains a gaseous or rarefied state at standard temperature and pressure conditions and or the gaseous components or vapors occurring in or derived from petroleum or natural gas.
GAS STATION
A building(s), premises or portions thereof which are used, arranged, designed, or intended to be used for the retail sale of gasoline or other fuel for motor vehicles. Gas stations may include the operation of a convenience food store in conjunction with the retail sale of petroleum products.
GFA
See "gross floor area."
GOLF COURSE
An area of land laid out for golf with a series of nine or 18 holes each including tee, fairway, and putting green and often one or more natural or artificial hazards.
GROSS DENSITY
The maximum number of dwelling units authorized per acre of land, determined based on the total acreage in the planned residential development site, including the acreage in open space, as well as acreage devoted to residential and nonresidential uses.
GROSS FLOOR AREA
The sum of the gross horizontal areas of all the floors of a building and its accessory structures on the same lot, excluding cellar and basement floor areas but including the area of roofed porches and roofed terraces. All dimensions shall be measured between exterior faces of walls.
GROUP CARE FACILITY
A facility, licensed by the commonwealth, which provides room and board and specialized services to more than eight residents who are in need of supervision, excluding dependent children adjudicated by the criminal court system under the age of 18, mentally or physically disabled persons of any age, and elderly persons, 62 or more years of age, and the required number of supervisors on each shift, who may or may not reside on the premises. The facility shall be licensed by the commonwealth to provide specialized health, social and/or rehabilitative services to the residents. Twenty-four-hour supervision shall be provided by staff qualified in accordance with the regulations of the commonwealth.
HOBBY/PERSONAL USE TOWERS AND ANTENNAS
Accessory use towers and antennas typically associated with leisure activities in and around a residence pursuant to FCC-licensed activities such as amateur radio and citizen's band radio and unlicensed activities such as listening to short wave radio broadcasts or TV broadcasts. Antennas in nonresidential areas which exist solely to support such hobby activity are included.
HOME OCCUPATION
Any business conducted within a residential dwelling whereas said business is not a no-impact home-based business.
HOSPITAL
An establishment licensed by the commonwealth for the inpatient and outpatient short-term care of patients suffering from physical or mental illnesses, and which may or may not include facilities for major surgery and which may be publicly or privately operated.
IMPERVIOUS SURFACE
Any material that prevents, impedes, or slows infiltration or absorption of stormwater directly into the ground at the rate of absorption of vegetation-bearing soils, including building, asphalt, concrete, gravel and other surfaces.
INDUSTRIAL, HEAVY
The mechanical or chemical transformation of raw materials or substances into new products or other raw materials, including the assembling of component parts, the manufacturing of products and the blending of materials into finished or semifinished products not otherwise defined as light manufacturing. This use includes:
A. 
The rental of vehicles and equipment over 26,000 pounds gross vehicle weight (GVW), including any heavy equipment or any other vehicle or equipment which is not classified as a "motor vehicle" under the Pennsylvania Motor Vehicle Code.[2]
B. 
A business establishment used for the display or sale of vehicles and equipment over 26,000 pounds gross vehicle weight (GVW), including any heavy equipment or any other vehicle or equipment which is not classified as a "motor vehicle" under the Pennsylvania Motor Vehicle Code. Such use may also include the servicing or repair of such vehicles or equipment.
INDUSTRIAL, LIGHT
The processing and fabrication of certain materials and products where no process involved will produce noises, vibration, water pollution, fire hazard or noxious emissions which will disturb or endanger neighboring properties. Light industrial includes, but is not limited to, the production or repair of the following goods: home appliances, electrical instruments, office machines, precision instruments, electronic devices, timepieces, jewelry, optical goods, musical instruments, novelties, wood products, printed material, lithographic plates, type composition, machine tools, dies and gauges, ceramics, apparel, lightweight nonferrous metal castings, film processing, light sheet metal products, plastic goods, pharmaceutical goods, food products, not including animal slaughtering, curing or rendering of fats, and similar activities.
JUNK VEHICLE
A vehicle which is inoperative or is unable to meet the vehicle registration and inspection standards under Part IV (§ 4101 et seq.) of the Pennsylvania Motor Vehicle Code. The term does not include a vehicle which would qualify as an antique or classic vehicle except for its lack of restoration or maintenance.
JUNKYARD
Land or structure(s) used for the collection, storage, processing and/or sale of scrap metal, wastepaper, glass, rags, containers and other discarded materials, machinery, equipment, inoperable farm equipment, or appliances or two or more scrapped, abandoned or junked motor vehicles. Refuse or garbage kept in a proper container for prompt disposal shall not be regarded as a junkyard.
KENNEL
Any household or establishment where more than four dogs who are more than six months old are kept, bred, trained and/or boarded for profit.
