[Adopted as Title 8, Ch. 3, of the 1989 Code of Ordinances]
Four garbage districts, all of which are subject to the provisions
of this article, are hereby established as follows:
For the purpose of this article, the following words and phrases
shall have the meanings given herein unless different meanings are
clearly indicated by the context:
AGRICULTURAL ESTABLISHMENT
An establishment engaged in the rearing and slaughtering
of animals and the processing of animal products or orchard and field
crops.
BULKY WASTE
Items whose large size precludes or complicates their handling
by normal collection, processing or disposal methods.
COMMERCIAL UNIT
Commercial units shall be all property other than residential
units and shall include boardinghouses, motels and resorts.
CURB
The back edge or curb and gutter along a paved street or
where one would be if the street was paved and had curb and gutter.
DEMOLITION WASTES
That portion of solid wastes consisting of wastes from the
repair, remodeling or reconstruction of buildings, such as siding,
lumber, roofing and sheathing scraps, rubble, broken concrete, asphalt
and plaster, conduit, pipe, wire, insulation and any other materials
resulting from the demolition of buildings and improvements.
DISPOSAL
The orderly process of discarding useless or unwanted material.
DNR
The Wisconsin Department of Natural Resources.
DUMP
A land site where solid waste is disposed of in a manner
that does not protect the environment.
DWELLING UNIT
A place of habitation occupied by a normal single-family
unit or a combination of persons who may be considered as equivalent
to a single-family unit for the purposes of this article.
E-WASTE
Any electronic computing or processing equipment including,
but not limited to, computers such as laptops, desktops, netbooks
and tablets, printers such as those that fax, scan and/or copy, computer
monitors such as CRTs and flat panel monitors, fax machines, computer
mice and keyboards and computer accessories such as hard drives, flash
drives, memory sticks, speakers, modems, CD and DVD players, video
gaming devices and similar electronic items.
GARBAGE
All items which are not recyclable, not burnable, or of a
compost nature, and all kinds of organic kitchen waste resulting from
the preparation or consumption of food and all decayed or spoiled
food products from any source whatsoever, but shall not include bodily
waste, with the exception of disposable diapers.
GARBAGE BAG
Not larger than thirty-gallon and of clear or opaque in color.
Plastic garbage bags must be closed with a tie and shall be of sufficient
strength to withstand stress resulting from handling during collection.

HAZARDOUS WASTE
Those wastes such as toxic, radioactive or pathogenic substances
which require special handling to avoid illness or injury to persons
or damage to property and the environment.
INDUSTRIAL WASTE
Waste material, except garbage, rubbish and refuse, directly
or indirectly resulting from an industrial processing or manufacturing
operation.
LITTER
Solid waste scattered about in a careless manner, usually
rubbish.
NONRESIDENTIAL SOLID WASTE
Solid waste from agricultural, commercial, industrial or
institutional activities or a building or group of buildings consisting
of four or more dwelling units.
PERSON
Individuals, firms, corporations and associations, including
the plural as well as the singular.
RECYCLABLES
Waste material that can be remanufactured into usable products
and shall include, by way of enumeration but not by way of limitation,
glass, plastics, newspapers, cardboard, and metals (aluminum, steel,
tin, brass, etc.).
REFUSE
Includes all waste material, including garbage, rubbish and
industrial waste, and shall, by way of enumeration but not by way
of limitation, include grass, leaves, sticks, tree branches and logs,
stumps, stone, cement, boards, furniture or household appliances,
and garden debris.
RESIDENTIAL SOLID WASTE
All solid waste that normally originates in a residential
environment from residential dwelling units.
RESIDENTIAL UNIT
An individual household capable of independent habitation
by a family unit. A single-family dwelling shall be considered to
be one residential unit; multifamily dwelling shall be considered
to be multiple residential units, the number of residential units
to equal the number of family units to be housed therein. "Residential
unit" shall not include boardinghouses, motels or resorts.
SCAVENGING
The uncontrolled removal of materials at any point in solid
waste management.
SOLID WASTE
Garbage, rubbish and other useless, unwanted or discarded
material from agricultural, residential, commercial, industrial or
institutional activities. "Solid waste" does not include solid or
dissolved material in domestic sewage.
STORAGE
The interim containment of solid waste in an approved manner
after generation and prior to collection and ultimate disposal.
