A.ย
Title. This article shall be known as the Solid Waste Management
Ordinance of the Village of Monticello, hereinafter referred to as
this "article."
B.ย
Declaration of policy. It is hereby declared to be the purpose and
intent of this article to comply with state and county recycling mandates
and enhance and improve the environment and promote the health, safety
and welfare of the Village by establishing minimum standards for the
storage, collection, transport, processing, separation, recovery and
disposal of solid waste. The weekly collection of solid waste shall
be under the direction of the Superintendent of Streets.
Four garbage districts, all of which are subject to the provisions
of this article, are hereby established as follows:
For the purpose of this article, the following words and phrases
shall have the meanings given herein unless different meanings are
clearly indicated by the context:
An establishment engaged in the rearing and slaughtering
of animals and the processing of animal products or orchard and field
crops.
Items whose large size precludes or complicates their handling
by normal collection, processing or disposal methods.
Commercial units shall be all property other than residential
units and shall include boardinghouses, motels and resorts.
The back edge or curb and gutter along a paved street or
where one would be if the street was paved and had curb and gutter.
That portion of solid wastes consisting of wastes from the
repair, remodeling or reconstruction of buildings, such as siding,
lumber, roofing and sheathing scraps, rubble, broken concrete, asphalt
and plaster, conduit, pipe, wire, insulation and any other materials
resulting from the demolition of buildings and improvements.
The orderly process of discarding useless or unwanted material.
The Wisconsin Department of Natural Resources.
A land site where solid waste is disposed of in a manner
that does not protect the environment.
A place of habitation occupied by a normal single-family
unit or a combination of persons who may be considered as equivalent
to a single-family unit for the purposes of this article.
Any electronic computing or processing equipment including,
but not limited to, computers such as laptops, desktops, netbooks
and tablets, printers such as those that fax, scan and/or copy, computer
monitors such as CRTs and flat panel monitors, fax machines, computer
mice and keyboards and computer accessories such as hard drives, flash
drives, memory sticks, speakers, modems, CD and DVD players, video
gaming devices and similar electronic items.
All items which are not recyclable, not burnable, or of a
compost nature, and all kinds of organic kitchen waste resulting from
the preparation or consumption of food and all decayed or spoiled
food products from any source whatsoever, but shall not include bodily
waste, with the exception of disposable diapers.
Not larger than thirty-gallon and of clear or opaque in color.
Plastic garbage bags must be closed with a tie and shall be of sufficient
strength to withstand stress resulting from handling during collection.

Those wastes such as toxic, radioactive or pathogenic substances
which require special handling to avoid illness or injury to persons
or damage to property and the environment.
Waste material, except garbage, rubbish and refuse, directly
or indirectly resulting from an industrial processing or manufacturing
operation.
Solid waste scattered about in a careless manner, usually
rubbish.
Solid waste from agricultural, commercial, industrial or
institutional activities or a building or group of buildings consisting
of four or more dwelling units.
Individuals, firms, corporations and associations, including
the plural as well as the singular.
Collection services provided by a person licensed to do the
same by the DNR.
Waste material that can be remanufactured into usable products
and shall include, by way of enumeration but not by way of limitation,
glass, plastics, newspapers, cardboard, and metals (aluminum, steel,
tin, brass, etc.).
Includes all waste material, including garbage, rubbish and
industrial waste, and shall, by way of enumeration but not by way
of limitation, include grass, leaves, sticks, tree branches and logs,
stumps, stone, cement, boards, furniture or household appliances,
and garden debris.
All solid waste that normally originates in a residential
environment from residential dwelling units.
An individual household capable of independent habitation
by a family unit. A single-family dwelling shall be considered to
be one residential unit; multifamily dwelling shall be considered
to be multiple residential units, the number of residential units
to equal the number of family units to be housed therein. "Residential
unit" shall not include boardinghouses, motels or resorts.
The uncontrolled removal of materials at any point in solid
waste management.
Garbage, rubbish and other useless, unwanted or discarded
material from agricultural, residential, commercial, industrial or
institutional activities. "Solid waste" does not include solid or
dissolved material in domestic sewage.
A galvanized metal or heavy plastic canister with a tightly
fitting cover which is animal/rodent-proof.
The interim containment of solid waste in an approved manner
after generation and prior to collection and ultimate disposal.
Areas where persons place containers during noncollection
days as well as areas where containers are set out on collection day.
Waste products such as wire or metal of any kind, magazines,
plastics, china, crockery, ashes or other nongarbage waste material
which results from the normal operation of a household, but not including
bodily waste. Large cartons or crates shall constitute "trash" if
such cartons or crates are broken down to a size suitable for handling
by the garbage collector and are compacted into a specified plastic
bag or dumpster. Brush and branch clippings or cuttings and tree limbs
shall not constitute "trash" for the purpose of collection.
Storage areas shall be kept in a nuisance and odor-free condition.
Litter shall not be allowed to accumulate. Collection crews will not
be responsible for cleaning up loose materials from any containers
which have become ruptured or broken due to wet conditions, animals,
vandalism or other cause. The occupant and/or owner shall be responsible
for cleaning up this litter. Litter not collected shall not be allowed
to accumulate. Violation will result in the occupant and/or owner
being notified to clean up his area with continued violation resulting
in the owner being prosecuted under the provisions of this article
and other Village ordinances.
A.ย
Storage of garbage. Every household or occupant of any dwelling or
place of business within the Village of Monticello shall provide one
or more standard garbage/trash containers of sufficient capacity to
contain all garbage/trash that may accumulate between collections
and which shall be secure from animals and/or rodents.
B.ย
Containers required. Every household or occupant of any dwelling
or place of business within the Village shall purchase garbage from
the Village Clerk-Treasurer for the purpose of garbage collection.
No garbage bags will be picked up unless there is a sticker attached.
Any entity in any district not able to comply with this regulation
shall be required to use dumpsters. If dumpster capacity has been
exceeded by the placing of garbage/trash outside of the dumpster,
there will be a loading fee for each occurrence which shall be determined
by resolution of the Village Board. The Village shall not be obligated
to pick up or to empty bundles or containers weighing over 40 pounds
each.