LAND DEVELOPMENT
A. 
The improvement of one lot or two or more contiguous lots, tracts, or parcels of land for any purpose involving:
(1) 
A group of two or more residential or nonresidential buildings, whether proposed initially or cumulatively, or a single nonresidential building on a lot or lots regardless of the number of occupants or tenure; or
(2) 
The division or allocation of land or space, whether initially or cumulatively, between or among two or more existing or prospective occupants by means of, or the purpose of streets, common areas, leaseholds, condominiums, building groups, or other features.
B. 
A subdivision of land.
C. 
Development in accordance with Section 503(1.1) of the Municipalities Planning Code.[3]
LANDFILL
Any site licensed by the Pennsylvania Department of Environmental Protection (PA DEP) for the disposal of solid waste, other than hazardous waste, as defined and regulated by federal statute.
LANDOWNER
The legal or beneficial owner or owners of land including the holder of an option or contract to purchase (whether or not such option or contract is subject to any condition), a lessee if he is authorized under the lease to exercise the rights of the landowner, or other persons having a proprietary interest in land.
LOADING SPACE
A portion of a lot used for the standing, loading, or unloading of motor vehicles.
LOCAL ROAD
A public street which is designed, primarily, to provide access to abutting lots and to discourage through traffic. All roads in the Township which are not defined by this chapter as arterial or collector roads are local roads.
LOT
A tract or parcel of land or several contiguous tracts or parcels under common ownership described in deeds or other instruments pursuant to the laws of the commonwealth and which are used or proposed to be used or developed as a single entity under the terms of this chapter.
LOT AREA
That area measured on a horizontal plane bounded by the front, rear and side lot lines, exclusive of any area within a street right-of-way.
LOT COVERAGE
That percentage of the total lot area which is covered by the principal and accessory structures.
LOT LINE, FRONT
That line which bounds the lot contiguous with the street right-of-way line.
LOT LINE, REAR
That line which is generally opposite to the front lot line.
LOT LINE, SIDE
Any lot line which is not a front lot line or a rear lot line.
LOT OF RECORD
Any lot in a plan of subdivision which is duly recorded in the office of the Recorder of Deeds of Washington County.
LOT WIDTH
The straight-line distance between the points of intersection of the building line with the side lot lines.
LOT, CORNER
A lot at the intersection of, and fronting on, two or more street rights-of-way.
LOT, NONCONFORMING
See "nonconforming lot."
MAILED NOTICE
Notice given by a municipality by first-class mail of the time and place of a public hearing and the nature of the matter to be considered at the hearing.
MAUSOLEUM
A building containing aboveground tombs for burial of human and/or domesticated animal remains.
MEDIATION
A voluntary negotiating process in which parties in a dispute mutually select a neutral mediator to assist with them in jointly exploring and settling their differences culminating in a written agreement which the parties themselves create and consider acceptable.
MINERAL
A solid inorganic substance of natural occurrence that includes, but is not limited to, anthracite and bituminous coal, lignite, limestone and dolomite, sand, gravel, rock, stone, earth, slag, ore, vermiculite, clay and other mineral resources. This does not include liquids such as oil and gases, such as natural gas.
MINERAL REMOVAL
Any extraction of any mineral for sale or other commercial purposes which involves removal of the surface of the earth or exposure of the mineral or subsurface of the earth. This definition includes activities carried out beneath the surface of the earth by means of shafts, tunnels or other underground mine openings.
MINI WAREHOUSE
See "self-storage."
MOBILE HOME
A. 
A transportable single-family dwelling intended for permanent occupancy which has a minimum floor area of 720 square feet and which is contained in one unit, or in two or more units designed to be joined into one integral unit capable of again being separated for repeated towing, which arrives at a site complete and ready for occupancy except for minor and incidental unpacking and assembly operations and constructed so that it may be used without a permanent foundation.
B. 
A mobile home which is used without permanent foundation shall be located within a mobile home park, as defined and regulated herein; however, a mobile home which is rendered immobile by permanent placement on a continuous masonry foundation or at least two concrete footers along the longer dimension which project at least three feet below finished grade and which is skirted and tied to its foundation in accordance with the requirements of the American National Installation of Mobile Homes Requirements (NFPA No. 501-A1974, ANSI A119.3-1975), as amended, and which is connected to all available utilities shall be regarded as a single-family dwelling, as defined and regulated by this chapter.
MOBILE HOME LOT
A parcel of land in a mobile home park improved with the necessary utility connections and other appurtenances necessary for the erection thereon of a single mobile home.
MOBILE HOME PARK
A parcel or contiguous parcels of land which has been so designated and improved that it contains two or more mobile home lots for the placement thereon of mobile homes.