STORAGE AREAS
Areas where persons place containers during noncollection
days as well as areas where containers are set out on collection day.
TRASH
Waste products such as wire or metal of any kind, magazines,
plastics, china, crockery, ashes or other nongarbage waste material
which results from the normal operation of a household, but not including
bodily waste. Large cartons or crates shall constitute "trash" if
such cartons or crates are broken down to a size suitable for handling
by the garbage collector and are compacted into a specified plastic
bag or dumpster. Brush and branch clippings or cuttings and tree limbs
shall not constitute "trash" for the purpose of collection.
Storage areas shall be kept in a nuisance and odor-free condition.
Litter shall not be allowed to accumulate. Collection crews will not
be responsible for cleaning up loose materials from any containers
which have become ruptured or broken due to wet conditions, animals,
vandalism or other cause. The occupant and/or owner shall be responsible
for cleaning up this litter. Litter not collected shall not be allowed
to accumulate. Violation will result in the occupant and/or owner
being notified to clean up his area with continued violation resulting
in the owner being prosecuted under the provisions of this article
and other Village ordinances.
The accumulation or deposit of garbage, trash or putrescible
animal or vegetable matter in or upon any lot or land or any public
or private place within the Village which causes the air or environment
to become noxious or offensive or to be in such a condition as to
promote the breeding of flies, mosquitoes or other insects, or to
provide a habitat or breeding place for rodents or other animals,
or which otherwise becomes injurious to the public health, is prohibited
and declared to constitute a nuisance.
It is unlawful for any person, firm or corporation to place,
deposit or cause to be deposited, for collection, any waste or refuse
not generated within the corporate limits of the Village of Monticello.
The Village Board hereby designates the collection point for
used tires and e-waste as the Green County Landfill. The Village shall
not pick up tires or e-waste for collection.
The Village of Monticello will provide a place for deposit of
these items. A compost pile will also be provided for the collection
of grass clippings and leaves and other vegetative matter.

A. Courtesy pickups may be provided on a prearranged custom basis for
a fee.
B. Courtesy pickups shall be prearranged with the Director of Public
Works by the resident who shall pay a fee as provided by the Village
Fee Schedule prior to or at the time of pickup.
C. The courtesy pickup fee shall be as provided by the Village Fee Schedule
and shall include 15 minutes of crew operation.
D. Additional time required shall be billed to the resident on a time-consumed
basis at the rate provided by the Village Fee Schedule per each additional
and succeeding fifteen-minute period.
E. The Director of Public Works or the Director's designee shall
have the right and authority to refuse a request for a courtesy pickup.
Courtesy pickups shall be limited to materials accumulated by an owner
or tenant of Village property. No collection shall be made of contractors'
materials.

A. Definitions.
DUMPSTER
A metal container commonly used to collect combined refuse
in multifamily dwellings (four dwelling units or more) and commercial
establishments.
TEMPORARY DUMPSTER
A large container commonly designed for the receiving, transporting
and dumping of waste materials on a temporary basis during demolition
or construction projects and is not intended to include dumpsters
employed for refuse or recycling collections.
TEMPORARY STORAGE UNIT
Any container, portable structure or temporary accessory
structure that can be or is used for the storage of personal property
or equipment of any kind and which is location for such purposes outside
an enclosed building.
B. Trash
pickup. It is unlawful for any person in a noncommercially zoned area
(R-1 Single-Family Residential, R-2 One- and Two-Family Residential
and R-3 Multiple-Family Residential under five units) to whom trash
pickup is available to have a dumpster.
C. Dumpsters.
Dumpsters shall be kept closed with covers (except when being filled
or emptied) and shall be kept in a sanitary and mechanical condition.
Dumpsters which are found to be in nonmechanical condition may be
ordered to be replaced by the Village at owner' s expense.
D. Accessibility.
When access to a dumpster is impeded by any object, including, but
not limited to, snow, ice or any other material, the dumpster will
not be emptied until the obstruction is removed.
E. Refusal
to collect. The Director of Public Works or his employees or agents
may refuse to collect any garbage or refuse improperly prepared or
deposited for pickup as provided by this chapter.
F. Dumpster use restricted to authorized persons. No person shall be permitted to place any item in a dumpster unless authorized by the owner of the property on which the dumpster is located. Any person who violates this section shall be subject to the penalties in §
1-6.
G. Safety
conditions.
