The owner, occupant, or tenant of every property
fronting upon or alongside any street in the Borough of Bath is hereby
required to remove or to cause to be removed, from all the sidewalks
abutting such property all snow and ice thereon fallen or formed,
within 24 hours after the same shall have ceased to fall or to be
formed. The same shall apply to areas around and including fire hydrant
fixtures located on every property fronting upon or alongside any
street in the Borough of Bath. The owner of a property shall be responsible
for conforming to the requirements of this section where such property
is occupied by such owner, or is vacant or unoccupied, or is a multiple-unit
property occupied by more than one occupant or tenant. The occupant
or tenant thereof shall be responsible therefor in the case of an
occupied property containing a single rental unit.
In any case where the owner, occupant, or tenant, as aforesaid, shall fail, neglect, or refuse to comply with any provision of §
568-32 hereof within the time limit prescribed therein, the Borough authorities may proceed immediately to clear all snow and/or ice from the sidewalk of such delinquent, and to collect the expenses thereof, with an additional amount of 10% thereof, from such owner, occupant, or tenant, as the case may be, which may be in addition to any fine or penalty imposed hereunder.

Any owner, occupant, or tenant who shall fail to remove any ice or snow from any sidewalk as required under §
568-32 herein shall be guilty of a violation of this chapter, and upon conviction, shall be sentenced to pay a fine of not more than $50, or such other amount as is approved, from time to time, by resolution of Borough Council, and costs of prosecution, together with the municipal cost of removal, if such has been accomplished. In default of payment of such fine, expenses, and costs, violator shall be subject to undergo imprisonment for not more than five days. Such fine, expenses, and costs may be in addition to any expenses and additional amounts imposed as provided in §
568-33 hereof. The liability imposed by §§
568-32 and
568-33 hereof shall be joint and several as among multiple owners, occupants, and tenants. In addition, court costs and reasonable attorney fees incurred by the Borough in enforcement proceedings shall be assessed against violator and awarded to the Borough.