Private collectors. No person shall engage in the collection or removal
of garbage or refuse within the Village limits of the Village of Monticello
unless he is employed by the Village Board or unless he has received
authorization to do so from the Village Board.
D.ย
Illegal containers. Containers not approved consist of metal, pasteboard
or plastic barrels or drums, wooden or cardboard barrels, wheelbarrows
and other such containers not approved by this article. These containers
will not be emptied regardless of contents or weight.

Placement for collection.
(1)ย
Residential solid waste shall be accessible to collection crews.
Excluding all recyclable materials, residential solid waste in approved
containers shall be placed immediately behind the curb of the public
street for collection or containers shall be placed immediately adjacent
to the alley if premises abut on an alley. Yard and bulky wastes from
residential units shall likewise be placed in neat, orderly fashion
behind the curb. During winter months, solid waste shall not be placed
on top of the snow bank, nor shall it be placed in the roadway. The
owner shall either shovel out an area behind the curb in which to
place his wastes or he shall place it in his driveway. Collection
crews will not collect residential solid waste unless it is placed
at the curb of a public street. Residential units shall bring their
solid waste to the terrace adjacent to the street curb for collection.

No garbage containers or other containers for refuse other than those
of the Village shall be placed, kept, stored or located within the
right-of-way of a street or alley; provided, however, that the Village
Board may authorize the location of such containers within the public
right-of-way at specified places and times when such location is necessary
for the expeditious collection and disposition of refuse.
B.ย
Collection of garbage and trash. All garbage/trash, excluding recyclable materials, shall be collected by the Village collector and conveyed to the Green County Landfill. Collection by the Village shall be on days specified with District A (ยงย 303-2A) being weekly and Districts B, C and D (ยงย 303-2B, C and D) being weekly, semiweekly or daily as needed.
C.ย
Charges. The expense, removal and disposal of the garbage and refuse
shall be paid by the persons who require and receive the service provided
for by this section or the owner of the premises where service is
rendered. Collection of the charges shall be made to the Village Clerk-Treasurer,
and the schedule of rates shall be fixed by the Village Board. All
charges established by the Board for garbage and refuse collection
which become delinquent shall be a direct lien upon the property served
in accordance with the statutes of the State of Wisconsin and may
be levied as a special charge against the real estate.
D.ย
Regulations as to times and conditions of collection.
(1)ย
The Village Board shall, by regulation, designate days and hours
of collection for each garbage district and/or for any specified high-volume
sources.
(2)ย
The Village Board shall give notice of such regulation by publication
of a notice one time in the Post Messenger, which, when published,
shall become a part of this article. Such days and times may be changed
by the Village Board from time to time if it is deemed necessary to
the expedient and efficient collection of garbage and trash, and notification
of such changes shall be similarly published and become a part of
this article.