(1) The
area around a dumpster shall be kept free of debris and litter, to
include the removal of nails, screws, or similar metallic materials
with the use of a magnet-type tool.
(2) The
area around a dumpster shall be kept free of sharp debris or construction
material such as metal and glass.
(3) All
full dumpsters shall be removed from a property or emptied within
72 hours after becoming full.
(4) All
dumpsters, except construction dumpsters, shall be fully secured with
the lid in place.
(5) All
dumpsters shall be maintained on a flat surface or properly secured
to prevent undesired moving of dumpster.
(6) All
dumpsters that are on or within six feet of a public roadway, alleyway,
highway, or parking lot shall be made to be visible on all visible
sides of the dumpster with a reflective area not less than 36 inches
square. The owner of the dumpster shall be responsible for making
the dumpster visible as set forth in this subsection.
(7) All
dumpsters utilized in the Village shall be placed, at minimum, equal
distance from fire hydrants as vehicles are required by law.
H. Temporary
dumpsters and storage unit on Village property or streets. No person
shall place any dumpster or similar container used for the purpose
of disposing of garbage or refuse on any Village property or Village
street without first obtaining permission from the Police Chief or
the Chief's designee. In the event the Police Chief authorizes the
placement of a dumpster on Village property or on any Village street,
the property owner shall be responsible for marking the dumpster to
warn motorists and other users of the street of the existence and
location of the dumpster. The Police Chief may require the placement
of marking or warning devices, including lighted barricades, fluorescent
tape, cones, or reflectors. Any dumpster authorized to be placed on
any Village street must be placed against the curb so as not to impede
traffic in any manner. No dumpster shall be permitted to be located
on any Village property or any Village street for more than 14 consecutive
days. Any dumpster which is placed on Village property or on any Village
street which remains on the Village property or the Village street
longer than the period of time authorized by the Police Chief shall
be removed by the Village and the cost thereof shall be a special
charge which, if unpaid, shall be placed on the tax bill of the property
in accordance with the provisions of § 66.0703, Wis. Stats.
I. Noncomplying
dumpsters. Any dumpster not in compliance with this section must be
corrected and brought into compliance immediately or it is hereby
declared to be a public nuisance and may be abated by the Village
at the owner's or responsible person's expense. Abatement shall, at
the Village's option, include removal, emptying, or cleaning the dumpster.
If the owner or responsible party is not able to be contacted, the
Village is hereby authorized to immediately abate the noncompliance.
J. Enforcement. It shall be unlawful for a person or company to utilize a dumpster in the Village in violation of this section. Any person who violates a provision of this section may be required to pay a forfeiture per Village Code §
1-6 for each violation.

It is the purpose of this article to promote recycling, composting,
and resource recovery through the administration of an effective recycling
program, as provided in § 287.11, Wis. Stats., and Ch. NR
544, Wis. Adm. Code, by the Village of Monticello in order to protect
and promote the public health, safety and welfare.
This article is adopted as authorized under § 287.09(3)(b),
Wis. Stats.
It is not intended by this article to repeal, abrogate, annul,
impair or interfere with any existing rules, regulations, ordinances
or permits previously adopted or issued pursuant to law. However,
whenever this article imposes greater restrictions, the provisions
of this article shall apply.
The requirements of this article apply to all persons within
the boundaries of the Village of Monticello.
The provisions of this article shall be administered by the
Village Board of the Village of Monticello.
For the purpose of this article the following words and phrases
shall have the meanings ascribed to them in this section:
BIMETAL CONTAINER
A container for carbonated or malt beverages that is made
primarily of a combination of steel and aluminum.
CONTAINER BOARD
Corrugated paperboard used in the manufacture of shipping
containers and related products.
FOAM POLYSTYRENE PACKAGING
Packaging made primarily from foam polystyrene that satisfies
one of the following criteria:
A.
Is designed for serving food or beverages.
B.
Consists of loose particles intended to fill space and cushion
the packaged article in a shipping container.
C.
Consists of rigid materials shaped to hold and cushion the packaged
article in a shipping container.
HDPE
High-density polyethylene plastic containers marked by the
SPI Code No. 2.
JUNK MAIL
Any paper, glossy, semiglossy or regular, including advertising
window envelopes.
LDPE
Low-density polyethylene plastic containers marked by the
SPI Code No. 4.
MAGAZINES
Magazines and other materials printed on similar paper.
