[Ord. No. 03-05 § 18-31.1]
a. Multiple dwelling code enforcing agency. There is hereby established
in the Borough of Bound Brook a State Multiple Dwelling Code enforcing
agency to be known as the "Bureau of Housing Inspections," consisting
of a Housing Official, Housing Inspector and such other officers for
such additional duties as the Commissioner of the Department of Community
Affairs, State of New Jersey, shall hereafter adopt as part of the
State Multiple Dwelling Code. The Housing Official shall be the chief
administrator of the enforcing agency.
b. Position to be filled by qualified person. Each official position
created in paragraph a above shall be filled by a person qualified
for such position pursuant to N.J.S.A. 55:13A-1 et seq. More than
one such official position may be held by the same person, provided
that such person is qualified pursuant to N.J.S.A. 55:13A to hold
each such position.
c. Public access to enforcing agency. The public shall have the right
to do business with the enforcing agency at one office location, except
for emergencies and unforeseen or unavoidable circumstances.

Monthly, the enforcing agency shall report a summary of its
enforcement experience, including the number of inspections, reinspections,
violations, abatements, inspections due but not completed, and such
other pertinent information the Code Enforcement Committee of the
Borough Council may deem necessary to assess the operational effectiveness
of the agency.

In addition to each annual rental registration renewal, each
multiple dwelling owner or managing agent shall provide the Borough,
using the annual multiple dwelling renewal form, the following information:
a. An itemized
list containing each unit number, the building the unit is located
in and the floor the unit is located on.
b. For each
unit, the number of approved bedrooms.
c. For each
unit, the number of total occupants over the age of two years old.
d. For each
unit, the number of school age occupants enrolled in the Bound Brook
school system as of July 1 of each renewal year.

All dwellings for rent or lease that are contained in a multiple
dwelling structure must adhere to the following regulations:
a. Each unit must be identified by a unit number and reported on the annual multiple dwelling filing as outlined in Subsection
15-38.3.
b. Each
dwelling unit must identify the number of bedrooms in each unit.
c. No room
other than the identified bedroom(s) is permitted to be used as permanent
sleeping quarters.
d. The maximum
permitted occupancy in a one-bedroom apartment or studio apartment
is two occupants. The maximum permitted occupancy in a two-bedroom
apartment is four occupants.

a. This
section shall be enforced by the Borough Department of Code Enforcement.
In the event that a Housing Inspector in the Department of Code Enforcement
determines that a violation of this section or any regulation promulgated
pursuant thereto has occurred, the Inspector may file a summons and/or
complaint in the Municipal Court or cause the issuance of the same,
whether or not a notice of violation or order has been served.
b. Owners
and operators of multiple dwellings found in violation of any state
housing and/or Borough of Bound Brook regulation are subject to a
minimum penalty of $500 up to a maximum penalty of $2,000 for each
violation.