MOTEL/HOTEL
An establishment which provides transient lodging accommodations to the general public and which may provide such additional supporting services as restaurants, dining rooms, recreation facilities and living quarters for a resident manager or proprietor.
MPC
The Pennsylvania Municipalities Planning Code, Act 247, of 1968, as amended.[4]
NATURAL GAS COMPRESSOR STATION
A facility designed and constructed to compress and aid in the transportation of natural gas that originates from an oil and gas well or collection of such wells operating as a midstream facility for delivery of oil and gas to a transmission pipeline, distribution pipeline, natural gas processing plant or underground storage field, including one or more natural gas compressors, associated buildings, pipes, valves, tanks and other equipment.
NATURAL GAS PROCESSING PLANT
A facility designed and constructed to remove materials such as ethane, propane and other constituents or similar substances from natural gas to allow such natural gas to be of such quality as is required or appropriate for transmission or distribution to commercial markets but not including facilities or equipment that are/is designed and constructed primarily to remove water, water vapor, oil or naturally occurring liquids from natural gas.
NITS
A unit of measure used for lighting expressed as candelas per meter squared.
NO-IMPACT HOME-BASED BUSINESS
A business or commercial activity administered or conducted as an accessory use which is clearly secondary to the use as a residential dwelling and which involves no customer, client or patient traffic, whether vehicular or pedestrian, pickup, delivery or removal functions to or from the premises, in excess of those normally associated with residential use. The business or commercial activity must satisfy the following requirements:
A. 
The business activity shall be compatible with the residential use of the property and surrounding residential uses.
B. 
The business shall employ no employees other than members residing in the dwelling.
C. 
There shall be no display or sale of retail goods and no stockpiling or inventory of a substantial nature.
D. 
There shall be no outside appearance of a business use, including, but not limited to, parking, signs or lights.
E. 
No on-site parking of commercially identified vehicles shall be permitted. This does not preclude short-term parking of common carrier vehicles such as USPS, UPS, etc., in conjunction with delivery of supplies or shipment of product.
F. 
The business activity may not use any equipment or process which creates noise, vibration, glare, fumes, odors, or electrical or electronic interference, including interference with radio or television reception, which is detectable in the neighborhood.
G. 
The business activity may not generate any solid waste or sewage discharge, in volumes or type, which is not normally associated with residential use in the neighborhood.
H. 
The business activity shall be conducted only within the dwelling and may not occupy more than 25% of the habitable floor area.
I. 
The business may not involve any illegal activity.
NONCONFORMING LOT
Any lot which does not comply with the applicable area and bulk provisions of this chapter or an amendment hereafter enacted, which lawfully existed prior to the enactment of this chapter or any subsequent amendment.
NONCONFORMING STRUCTURE
A structure, or part of a structure, manifestly not designed to comply with the applicable area, bulk or other provisions in this chapter or an amendment hereafter enacted, which lawfully existed prior to the enactment of this chapter or any subsequent amendment. Such nonconforming structures include, but are not limited to, nonconforming signs.
NURSING HOME
An institution licensed by the commonwealth for the long-term care of patients requiring skilled nursing or intermediate nursing care, but not including facilities for major surgery or care and treatment of narcotics addiction.
OFFICE
An office for such business as insurance, utilities, stenographic service, employment service, real estate, post office, sales such as those by a manufacturer's representative, legal, medical, dental, engineering and surveying, architectural and stock brokerage firms, securities and investment firms.
OIL AND GAS
Crude oil, natural gas, methane gas, coal bed methane gas, propane, butane and all other hydrocarbons and on-hydrocarbons contained in, associated with, or produced/originating within any formation and all communicating zones and their liquid or gaseous constituents that are produced by drilling a well of any depth into, through and below the surface of the earth.
OIL AND GAS DEVELOPMENT AND PRODUCTION
The well site operations, well site construction, drilling, hydraulic fracturing and/or site restoration associated with an oil and gas well or any depth; water and other fluid storage, impoundment and transportation used for such activities and the installation and use of all associated equipment, including tanks, meters and other equipment and structures whether permanent or temporary and the site preparation, construction, installation, maintenance and repair of oil and gas pipelines and associated equipment and other equipment and activities associated with the exploration for, production and transportation of oil and gas other than natural gas compressor stations and natural gas processing plants or facilities performing the equivalent functions that operate as midstream facilities and are only authorized consistent with this chapter.
OIL AND GAS DRILL SITE
The oil and gas drill site shall consist of the area occupied by the facilities, structures and equipment necessary for or incidental to the drilling, production or operation of an oil or gas well.
OIL AND GAS DRILLING SUBSURFACE FACILITIES
Activities performed under the surface of the ground that are part of the operation of oil and gas drilling, as defined herein, located on properties within the unit for a particular drill site, but that are not included in the drill site, including, but not limited to, horizontal drilling and hydraulic fracturing zones, underground gathering and transmission pipelines and similar underground facilities incidental to oil and gas drilling.