MAJOR APPLIANCE
A residential or commercial air conditioner, clothes dryer,
clothes washer, dishwasher, freezer, oven, microwave oven (from which
the capacitor has been removed), refrigerator, stove, furnace, boiler,
dehumidifier, or water heater.
MULTIPLE-FAMILY DWELLING
A property containing five or more residential units, including
those which are occupied seasonally.
NEWSPAPERS
Includes newspapers and other material printed on newsprint.
OFFICE PAPER
High-grade printing and writing papers from offices in nonresidential
facilities and properties. Printed white ledger and computer printout
are examples of office paper generally accepted as high-grade. This
term does not include industrial process waste.
PERSON
Includes any individual, corporation, partnership, association,
local governmental unit, as defined in § 66.0901, Wis. Stats.,
state agency or authority, or federal agency.
PETE
Polyethylene terephthalate plastic containers marked by the
SPI Code No. 1.
PLASTIC CONTAINER
An individual, separate, rigid plastic bottle, can, jar or
carton, except for a blister pack, that is originally used to contain
a product that is the subject of a retail sale.
POST-CONSUMER WASTE
Solid waste other than solid waste generated in the production
of goods, hazardous waste, waste from construction and demolition
of structures, scrap automobiles or high-volume industrial waste.
PP
Polypropylene, labeled by the SPI Code No. 5.
PS
Polystyrene plastic containers marked by the SPI Code No.
6.
PVC (V)
Polyvinyl chloride plastic containers marked by the SPI Code
No. 3.
RECYCLABLE MATERIALS
Includes lead acid batteries, major appliances, waste oil,
yard waste, aluminum containers, corrugated paper or other container
board, foam polystyrene packaging, glass containers, magazines, newspaper,
office paper, rigid plastic containers, including those made of PETE,
HDPE, PVC, LDPE, PP, PS, and other resins or multiple resins, steel
containers, waste tires, bimetal containers and e-waste.
SOLID WASTE TREATMENT
As given in § 289.01(39), Wis. Stats., and means
any method, technique or process which is designed to change the physical,
chemical or biological character or composition of solid waste. "Treatment"
includes incineration.
WASTE TIRE
A tire that is no longer suitable for its original purpose
because of wear, damage or defect.
YARD WASTE
Leaves, grass clippings, yard and garden debris, and brush,
including clean woody vegetative material no greater than six inches
in diameter. This term does not include stumps, roots or shrubs with
intact root balls.
The separation requirements of §
303-23 do not apply to the following:
A. Occupants of single-family and two-unit to four-unit residences, multiple- family dwellings and nonresidential facilities and properties that send their post-consumer waste to a processing facility licensed by the Wisconsin Department of Natural Resources that recovers the materials specified in §
303-23 from solid waste in as pure a form as is technically feasible.
B. Solid waste which is burned as a supplemental fuel at a facility
if less than 30% of the heat input to the facility is derived from
the solid waste burned as supplemental fuel.
C. A recyclable material specified in §
303-23 for which a variance has been granted by the Department of Natural Resources under § 287.11(2)(m), Wis. Stats., or NR 544.14, Wis. Adm. Code.
To the greatest extent practicable, the recyclable materials separated in accordance with §
303-23 shall be clean and kept free of contaminants such as food or product residue, oil or grease, or other nonrecyclable materials, including but not limited to household hazardous waste, medical waste, and agricultural chemical containers. Recyclable materials shall be stored in a manner which protects them from wind, rain and other inclement weather conditions.
Occupants of single-family and two-unit to four-unit residences,
multiple-family dwellings, and nonresidential facilities and properties
shall manage lead acid batteries, major appliances, waste oil and
yard waste as follows:
A. Lead acid batteries shall be brought to the Village of Monticello
Recycling Center.
B. Major appliances shall be picked up only on cleanup days, spring
and fall, after removal of motors, compressors, capacitors, and Freon,
which must be removed by a licensed technician, and then brought to
recycling with a certified Freon removal slip.
C. Waste oil shall be brought to the Village of Monticello Recycling
Center.
D. Yard waste shall be brought to the Village of Monticello Recycling
Center.
No person may dispose of in a solid waste disposal facility or burn in a solid waste treatment facility any of the materials specified in §
303-23A(5) through
(15) which have been separated for recycling, except waste tires may be burned with energy recovery in a solid waste treatment facility.
