The Jefferson Codorus Joint Sewer Authority, having been organized with the Township of Codorus, located in York County, Pennsylvania, under the Municipality Authorities Act of 1945[1] for the purpose of constructing, improving, maintaining and operating a public sewer system and sewage treatment works, including potential for works for treating and disposing of industrial waste, in the Borough and in the area zoned residential in Codorus Township adjoining Jefferson Borough, as set forth in the service area defined and shown in the Jefferson Borough Sewage Facilities Plan, dated July 1, 2001, and any amendments thereto.

Articles of Incorporation to organize the Jefferson Codorus Joint Sewer Authority, a copy of which is on file in the Borough office and the contents of which are hereby incorporated herein as if fully set forth, are hereby approved.

The Borough and its governing body are hereby authorized to cooperate with the Township of Codorus in the creation of the Jefferson Codorus Joint Sewer Authority, which cooperation is authorized under the Intergovernmental Cooperation Law, 53 Pa.C.S.A. § 2301 et seq. The cooperation of the Borough and Township includes the holding of a joint public hearing upon their intention to organize the Jefferson Codorus Joint Sewer Authority as required by the Municipality Authorities Act of 1945, the execution and filing of the aforesaid Articles of Incorporation organizing said Authority, and the appointment of members to the Board of the said Authority as provided for in the Articles of Incorporation. The provisions of the Articles of Incorporation and the other sections of this article state any other terms regarding this cooperation and purpose for the same. The Borough and the Township will not own, operate or manage any property, real or personal for or regarding the purposes of the Jefferson Codorus Joint Sewer Authority, and that Authority will provide for any financing required for its purposes, which may be guaranteed by the Borough and the Township as may be deemed appropriate by the governing bodies of the same at the time of such financing.
The President of the Jefferson Borough Council and the Secretary of the Borough are hereby authorized and directed to execute the said Articles of Incorporation and to file same with the Secretary of the Commonwealth not less than three days after publication of the notice of adoption of this article as is required by the Municipality Authorities Act of 1945.
