ENCLOSED AREA
All areas between a floor and ceiling, extending to the outer perimeter walls of a structure.
PARKS AND RECREATIONAL FACILITIES
Shall include all public parks, playgrounds, ball fields, publicly owned or leased by Jefferson Borough, and all property owned or leased by Jefferson Borough upon which the public is invited or upon which the public is permitted and where individuals gather for recreational activities, including, all areas adjacent to such facilities, including but not limited to, any parking area, driveway, or drive aisle.
MUNICIPAL BUILDINGS AND GROUNDS
Shall include all structures and property owned, leased, rented, and/or operated by Jefferson Borough and/or occupied by Borough employees and used for official business of Jefferson Borough.
SMOKING
The burning of, inhaling from, exhaling the smoke from, or the possession of a lighted cigar, cigarette, pipe, or any other matter or substance which contains tobacco or any other matter that can be smoked, or the inhaling or exhaling of smoke or vapor from an electronic smoking device.
A. 
Smoking shall be prohibited in all municipal buildings and grounds as defined herein and all public parks and recreational facilities owned or leased by Jefferson Borough and all property owned or leased by Jefferson Borough upon which the public is invited or upon which the public is permitted and where individuals gather for recreational activities, including all areas adjacent to such facilities, including, but not limited to, any parking area, driveway, or drive aisle.
B. 
Young Lungs at Play signs or other appropriate signage will be posted.
C. 
Smoking shall be prohibited in all vehicles registered to Jefferson Borough.
The enforcement authority of this chapter shall be the Jefferson Borough Council or a representative designated by the Jefferson Borough Council.
Any person who shall violate this chapter shall pay, upon summary conviction, a fine of not more than $1,000, together with costs of prosecution in each case, including, but not limited to, attorneys' fees, and in default of payment of such fine and costs may be punished by imprisonment for not more than 30 days.
All prior ordinances that are inconsistent herewith are hereby repealed to the extent of such inconsistency.
If any section, subsection, sentence or clause of this chapter is held for any reason to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this chapter.