OIL AND GAS DRILLING SURFACE FACILITIES
The conduct on a property of oil and gas drilling, as defined herein, that involves activities performed on or above the surface of the ground, including but not limited to: location of the well head and accessory structures, operation of the drilling rig, construction of an access drive and aboveground storage and/or treatment of water and fluids used in the drilling process.
OPEN SPACE
Open space is land area unoccupied by buildings and unobstructed to the sky which is devoted to landscaping, recreation, gardens or other like uses. Areas devoted to driveways, off-street parking, loading, swamp areas, unusable ground, retention ponds, or public or private rights-of-way shall not be considered to be open space. Recreation facilities or structures and their accessory uses located in common recreation areas shall be considered open space as long as total impervious surfaces (paving, roof, etc.) constitute no more than 5% of the total open space.
OPEN SPACE RATIO
The percentage of the total lot area contained in all lots devoted to a given dwelling unit or use type which is required to be reserved as open space within the planned residential development site.
OPERATOR
Any person, partnership, company, corporation and its subcontractors and agents who have an interest in real estate and/or oil and gas for the purpose of developing, exploring or drilling for, producing or transporting oil or gas.
OWNER
The person or persons having the right of legal title to, beneficial interest in or a contractual right to purchase a lot or parcel.
PARCEL
Any designated piece or tract of land located in the Township established by a plat or otherwise as permitted by law.
PARKING AREA
A portion of a lot designed for the parking of motor vehicles in accordance with the requirements of this chapter.
PARKING SPACE
A portion of a parking area designated for the parking of one motor vehicle in accordance with the requirements of this chapter.
PARKING, OFF-STREET
Parking spaces available for the parking outside of a road right-of-way for one or more motor vehicle, excluding residential driveways, such that each vehicle shall have dimensions not less than nine feet by 18 feet, exclusive of passageways and driveways appurtenant thereto and giving access thereto, and having direct access to a street, alley, or aisle.
PERMITTED USE
An authorized use allowed by right which may be granted by the Zoning Officer upon compliance with the provisions of this chapter.
PERSONAL CARE BOARDING HOME
A facility licensed by the commonwealth located within a dwelling where room and board is provided to more than three residents who are not relatives of the operator, and who are mobile or semimobile and require specialized services in such matters as bathing, dressing, diet and medication prescribed for self-administration for a period exceeding 24 consecutive hours, but who are not in need of hospitalization or skilled nursing care or intermediate nursing care.
PERSONAL SERVICES
Any enterprise providing services pertaining to the person, their apparel, or personal effects commonly carried on or about the person, including, but not limited to, shoe repair, tailoring, clothes cleaning, watch repairing, barber shops, beauty parlors and related activities. This use includes massage establishments licensed by the commonwealth. This use does not include a veterinary clinic, kennel or a medical or dental clinic.
PLACE OF WORSHIP
A building use and/or lot where people regularly observe, practice, or participate in religious or spiritual services, meeting and/or activities.
PLAN
A survey of a lot upon which is shown the location of existing and/or proposed structures; existing contours and proposed grading; location and dimensions of yards; proposals for the disposition of sanitary waste and stormwater; indications of zoning compliance; name of applicant and landowner; area location map; dates of preparation and revisions; and evidence of preparation by a registered architect, registered surveyor, landscape architect or engineer.
PLANNED RESIDENTIAL DEVELOPMENT
A site under single ownership and control which is proposed to be developed as a single entity for a number of dwelling units or combination of residential and nonresidential uses the development plan for which does not correspond in lot size, bulk, type of dwelling, use, density, lot coverage and required open space to the regulations established in any one zoning district.
PLANNING COMMISSION
The Planning Commission of the Township of Nottingham.
PLAT
The map or plan of a subdivision or land development, whether preliminary or final.
A. 
PLAT, FINALThe final map of the land development or subdivision that is submitted for community approval and which, if approved, is filed with the County Recorder of Deeds.
B. 
PLAT, PRELIMINARYA preliminary map of the proposed land development or subdivision that is submitted for Township consideration.
PORCH
A covered entrance to a building or structure which may or may not be enclosed and which projects out from the main wall of such building or structure and has a separate roof or an integral roof with the principal building or structure to which it is attached.
PRINCIPAL BUILDING
The building or buildings on a lot in which the principal use or uses are conducted.
PRINCIPAL STRUCTURE
The structure or structures in which the principal use or uses are conducted.
PRINCIPAL USE
The primary or predominant use of any lot or structure.
PRIVATE
Belonging to or concerning an individual person, company or interest independent from federal, state or local government agency.
