The purpose of this article is to abolish the offices of the three elected Town Assessors, and, in their stead and place, create the office of single appointed Town Assessor.
This article is enacted pursuant to §§ 310, 328, and 330 of the Real Property Tax Law of the State of New York and § 20 of the Municipal Home Rule Law of the State of New York.
The Town Board of the Town of Walton hereby declares that effective December 31, 2005, the three offices of elected Town Assessor are abolished and, in their stead and place, the office of single appointive Town Assessor is hereby created.
The single appointed Town Assessor shall be appointed by the Town Board of the Town of Walton for a six-year term commencing January 01, 2006; each appointee thereafter shall hold office for a six-year term.
The eligibility, qualifications, certification, and duties of the single appointed Assessor and the laws governing said office shall be as provided for by the Real Property Tax Law of the State of New York, as existing and as amended in the future from time to time, and such other statutes, rules and regulations of the State of New York as shall be applicable.
This article shall take effect January 01, 2006, upon its filing in the office of the Secretary of State as required by law.