Restriction on time of placement.
(1)ย
No garbage/trash bags shall be placed at the curb or street edge
before 10:00 p.m. on the day before the scheduled collection day,
and the same shall be placed at curbside no later than 7:00 a.m. the
day of collection.
(2)ย
Village employees or employees of licensed collectors will not enter
any structures to remove garbage or refuse, except by written agreement
with the property owner.
(3)ย
If the scheduled collection day falls on a holiday, collection will
be on the following scheduled working day.
(4)ย
Special collections will be made only if ordered by the Building
Inspector or Health Officer and will be billed to the owner.
A.ย
Dead animals. It shall be unlawful to place any dead animal, or parts
thereof, in a container for collection provided; however, this section
shall not apply to animal parts from food preparation for human consumption.
B.ย
Undrained food wastes. It shall be unlawful to place any garbage
or other food wastes in a container for collection unless it is first
drained and wrapped.
C.ย
Ashes. It shall be unlawful to place hot ashes for collection.
D.ย
Improper placement. It shall be unlawful to place, or allow to be
placed, any solid waste upon the roads, streets, public or private
property within the Village contrary to the provisions of this article.
E.ย
Compliance with article. It shall be unlawful to store, collect,
transport, transfer, recover, incinerate or dispose of any solid waste
within the boundaries of the Village contrary to the provisions of
this article.
F.ย
Improper transportation. It shall be unlawful to transport any solid
waste in any vehicle which permits the contents to blow, sift, leak
or fall therefrom. If spillage does occur; the collection crew shall
immediately return spilled materials to the collection vehicle and
shall properly clean, or have cleaned, the area. All vehicles used
for the collection and transportation of solid waste shall be durable,
easily cleanable and leakproof, if necessary, considering the type
of waste and its moisture content. Collection vehicles shall be cleaned
frequently to prevent nuisances and insect breeding and shall be maintained
in good repair.
G.ย
Interference with authorized collector. No person other than an authorized
collector shall collect or interfere with any garbage after it shall
have been put into a garbage receptacle and deposited in the proper
place for the collector, nor shall any authorized person molest, hinder,
delay or in any manner interfere with an authorized garbage collector
in the discharge of his duties.
H.ย
Scavenging. It shall be unlawful for any person to scavenge any solid
waste or refuse placed for collection on the terrace without the permission
of the owner.
I.ย
Private dumps. It shall be unlawful for any person to use or operate
a private dump.
J.ย
Burning of waste. It shall be unlawful for any person to burn solid
waste in any manner, except as provided elsewhere in the Code of the
Village of Monticello.
K.ย
Noncollectible materials. It shall be unlawful for any person to
place for collection any of the following wastes:
L.ย
Hospital wastes. It shall be unlawful for any person to place for
collection any pathogenic hospital wastes. Such items as needles and
syringes may be disposed of as long as they are contained to eliminate
injury to collection crews.
M.ย
Building waste. All waste resulting from remodeling, construction
or removal of a building, roadway or sidewalk shall be disposed of
by the owner, builder or contractor. Building materials of any kind
will not be collected. Building and construction waste shall not be
burned at the construction site nor disposed of at the Monticello
Recycling Center or elsewhere within the Village.
N.ย
Undrained garbage bags. Undrained garbage/trash bags weighing more
than 40 pounds will not be picked up for collection.
O.ย
Defective bags. Garbage/trash bags which have been overfilled, ripped
or torn open will not be picked up for collection.
The accumulation or deposit of garbage, trash or putrescible
animal or vegetable matter in or upon any lot or land or any public
or private place within the Village which causes the air or environment
to become noxious or offensive or to be in such a condition as to
promote the breeding of flies, mosquitoes or other insects, or to
provide a habitat or breeding place for rodents or other animals,
or which otherwise becomes injurious to the public health, is prohibited
and declared to constitute a nuisance.
It is unlawful for any person, firm or corporation to place,
deposit or cause to be deposited, for collection, any waste or refuse
not generated within the corporate limits of the Village of Monticello.
The Village Board hereby designates the collection point for
used tires and e-waste as the Green County Landfill. The Village shall
not pick up tires or e-waste for collection.
The Village of Monticello will provide a place for deposit of
these items. A compost pile will also be provided for the collection
of grass clippings and leaves and other vegetative matter.

