The following rules and regulations for the use of the Springdale Marina at the bottom of Colfax Street are hereby adopted.
Overnight camping, the erection of any tent or either device used for, or capable of being used for, sleeping or cooking, the building or maintaining of open fires, swimming, and the picking, cutting, or digging of flowers, plants, shrubs and trees is prohibited.
Leaving, depositing and/or the disposal of any trash, garbage or other debris on Borough property at the marina is prohibited unless placed in containers, if provided for this purpose, and such disposal shall be limited to materials accumulated during the use of the Borough property at the marina. Disposing, leaving, or discarding on Borough property at the marina of camp, household or other refuse accumulated off such property is hereby prohibited.
Any personal, organizational or commercial use other than normally intended fishing and boating activities is prohibited, except that the Executive Director of the Pennsylvania Fish Commission or his designee may issue special event permits to organizations consisting of, but not limited to, Scouts of America, church groups, chartered fire and rescue groups, and American Red Cross units for the use of said marina property when it is determined that such use will not damage the marina property and will not interfere with normal usage by others.
The removal or defacing of any sign, poster, or property is prohibited, and it shall be unlawful to damage in any manner any lands or to interfere with any device or structure thereon or to alter or interfere with the flow of water over or through any structure on said marina property.
Vehicles properly registered in conformity with the Pennsylvania Vehicle Code[1] will be permitted on the marina property, provided they are operated only on roads open to the public and in such a manner as to not endanger life or property. Vehicles must be parked in designated areas only, and the blocking of driveways, access roads and launching ramps is prohibited.

Any person or persons, corporations or organizations found guilty of violating any provisions of this article shall, upon conviction thereof by the Magisterial District Judge, be fined the sum of not less than $300 nor more than $600 and, upon failure to pay, incarcerated in the Allegheny County Jail for a period not to exceed 30 days.

Agan Park, Veterans Memorial Field and the senior citizens room and gymnasium at the Springdale Borough Municipal Building shall be used as directed by Springdale Borough Council or its authorized representatives. Group uses of these facilities must be scheduled at least 30 days in advance. All uses by minors must include at least one supervising adult at all times. Use of any facility shall not be permitted until background clearances are submitted to the Borough offices, including Federal Criminal History Record, the Pennsylvania State Criminal Record Check and the Pennsylvania Child Abuse History Clearance.
The Springdale Borough Police shall be responsible for unlocking and locking the Municipal Building, Agan Park and Veterans Memorial Park for group uses whenever requested to do so by Borough officials. The police shall also be responsible for opening the Municipal Building on election days when it is used as a polling place.
All repair and maintenance work at the above-named facilities shall be performed by Borough employees or by parties designated by Springdale Borough Council.
No bicycles, dogs, golfing or any use of alcoholic beverages shall be permitted on the premises of Veterans Memorial Field.
Borough Council may by motion establish regular hours during which the Municipal Building, Agan Park and the Veterans Memorial Field shall be open to the public.
Permits must be obtained for all group uses of Agan Park. Such permits shall be obtained at the Springdale Borough Municipal Building. Permit fees shall be as established by motion of Springdale Borough Council.
All persons engaging in group use of Agan Park, Veterans Memorial Field or the Municipal Building shall be responsible for disposing of garbage and refuse generated by the use. The premises shall be left in a condition at least as clean as prior to the use. Borough Council or its authorized representatives may require and set the amount of cleanup bond, to be posted at the time a group use is scheduled.
Nothing in this article shall be construed to impose duties on the Borough of Springdale to provide for the health or safety of those using Borough facilities or to impose liability for failing to do so. All persons using Borough facilities do so at their own risk, and all groups are expected to supervise themselves.

Any person, group or organization violating any of the provisions of this article shall be guilty of a summary offense punishable by a fine of not less than $300 and not more than $600. Penalties shall apply to all persons participating in group uses of facilities in violation of this article, whether they are members of the group requesting the use or not. The Borough of Springdale or its authorized representatives may take all legal action necessary to restrain, prevent, terminate or abate violations of this article or to enforce payment of cleanup costs by those using Borough facilities.