PROTECTED STRUCTURE
Any occupied residence, commercial business, school, religious institution or public building located within 600 feet from the center of the drilling pad that may be impacted by noise generated from drilling or hydraulic fracturing activity at a well site. The term shall not include any structure owned by an oil and gas lessor who has signed a lease or agreement with the operator granting surface rights to drill the subject well or whose owner (or occupants) has (have) signed a waiver relieving the operator from implementation of the measures established in this chapter.
PUBLIC
Owned, operated or controlled by a government agency, federal, state, county or local.
PUBLIC BUILDING
An establishment that houses elected officials or government employees and generally performs work related to government or public service.
PUBLIC HEARING
A formal meeting held pursuant to public notice by the Township Supervisors, intended to inform and obtain public comment, prior to taking action in accordance with this chapter.
PUBLIC IMPROVEMENTS
All streets, walkways, gutters, curbs, sewers, water lines and other utilities or related facilities to be dedicated to or maintained by the public.
PUBLIC MEETING
A forum held pursuant to notice under the Act of October 15, 1998 (P.L. 729, No. 93), known as the Sunshine Act, 65 Pa.C.S.A. § 701 et seq.

PUBLIC PARKS AND RECREATION
An area maintained as a public property for recreation. This use may include playgrounds, lawns, trails, pavilions and other areas designed and intended for outdoor recreation.
PUBLIC UTILITIES
See "public water and sewer."
PUBLIC WATER AND SEWER
Services provided to the public, specifically municipal sanitary sewer services provided by Peters Creek Sanitary Authority and municipal potable water services provided by Pennsylvania-American Water Company.
REGIONAL PUBLIC UTILITY FACILITIES
An intermunicipal, intrastate or interstate transmission facility operated by a public utility necessary to supply services to the general public outside of the Township.
RESIDENTIAL BUILDING
Any building which is used for residential occupancy by one or more families.
RESTAURANT
An establishment where food and beverages are served to customers at a table or counter by a restaurant employee and where customers are given an individual menu and/or are offered buffet service which includes a complete meal. This use also includes an establishment where food and beverages are served for consumption either on or off the premises and where the primary method of operation involves the serving of food in edible or disposable containers.
RETAIL ESTABLISHMENT
Business establishment that sells goods, services or merchandise to the general public for personal, household or consumption and which shall not include wholesaling, manufacturing or processing of the goods offered for sale.
RETIREMENT COMMUNITY
A planned residential development designed exclusively as housing for the elderly or physically handicapped and which may contain special features associated with the needs of the elderly or handicapped which are not usual in the construction of residential dwellings, such as special health and security features, dispensaries, common dining facilities, transportation or other supporting personal or health service facilities.
RIGHT-OF-WAY
That portion of land dedicated to public use for street or utility purposes.
ROAD
See "street."
SCHOOL
A place of instruction operated by a public, private, nonprofit or religious organization, having regular sessions, with regularly employed instructors and meeting all of the requirements of the Pennsylvania Department of Education for providing primary, secondary, post-secondary, undergraduate and/or graduate collegiate education. This definition includes any specialized instructional establishment that provides on-site training of business, commercial, medical and/or trade skills such as accounting, data processing, computer repair, vocational trades and/or equipment usage.
SELF-STORAGE and MINI WAREHOUSE
A building or group of buildings in a controlled access and fenced compound that contains various sizes of individual, compartmentalized and controlled access stalls and/or lockers leased to the general public for a specified period of time for the dead storage of personal property. No sales, service or repair activities other than the rental of storage units are permitted on the premises.
SETBACK LINE
A line on a lot, generally parallel to a lot line, located a sufficient distance therefrom to provide the minimum yards required by this chapter. The setback line limits the area in which buildings, structures, boats and trailers are permitted subject to all applicable provisions of this chapter.
SHOPPING CENTER
A site under single ownership and control which is developed as a unit for two or more retail establishments in one or more buildings and designed so that parking, loading and access facilities are shared.
SIGHT DISTANCE
The maximum distance of unobstructed vision, in a horizontal or vertical plane, along a street from a vehicle located at any given point on the street which shall take into account visibility over a crest vertical curve and the extent of headlight illumination across a sag vertical curve.
SIGN
A sign is a name, identification, description, display (including electronic) or illustration which is affixed to, or painted, or represented directly or indirectly upon a building, structure, or piece of land and which directs attention to an object, product, place, activity, persons, institution, organization, or business. The definition of sign does not include the display of any official court, or public office notices nor any official or municipal traffic control or parking sign or device, nor shall it include the flag, emblem or insignia of a nation, state, county, municipality, school, or a religious group. A sign shall not include name, identification, description, display or illustration that is located completely within an enclosed building.