Cleanup day will be the third Monday of April and October, with pickup
as follows:

Only the above items as designated for that date will be picked up.
Items must be separated and curbside by 7:00 a.m. Truck will NOT backtrack
for a second pickup. No closed bags will be collected and all containers
left by the curbside will be collected and discarded.
C.ย
Any debris that can be disposed of at the Village recycling site
will not be picked up during cleanup days; i.e., recyclables, rocks,
ashes, leaves, garden debris, lawn clippings. No regular refuse or
garbage or tires will be picked up during cleanup days.

Courtesy pickups may be provided on a prearranged custom basis for
a fee.
B.ย
Courtesy pickups shall be prearranged with the Director of Public
Works by the resident who shall pay a fee as provided by the Village
Fee Schedule prior to or at the time of pickup.
C.ย
The courtesy pickup fee shall be as provided by the Village Fee Schedule
and shall include 15 minutes of crew operation.
D.ย
Additional time required shall be billed to the resident on a time-consumed
basis at the rate provided by the Village Fee Schedule per each additional
and succeeding fifteen-minute period.
E.ย
The Director of Public Works or the Director's designee shall
have the right and authority to refuse a request for a courtesy pickup.
Courtesy pickups shall be limited to materials accumulated by an owner
or tenant of Village property. No collection shall be made of contractors'
materials.

DUMPSTER
TEMPORARY DUMPSTER
TEMPORARY STORAGE UNIT
Definitions.
A metal container commonly used to collect combined refuse
in multifamily dwellings (four dwelling units or more) and commercial
establishments.
A large container commonly designed for the receiving, transporting
and dumping of waste materials on a temporary basis during demolition
or construction projects and is not intended to include dumpsters
employed for refuse or recycling collections.
Any container, portable structure or temporary accessory
structure that can be or is used for the storage of personal property
or equipment of any kind and which is location for such purposes outside
an enclosed building.
B.ย
Trash
pickup. It is unlawful for any person in a noncommercially zoned area
(R-1 Single-Family Residential, R-2 One- and Two-Family Residential
and R-3 Multiple-Family Residential under five units) to whom trash
pickup is available to have a dumpster.
C.ย
Dumpsters.
Dumpsters shall be kept closed with covers (except when being filled
or emptied) and shall be kept in a sanitary and mechanical condition.
Dumpsters which are found to be in nonmechanical condition may be
ordered to be replaced by the Village at owner' s expense.
D.ย
Accessibility.
When access to a dumpster is impeded by any object, including, but
not limited to, snow, ice or any other material, the dumpster will
not be emptied until the obstruction is removed.
E.ย
Refusal
to collect. The Director of Public Works or his employees or agents
may refuse to collect any garbage or refuse improperly prepared or
deposited for pickup as provided by this chapter.
F.ย
Dumpster use restricted to authorized persons. No person shall be permitted to place any item in a dumpster unless authorized by the owner of the property on which the dumpster is located. Any person who violates this section shall be subject to the penalties in ยงย 1-6.
G.ย
Safety
conditions.
(1)ย
The
area around a dumpster shall be kept free of debris and litter, to
include the removal of nails, screws, or similar metallic materials
with the use of a magnet-type tool.
(2)ย
The
area around a dumpster shall be kept free of sharp debris or construction
material such as metal and glass.
(3)ย
All
full dumpsters shall be removed from a property or emptied within
72 hours after becoming full.
(4)ย
All
dumpsters, except construction dumpsters, shall be fully secured with
the lid in place.
(5)ย
All
dumpsters shall be maintained on a flat surface or properly secured
to prevent undesired moving of dumpster.
(6)ย
All
dumpsters that are on or within six feet of a public roadway, alleyway,
highway, or parking lot shall be made to be visible on all visible
sides of the dumpster with a reflective area not less than 36 inches
square. The owner of the dumpster shall be responsible for making
the dumpster visible as set forth in this subsection.
(7)ย
All
dumpsters utilized in the Village shall be placed, at minimum, equal
distance from fire hydrants as vehicles are required by law.
H.ย
Temporary
dumpsters and storage unit on Village property or streets. No person
shall place any dumpster or similar container used for the purpose
of disposing of garbage or refuse on any Village property or Village
street without first obtaining permission from the Police Chief or
the Chief's designee. In the event the Police Chief authorizes the
placement of a dumpster on Village property or on any Village street,
the property owner shall be responsible for marking the dumpster to
warn motorists and other users of the street of the existence and
location of the dumpster. The Police Chief may require the placement
of marking or warning devices, including lighted barricades, fluorescent
tape, cones, or reflectors. Any dumpster authorized to be placed on
any Village street must be placed against the curb so as not to impede
traffic in any manner. No dumpster shall be permitted to be located
on any Village property or any Village street for more than 14 consecutive
days. Any dumpster which is placed on Village property or on any Village
street which remains on the Village property or the Village street
longer than the period of time authorized by the Police Chief shall
be removed by the Village and the cost thereof shall be a special
charge which, if unpaid, shall be placed on the tax bill of the property
in accordance with the provisions of ยงย 66.0703, Wis. Stats.
I.ย
Noncomplying
dumpsters. Any dumpster not in compliance with this section must be
corrected and brought into compliance immediately or it is hereby
declared to be a public nuisance and may be abated by the Village
at the owner's or responsible person's expense. Abatement shall, at
the Village's option, include removal, emptying, or cleaning the dumpster.
If the owner or responsible party is not able to be contacted, the
Village is hereby authorized to immediately abate the noncompliance.

