No person or persons shall set or maintain any fire upon any
of the streets, sidewalks, alleys, tree lawns or public grounds in
the Borough of Wyoming, or burn or cause to be burned thereon any
paper, boxes, rubbish, leaves or other material or substance of any
kind, nor shall any person or persons set or maintain a fire of any
kind out of doors, anywhere within the confines of the said Borough,
as now or hereafter, as the case may be, constituted.

Nothing contained in §
7-101 herein shall be construed to apply to the use of any standard commercially designed noncombustible equipment commonly used in so-called "cookouts" for noncommercial preparation of food to be consumed on the premises. No such fire shall be closer than 10 feet from any building or from any property line.
Further, firepits, and portable recreational fire devices such
as fire bowls and chimineas, that are fueled by wood, natural gas,
or propane, for the sole purpose of a recreational activity shall
be permitted provided that the following terms and conditions are
met:
a. Residents can have a fire pit in their backyard, but the fuel area
of the fire pit must be equal to or less than five feet in diameter;
b. Smoke coming from your fire pit or device shall not be a nuisance
to your neighbor;
c. At no time shall any firepit burn any type of construction material
or trash is prohibited, as is using any type of flammable or combustible
liquid;
d. At least one person 18 years of age or older must be present;
e. A garden hose connected to a constant water source or extinguishing
device must be stored close by the fire pit or device in case of emergency;
f. If a garden hose is not available, adequate fire suppression equipment
shall be immediately available to extinguish or control the fire;
g. The firepit shall not be left unattended at any time;
h. No firepit shall be used on a deck or balcony; and
i. No such fire shall be closer than 10 feet from any building or from
any property line.

Any person, firm or corporation who shall violate any provision
of this part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall first be afforded a warning of a violation under any section
of this part; thereafter, a second warning may be given at the discretion
of the responding police officer based on the violation or a person,
firm or corporation shall be sentenced to pay a fine of not more than
$300 plus costs together with reasonable attorney fees and, in default
of payment of dais fine and costs to a term of imprisonment not to
exceed 90 days. Each day that a violation of the part continues or
each section of this part which shall be found to have been violated
shall constitute a separate offense.