SIGN AREA
The entire sign face (one side only), or, where the sign consists of raised letters or symbols, or a sign face of irregular shape, the sign area shall include the area of the smallest rectangle, circle or oval that can encompass the letters, symbols, or irregularly shaped sign face.
SIGN, ANIMATED
Any sign or part of a sign or sign face that changes physical position or light intensity by any movement or rotation or that gives the visual impression of such movement or rotation of the sign or sign face.
SIGN, BANNER
Any sign intended to be hung, either with or without frames, of lightweight material such as paper, plastic, or fabric of any kind. National flags, state or municipal flags or the official flag of any institution or business shall not be considered banners.
SIGN, BUILDING
A sign attached to any part of a building, including a sign projecting from a part of a building.
SIGN, CANOPY
A sign attached to a roof extension of a building with or without support, but not walls.
SIGN, CHANGEABLE COPY OR LETTERING
A sign or portion thereof with characters, letters, or illustrations that can be changed or rearranged, mechanically or electronically, without altering the face or the surface of the sign.
SIGN, DIRECTIONAL
A sign, no greater than five square feet in size that provides on-site directional assistance or instruction to vehicular or pedestrian traffic relative to parking area, entrances and exits. Such sign shall contain no advertising other than the business name or logo and shall provide directional information, such as "No Parking," "Entrance," "Exit," "One Way," "Loading Only," "Telephone," and other similar directives. Directional, incidental sign shall be located only in conjunction with site drive entrances and/or internal traffic drive aisles.
SIGN, FREESTANDING
A sign that is supported from the ground and not attached to a building. The sign may be attached to a pole, mast, frame or other structure that is not itself an integral part of, or attached to, a building.
SIGN, LED
Any sign or portion thereof that displays electronic images, graphics, or pictures, with or without textual information, using LEDs (light emitting diodes), fiber optics, light bulbs, or other illumination devices or combination thereof within the display area and where a static message change sequence is accomplished immediately or by means of fade, repixilation, dissolve or other such modes, devices, processes, products, applications or technologies from a proximate or remote location. Such signs include computer-programmable and microprocessor-controlled electronic displays.
SIGN, MARQUEE
A sign attached to a permanent structure, other than a roof, attached to, supported by, and projecting from, a building, and providing protection from natural elements.
SIGN, MONUMENT
A freestanding sign in which a solid structure, the width of which is equal to or greater than the width of the sign face, is used to mount the sign area on, in or as an integral part of such structure.
SIGN, POLITICAL
A temporary sign directly associated with any national, state, or local government election.
SIGN, SURFACE AREA
That area enclosed by one continuous line, connecting the extreme points or edges of a sign. The area shall be determined using the largest sign area or silhouette visible at any one time from any one point. This area does not include the main supporting sign structure, but all other ornamental attachments, inner connecting links, etc., which are not part of the main supports of the sign shall be included in determining the sign area. For signs painted on walls, this will mean the area of the smallest triangle, rectangle or circle which can wholly enclose the surface area of the sign. For two-sided signs, only one face is counted in computing the surface area.
SIGN, TEMPORARY
Any sign not permanently attached to the ground or other permanent structure, or is designed to be transported.
SIGN, WALL
Any sign painted on or adhered directly to a wall of a building.
SINGLE-FAMILY
A building and lot occupied by one family.
SITE AREA
The total area of the lot or lots comprising a site.
SLOPE
The face of an embankment or cut section; any ground whose surface makes an angle with the plans of the horizon. Slopes are usually expressed in a percentage based upon vertical difference in feet per 100 feet or horizontal distance.
SOLAR ENERGY FACILITY, LARGE-SCALE
An electric generating facility, with the purpose of electricity supply, consisting of one or more solar panels and other ancillary associated buildings and structures, including substations, meteorological towers, electrical infrastructure, transmission lines, and other appurtenant structures and facilities. This use includes solar energy conversion systems that exist for the sole purpose of converting solar energy into electricity for sale to utilities or off-site users, consisting of a photovoltaic array or solar thermal generating apparatus, associated control or conversion electronics, including collection, distribution and storage equipment.
SOLAR ENERGY FACILITY, SMALL-SCALE
A solar collection system consisting of one or more building- and/or ground-mounted systems, solar photovoltaic cells, panels or arrays and solar related equipment that rely upon solar radiation as an energy source for collection, inversion, storage and distribution of solar energy for electricity generation. A small-scale solar energy facility is a generation system with a capacity of not greater than 50 kilowatts if installed at a residential service or not larger than 3,000 kilowatts at other customer service locations and do not produce excess on-site energy greater than currently permitted by Pennsylvania Public Utility Commission guidelines.
SPACE BETWEEN BUILDINGS
The shortest distance between two buildings, regardless of orientation.