It is the purpose of this article to promote recycling, composting,
and resource recovery through the administration of an effective recycling
program, as provided in ยงย 287.11, Wis. Stats., and Ch. NR
544, Wis. Adm. Code, by the Village of Monticello in order to protect
and promote the public health, safety and welfare.
This article is adopted as authorized under ยงย 287.09(3)(b),
Wis. Stats.
It is not intended by this article to repeal, abrogate, annul,
impair or interfere with any existing rules, regulations, ordinances
or permits previously adopted or issued pursuant to law. However,
whenever this article imposes greater restrictions, the provisions
of this article shall apply.
A.ย
In their
interpretation and application, the provisions of this article shall
be held to be the minimum requirements and shall not be deemed a limitation
or repeal of any other power granted by the Wisconsin statutes. Where
any terms or requirements of this article may be inconsistent or conflicting,
the more restrictive requirements or interpretation shall apply.
B.ย
Where
a provision of this article is required by Wisconsin statutes, or
by a standard in Ch. NR 544, Wis. Adm. Code, and where the article
provision is unclear, the provision shall be interpreted in light
of the Wisconsin statutes and the Ch. NR 544 standards in effect on
the date of the adoption of this article, or in effect on the date
of the most recent text amendment to this article.
The requirements of this article apply to all persons within
the boundaries of the Village of Monticello.
The provisions of this article shall be administered by the
Village Board of the Village of Monticello.
For the purpose of this article the following words and phrases
shall have the meanings ascribed to them in this section:
A container for carbonated or malt beverages that is made
primarily of a combination of steel and aluminum.
Corrugated paperboard used in the manufacture of shipping
containers and related products.
Packaging made primarily from foam polystyrene that satisfies
one of the following criteria:
High-density polyethylene plastic containers marked by the
SPI Code No. 2.
Any paper, glossy, semiglossy or regular, including advertising
window envelopes.
Low-density polyethylene plastic containers marked by the
SPI Code No. 4.
Magazines and other materials printed on similar paper.
A residential or commercial air conditioner, clothes dryer,
clothes washer, dishwasher, freezer, oven, microwave oven (from which
the capacitor has been removed), refrigerator, stove, furnace, boiler,
dehumidifier, or water heater.
A property containing five or more residential units, including
those which are occupied seasonally.
Includes newspapers and other material printed on newsprint.
Commercial, retail, industrial, institutional and governmental
facilities and properties. This term does not include multiple-family
dwellings.
High-grade printing and writing papers from offices in nonresidential
facilities and properties. Printed white ledger and computer printout
are examples of office paper generally accepted as high-grade. This
term does not include industrial process waste.
Plastic resins labeled by the SPI Code No. 7.
Includes any individual, corporation, partnership, association,
local governmental unit, as defined in ยงย 66.0901, Wis. Stats.,
state agency or authority, or federal agency.
Polyethylene terephthalate plastic containers marked by the
SPI Code No. 1.
An individual, separate, rigid plastic bottle, can, jar or
carton, except for a blister pack, that is originally used to contain
a product that is the subject of a retail sale.
Solid waste other than solid waste generated in the production
of goods, hazardous waste, waste from construction and demolition
of structures, scrap automobiles or high-volume industrial waste.
Polypropylene, labeled by the SPI Code No. 5.
Polystyrene plastic containers marked by the SPI Code No.
6.
Polyvinyl chloride plastic containers marked by the SPI Code
No. 3.
Includes lead acid batteries, major appliances, waste oil,
yard waste, aluminum containers, corrugated paper or other container
board, foam polystyrene packaging, glass containers, magazines, newspaper,
office paper, rigid plastic containers, including those made of PETE,
HDPE, PVC, LDPE, PP, PS, and other resins or multiple resins, steel
containers, waste tires, bimetal containers and e-waste.
As specified in ยงย 289.01(33), Wis. Stats.
As specified in ยงย 289.01(35), Wis. Stats.
As given in ยงย 289.01(39), Wis. Stats., and means
any method, technique or process which is designed to change the physical,
chemical or biological character or composition of solid waste. "Treatment"
includes incineration.
A tire that is no longer suitable for its original purpose
because of wear, damage or defect.
Leaves, grass clippings, yard and garden debris, and brush,
including clean woody vegetative material no greater than six inches
in diameter. This term does not include stumps, roots or shrubs with
intact root balls.

