Except where otherwise indicated by context, the following definitions shall apply in the interpretation and enforcement of this chapter.
ALL-TERRAIN VEHICLE
A vehicle with treads, wheels or both, designed to traverse varied, uneven terrain as well as roads.
BOARD OF SUPERVISORS
Supervisors of Hemlock Township, Columbia County, Pennsylvania.
MOTOR VEHICLE
Any self-propelled vehicle or vehicle propelled or drawn by a self-propelled vehicle, including any vehicle commonly referred to as a snowmobile, ATV or similar.
MUNICIPALITY
The Township of Hemlock, Columbia County, Pennsylvania.
PERSON
Any natural or other person, firm, partnership, association, corporation, company or organization of any kind.
PUBLIC PARKS OR PARK
Any land owned or leased by the Township for the use of the public for any one or combination of the following uses, to-wit: recreation, amusement, playground and field, swimming beaches, trails and trail ways and any area used by the public for relaxation.
RECREATIONAL FACILITY
A building, structure, field, court or park which has organized activities for teams and individuals or which provides active facility sites for non-organized leisure play.

The Board of Supervisors may, from time to time, review or alter the rules and regulations reasonably necessary to have a proper and effective administration of this Part.
A. 
Defacing or Destroying Property Prohibited. No person shall willfully mark, deface, destroy, damage or impair the value of any public or private property located within any public park or recreational facility in the Township including buildings, structures, signs, trees, shrubs, grass, walkways, lighting, playground equipment or vegetation or similar located therein.
B. 
Littering Prohibited. No person shall litter, cast or throw rubbish, trash or garbage in any public park or recreational facility, including any surrounding water area within the Township except in containers and receptacles duly designated for said purpose.
C. 
Parking and Driving All-Terrain and Motor Vehicles. No all-terrain or motor vehicle shall be driven in a public park or recreational facility, except on roadways and trail ways designated and developed for said purposes. No motor vehicles shall be parked in any public park, recreational facility, public paths and trail ways, except in those areas duly posted, designated or developed for the parking of motor vehicles.
D. 
Park Hours. All park or recreational facility hours shall be from dawn until dusk of each day, year round. No person shall enter any park or recreational facility before dawn and all persons shall leave on or before dusk. No motor or all-terrain vehicle shall be parked in a public park or recreational facility, except in those hours designated in which said parks or facilities are open to the public.
E. 
Speed of Vehicles. No person shall operate a motor vehicle at a greater speed than 15 m.p.h. in any park or recreation facility.
F. 
Alcoholic Beverages. Alcoholic beverages are prohibited at all times in all parks and recreational facilities.
G. 
Open Fire Prohibited. No person shall build a fire in any area in a park or recreational facility, except in fireplaces or receptacles duly provided for said purpose.
H. 
Domestic Animals. No domestic animals shall be permitted in any public park or recreational facility, unless on a leash at all times and only in areas permitted.
I. 
Camping and/or Vagrancy. No camping or overnight stays shall be permitted at any time in any public park or recreational facility in the Township.

No person other than Township employees or designated Township agents shall cut and/or remove trees, shrubs, bushes or other vegetation, including seeds or spores, from any Township park, recreational facility or property owned by the Township.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $300, nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

This Part may be enforced by law enforcement officers and Zoning Officer of Hemlock Township.