SPECIAL EVENT BARN, ACCESSORY USE
A permanent structure that is currently being used as a barn on a farm and which is sometimes used for the commercial purpose as a venue for weddings, receptions, and other gatherings, to include, but not limited to, birthday parties, retirement parties, anniversary parties, graduation parties, formal dinners, business engagements, where such commercial use of the barn is secondary to the farming activity on the property.

SPECIAL EVENT BARN, PRINCIPAL USE
A permanent existing structure that was previously used as a barn and is fully or partially repurposed as a venue for the commercial purpose of hosting weddings, receptions, and other gatherings to include, but not limited to, birthday parties, retirement parties, anniversary parties, graduation parties, formal dinners, business engagements.

SPECIAL EVENT VENUE
A permanent structure that used as a venue for the commercial purpose of hosting weddings, receptions, and other gatherings, or a permanent structure which is sometimes used for the commercial purpose as a venue for weddings, receptions, and other gatherings, to include, but not limited to, birthday parties, retirement parties, anniversary parties, graduation parties, formal dinners, business engagements.

SPECIAL EXCEPTION
A use appropriate for the zoning district in which it is permitted, but is subject to specific standards and criteria and a hearing and decision by the Zoning Hearing Board.
STEEP SLOPE
Slopes exceeding 25%.
STORY
That portion of a building included between the surface of any floor and the surface of the floor next above it, or if there be no floor above it, then the space between any floor and the ceiling next above it.
STREET
All land between right-of-way lines, whether public or private and whether improved or unimproved, which is intended to accommodate vehicular traffic, including an avenue, drive, boulevard, highway, road, freeway, parkway, lane, viaduct or other vehicular way.
STRUCTURAL ALTERATION
Any change in the support members of a building such as bearing walls, columns, beams, or girders; changes in the means of ingress and/or egress; enlargement of floor area or height of a structure; or relocation of a structure from one position to another.
STRUCTURE
Any man-made object having an ascertainable location on or in land or water, whether or not affixed to the land where said object may or may not have a roof and/or wall(s).
SUBDIVISION
The division or redivision of a lot, tract or parcel of land by any means into two or more lots, tracts, parcels or other divisions of land including changes in existing lot lines for the purpose, whether immediate or future, of lease, partition by the court for distribution to heirs or devisees, transfer of ownership or building or lot development; provided, however, that the subdivision by lease of land for agricultural purposes into parcels of more than 10 acres, not involving any new street or easement of access or any residential dwelling, shall be exempted.
SUPERVISORS
The Board of Supervisors of the Township of Nottingham, Washington County, Pennsylvania.
SURVEY
A precise legal description of a lot and the graphic delineation of precise lot boundaries; lot dimensions and areas; all easements and public and private rights-of-way; and North point and graphic scale affecting the lot, prepared by a professional land surveyor licensed and registered in the commonwealth. The survey shall be on sheets of 24 inches by 36 inches.
SWIMMING POOL
A body of water in an artificial or semiartificial receptacle or other container, whether located in or out of doors, in-ground or aboveground, which is used for swimming, bathing or wading and having a depth at any point of more than 24 inches and a surface area of more than 100 square feet, including the equipment necessary to maintain the swimming pool and the healthful condition of the water.
TEMPORARY STRUCTURE
Any structure or vehicle which is designed to be easily transported or dismantled after its function has been fulfilled, and which is used for residential, commercial or office purposes. This use does not include tents.
TOTAL SITE AREA
The sum of the area of all parcels in the total site for which an application for planned residential development has been filed.
TOWNSHIP
The Township of Nottingham, Washington County, Pennsylvania.
TRUCK TERMINAL
A facility to accommodate the service, repair and storage of trucks and other motorized equipment and trailers, and which may incidentally provide warehousing activities and transfer facilities.
USE
An activity, business or purpose for which any lot or structure is utilized.
A. 
USE, ACCESSORYA use customarily incidental and subordinate to the principal use of the lot.
B. 
USE, AUTHORIZEDAny principal use or accessory use allowed by this chapter as a permitted use by right, conditional use, use by planned development or use by special exception.
C. 
USE BY SPECIAL EXCEPTIONAn authorized use which may be granted only by the Zoning Hearing Board in accordance with standards and criteria in this chapter.
D. 
USE, CONDITIONALAn authorized use which may be granted only by Board of Supervisors pursuant to standards in this chapter and criteria after recommendation by the Planning Commission and after a public hearing held in accordance with the requirements of this chapter.
E. 
USE, NONCONFORMINGA use, whether of land or of structure, which does not comply with the applicable use provisions in this chapter or an amendment hereafter enacted, where such use was lawfully in existence prior to the enactment of this chapter or amendment.
F. 
USE, BY RIGHTAn authorized use which, upon an application, may be granted by the Zoning Officer in accordance with the provisions of this chapter.
