It shall be unlawful for children under the age of 14 years
to be, or remain in or upon the streets, alleys, parks or public places
in the Municipality at night after the hour of 11:00 p.m., EST or
DST, unless such is accompanied by a parent, guardian or other persons
having legal custody of such child.

It is hereby unlawful for any parents, guardian or other person
having the legal care or custody of any of the children above-designated
to allow or permit any such child, ward or other person under such
age, while in such legal custody, to go or be in or upon any streets,
alleys, parks or public places in said Municipality after the time
provided in Section 401 of this chapter, excepting as therein provided.

Any child, as above designated, found upon the municipal streets,
alleys, parks or public places within the Municipality in violation
of Section 401 of this chapter shall be taken into custody by the
municipal police and delivered to his or her parents, guardian or
person having the legal custody of said child, and report thereof
made immediately to the Manager{50}, who shall make a record thereof
in a book to be kept for that purpose. If said parent, guardian or
person having legal custody of said child shall again allow him or
her to be on said streets, alleys, parks or public places in violation
of Section 401 of this chapter, said parent, guardian or person having
the legal custody of said child so offending shall, upon conviction
thereof before the District Justice{60}, be sentenced to pay a fine
of not more than $25 nor less than $1 and the costs of suit; or, on
failure of the convicted party to pay such fine and costs, to be committed
to the County Jail for a period not exceeding five days, at discretion
of the District Justice{70}, and a like fine or imprisonment shall
be imposed on any person aiding or abetting the violation of the intent
and purpose of this ordinance.

The police officers of the Municipality, in taking children
into custody, shall use their discretion in determining age and, in
doubtful cases, may require positive proof and, until such proof is
furnished, the officer's judgment shall prevail.

Said children who shall violate this ordinance more than three
times shall be reported to the Juvenile Probation Officer of Centre
County. Proceedings shall be instituted in the Court of Quarter Sessions
against such incorrigible and delinquent children as the occasion
shall demand.
