For the purpose of this chapter, the terms defined herein shall
have the meaning ascribed to them:
OPERATE
To ride in or on, other than as a passenger, use or control
the operation of a snowmobile in any manner, whether or not said snowmobile
is in motion.
OPERATOR
Every person who operates or is in actual physical control
of a snowmobile.
SNOWMOBILE
A self-propelled vehicle designed for travel on snow or ice,
steered by skis or runners, and supported in part by skis, belts or
cleats.
Whenever the operation of a snowmobile is permitted on the shoulder
or inside bank of any Town of Walton highway or portion thereof as
provided in this chapter, the following conditions and restrictions
are hereby imposed, in addition to the regulations contained in the
Parks and Recreation Law, to all such snowmobile operations:
A. Unattended snowmobiles. It shall be unlawful for any owner or operator
to leave or allow a snowmobile to be left unattended on any Town of
Walton highway.
B. Obedience to vehicular traffic controls. Each person operating a
snowmobile on the inside bank or shoulder of any Town of Walton highway
shall observe strictly all vehicular traffic signs and signals and
all other rules and regulations applicable to vehicular traffic, and
shall obey the orders and directions of any state or local police
or other law enforcement officer authorized to direct or regulate
traffic.
C. Hours of operation. No snowmobile may be operated on the inside bank
or shoulder of any highway in the Town of Walton, pursuant to this
chapter, between the hours of 11:00 p.m. and 7:00 a.m. on Monday through
Friday or between the hours of 1:00 a.m. and 7:00 a.m. on Saturday
and Sunday.

A violation of this chapter shall be punishable by a fine of
not more than $250, imprisonment for not more than 15 days, or both
such fine and imprisonment. Upon conviction of a violation of any
provision of this chapter, a court may also require the convicted
person, as a condition of the sentence in addition to any other penalty,
to successfully complete an approved snowmobile safety course.
If any clause, sentence, paragraph, section or part of this
chapter shall be adjudged by any court of competent jurisdiction to
be invalid, such judgment shall not affect, impair or invalidate the
remainder thereof, but shall be confined in its operation to the clause,
sentence, paragraph, section or part thereof directly involved in
the controversy and which such judgment shall have been rendered.
This chapter shall take effect 10 days after publication and
posting of same as required by law.