G. 
USE, PRINCIPALThe main purpose or activity for which a lot is used or for which a structure or part of a structure or lot is used.
USES NOT LISTED, NONRESIDENTIAL
Any nonresidential use not specifically identified in the permitted land use chart of this chapter.
USES NOT LISTED, RESIDENTIAL
Any residential use not specifically identified in the permitted land use chart of this chapter.
VARIANCE
A departure from the strict letter of this chapter, as it applies to specific properties, as authorized by the Zoning Hearing Board in accordance with the terms of this chapter and the MPC.
VEHICLE SALES, SERVICE, AND RENTAL
Vehicle-related establishments including the following:
A. 
The rental of automobiles, motorcycles and trucks under 26,000 pounds gross vehicle weight (GVW), but not including any heavy equipment or any other vehicle or equipment which is not classified as a "motor vehicle" under the Pennsylvania Motor Vehicle Code.
B. 
A business establishment used for the display or sale of automobiles, noncommercial trucks, motorcycles, motor homes, recreational vehicles and/or or boats under 26,000 pounds gross vehicle weight (GVW), but not including any heavy equipment or any other vehicle or equipment which is not classified as a "motor vehicle" under the Pennsylvania Motor Vehicle Code. Such use may also include the servicing or repair of vehicles of the brand of vehicles sold at the establishment.
VEHICLE, REPAIR
A building, or part thereof, used for the servicing and repair of motor vehicles, including engine overhaul, body work and recapping/retreading of tires and where all storage of parts and dismantled vehicles and all repair work are conducted entirely inside a completely enclosed building.
WAREHOUSE
A building or structure used for the storage and handling of goods, materials, freight, or merchandise awaiting sale on another lot or location, but not including the maintenance or fueling of commercial vehicles. Warehousing which is incidental to retail sales and which does not constitute in excess of 30% of the total floor area of the retail establishment shall be excluded from this definition. Incidental sales may occur on the lot.
WELL SITE
A graded pad designed and constructed for the drilling of one or more oil and gas wells.
WIND ENERGY FACILITY, LARGE-SCALE
An electric generating facility, with the purpose of electricity supply, consisting of one or more wind turbines and other ancillary associated buildings and structures, including substations, meteorological towers, electrical infrastructure, transmission lines, and other appurtenant structures and facilities. This use includes a wind energy conversion system that exists for the sole purpose of converting wind energy into electricity for sale to utilities or off-site users, consisting of a wind turbine or wind turbines, tower(s) and associated control or conversion electronics, including collection, distribution and storage equipment.
WIND ENERGY FACILITY, SMALL-SCALE
A wind energy collection system consisting of one or more building- and/or ground-mounted systems, and related equipment that rely upon wind as an energy source for collection, inversion, storage and distribution of energy for electricity generation. A small-scale wind energy facility is a generation system with a capacity of not greater than 50 kilowatts if installed at a residential service or not larger than 3,000 kilowatts at other customer service locations and do not produce excess on-site energy greater than currently permitted by Pennsylvania Public Utility Commission guidelines.
YARD
A required open space located on a lot which is unobstructed by any portion of a principal structure other than certain projections expressly permitted by this chapter.
YARD, FRONT
A yard extending across the full lot width and abutting the front lot line. The depth measurement required by this chapter for the front yard shall be the horizontal distance between of the right-of-way and a line parallel or concentric thereto known as the front building line.
YARD, REAR
A yard extending across the width of the lot between the side lot lines and adjoining the rear lot line. The minimum depth measurement required by this chapter shall be the horizontal distance between the rear lot line and a line parallel thereto known as the rear building line.
YARD, SIDE
A yard extending between the front building line and the rear building line parallel to the side lot line. The minimum width measurement required by this chapter shall be the horizontal distance between the side lot line and a line parallel thereto known as the side building line.
ZONING APPROVAL
Approval under the provisions of this chapter certifying that an application for development or application for occupancy permit has fulfilled the requirements of this chapter.
ZONING CERTIFICATE
A certificate issued by the Zoning Officer prior to the use of any structure or land or the construction, reconstruction, alteration, enlargement, removal or relocation of any structure which certifies that the proposed use or construction is in compliance with the requirements of this chapter for the zoning district in which the proposed use or construction is located, but which does not include approval of the structural integrity of the proposed construction or the materials or methods of construction proposed.

The Zoning Hearing Board of Nottingham Township, Washington County, Pennsylvania.
ZONING MAP
The official map delineating the zoning districts of Nottingham Township, Washington County, Pennsylvania, together with all amendments subsequently adopted.
ZONING OFFICER
The designated official or an authorized representative appointed by the Supervisors whose duty it shall be to administer this chapter.