Separation required. Occupants of single-family and two-unit to four-unit
residences, multiple-family dwellings and nonresidential facilities
and properties shall separate the following materials from post-consumer
waste:

Lead acid batteries.
(2)ย
Major appliances.
(3)ย
Waste oil.
(4)ย
Yard waste.
(5)ย
Aluminum cans.
(6)ย
Bimetal containers.
(7)ย
Corrugated paper or other container board.
(8)ย
Foam polystyrene packaging.
(9)ย
Container glass.
(10)ย
Magazines.
(11)ย
Newspapers.
(12)ย
Office paper.
(13)ย
Junk mail.
(14)ย
Rigid plastic containers made of No. 1 PETE, No. 2 HDPE, No.
3 PVC, No. 4 LDPE, No. 5 PP, No. 6 PS, and other resins No. 7, or
multiple resins when state-mandated.

Steel containers.

Waste tires.
B.ย
Changes in requirements. The Village of Monticello reserves the right
to designate additional solid waste materials as recyclable, or currently
collected materials as no longer recyclable in accordance with state
law and to either add or delete them from any collection services
provided by the Village or its contractors. The Village of Monticello
shall provide written notice to service recipients of this declaration.
The separation requirements of ยงย 303-23 do not apply to the following:

Occupants of single-family and two-unit to four-unit residences, multiple- family dwellings and nonresidential facilities and properties that send their post-consumer waste to a processing facility licensed by the Wisconsin Department of Natural Resources that recovers the materials specified in ยงย 303-23 from solid waste in as pure a form as is technically feasible.
B.ย
Solid waste which is burned as a supplemental fuel at a facility
if less than 30% of the heat input to the facility is derived from
the solid waste burned as supplemental fuel.
To the greatest extent practicable, the recyclable materials separated in accordance with ยงย 303-23 shall be clean and kept free of contaminants such as food or product residue, oil or grease, or other nonrecyclable materials, including but not limited to household hazardous waste, medical waste, and agricultural chemical containers. Recyclable materials shall be stored in a manner which protects them from wind, rain and other inclement weather conditions.
Occupants of single-family and two-unit to four-unit residences,
multiple-family dwellings, and nonresidential facilities and properties
shall manage lead acid batteries, major appliances, waste oil and
yard waste as follows:
A.ย
Lead acid batteries shall be brought to the Village of Monticello
Recycling Center.
B.ย
Major appliances shall be picked up only on cleanup days, spring
and fall, after removal of motors, compressors, capacitors, and Freon,
which must be removed by a licensed technician, and then brought to
recycling with a certified Freon removal slip.
C.ย
Waste oil shall be brought to the Village of Monticello Recycling
Center.
D.ย
Yard waste shall be brought to the Village of Monticello Recycling
Center.
A.ย
Except as otherwise directed by the Village Board, occupants of single-family and two-unit to four-unit residences shall do the following for the preparation and collection of separated materials specified in ยงย 303-23A(5) through (15):
(1)ย
Aluminum containers shall be rinsed and flattened.
(2)ย
Bimetal containers shall be rinsed, labels removed and flattened.
(3)ย
Corrugated paper or other container board shall be flattened and
bundled.
(4)ย
Foam polystyrene packaging shall be rinsed if necessary.
(5)ย
Glass containers shall be washed with lids removed and separated
by color.
(6)ย
Magazines shall be separated from newspapers and bundled.
(7)ย
Newspaper shall be bundled. Telephone directories can be included
with covers removed.
(8)ย
Office paper shall be kept separate from newspaper.
(9)ย
Junk mail shall be kept separate from newspaper and office paper.
(10)ย
Rigid plastic containers shall be prepared and collected as
follows: Plastic containers made of PETE, HDPE, PVC No. 3, LDPE No.
4, PP No. 5, PS No. 6, and other resins or multiple resins No. 7 shall
be prepared and collected when mandated by the state and market becomes
available.

Steel containers shall be rinsed, labels removed and flattened.
(12)ย
Waste tires shall be taken directly to a landfill where a per-tire
fee is charged.
(13)ย
E-waste shall be taken directly to a landfill where a per-pound
fee will be charged.

The Village or its authorized collector has the right to reject any recyclable material that is not prepared according to the specifications of Subsection A above, or in educational materials provided by the contractor or the Village to the service recipients. Materials may also be rejected if not separated from solid waste, placed properly for deposit, or are not designated recyclable materials for deposit.
A.ย
Owners or designated agents of nonresidential facilities and properties shall do all of the following to recycle the materials specified in ยงย 303-23A(5) through (15):
(1)ย
Provide adequate, separate containers for the recyclable materials.
(2)ย
Notify tenants in writing at the time of renting or leasing the dwelling
and at least semiannually thereafter about the established recycling
program.
(3)ย
Provide for the collection of the materials separated from the solid
waste by the tenants and the delivery of the materials to a recycling
facility.
(4)ย
Notify users, tenants and occupants of reasons to reduce and recycle,
which materials are collected, how to prepare materials in order to
meet the processing requirements, collection methods or sites, locations
and hours of operation, and a contact person or company, including
a name, address and telephone number.
B.ย
The requirements specified in Subsection A do not apply to the owners or designated agents of nonresidential facilities and properties if the post-consumer waste generated within the facility or property is treated at a processing facility licensed by the Department of Natural Resources that recovers for recycling the materials specified in ยงย 303-23A(5) through (15) from solid waste in as pure a form as is technically feasible.
A.ย
Owners or designated agents of multiple-family dwellings shall do all of the following to recycle the materials specified in ยงย 303-23A(5) through (15):
(1)ย
Provide adequate, separate containers for the recyclable materials.
(2)ย
Notify in writing, at least semiannually, all users, tenants and
occupants of the properties about the established recycling program.
(3)ย
Provide for the collection of the materials separated from the solid
waste by the users, tenants and occupants and the delivery of the
materials to a recycling facility.
(4)ย
Notify users, tenants and occupants of reasons to reduce and recycle
solid waste, which materials are collected, how to prepare the materials
in order to meet the processing requirements, collection methods or
sites, locations and hours of operation, and a contact person or company,
including a name, address and telephone number.
B.ย
The requirements specified in Subsection A do not apply to the owners or designated agents of multiple-family dwellings if the post-consumer waste generated within the dwelling is treated at a processing facility licensed by the Department of Natural Resources that recovers for recycling the materials specified in ยงย 303-23A(5) through (15) from solid waste in as pure a form as is technically feasible.
No person may dispose of in a solid waste disposal facility or burn in a solid waste treatment facility any of the materials specified in ยงย 303-23A(5) through (15) which have been separated for recycling, except waste tires may be burned with energy recovery in a solid waste treatment facility.
A.ย
For the purpose of ascertaining compliance with the provisions of
this article, any authorized officer, employee or representative of
the Village of Monticello may inspect recyclable materials separated
for recycling, post-consumer waste intended for disposal, recycling
collection sites and facilities, collection vehicles, collection areas
of multiple-family dwellings and nonresidential facilities and properties,
and any records relating to recycling activities, which shall be kept
confidential when necessary to protect proprietary information. No
person may refuse access to any authorized officer, employee or authorized
representative of the Village of Monticello who requests access for
purposes of inspection, and who presents appropriate credentials.
No person may obstruct, hamper or interfere with such an inspection.
B.ย
Any person who violates a provision of this article may be issued
a citation by the Monticello Police Department to collect forfeitures.
The issuance of a citation shall not preclude proceeding under any
other ordinances or law relating to the same or any other matter.
Proceeding under any other ordinance or law relating to the same or
any other matter shall not preclude the issuance of a citation under
this subsection.
