The purpose of this Article is to establish general regulations for the usage of City parks, green spaces, Community Center and Community Rooms.

The provisions adopted in this Article shall not be exclusive but shall be cumulative and complementary to any other provisions of the City of Olivette ordinances and County, State and Federal laws. Nothing in this Article shall be read, interpreted or construed so as to limit any existing right or power of the City.

A.
The following rules and regulations shall apply to all City parks and green spaces:
1.
Park hours are from dawn to dusk.
2.
Pavilions and recreation areas must be left clean and free of trash and debris after use.
3.
Golf practicing is prohibited.
4.
No motor vehicles are permitted except in designated parking or driving areas.
5.
Dogs are to be leashed (maximum six (6) foot lead) and under control at all times except where posted.
6.
All fires must be contained to the barbeque pits only; all coals shall be put completely out and shall not be thrown in the park's trash containers.
7.
No glass containers or bottles are permitted in the park.
B.
The following rules and regulations shall apply to the Community Center and City Center Community Rooms.
1.
Facilities are smoke free.
2.
Renters must be twenty-one (21) years and older.
3.
All use, including food, drinks, and activities must be contained within the room specified.
4.
Serving of alcoholic beverages must comply with all local, State and Federal liquor laws and food must be served.
5.
Renters shall reimburse the City for all damages to property caused by the renter or the renter's guests, employees, agents or affiliated persons.
C.
The Park and Recreation Director may adopt additional rules as may be appropriate for park, community center, and community room operations.

A.
The following uses are allowed in any park only on receipt of a special use permit issued by the Director:
1.
Bands, public address systems, disc jockeys, or similar forms of entertainment or communication;
2.
Entertainment, amusement, or festival equipment or features such as rides, dunking booths, game booths, beer booths, food booths, moonwalks, tents, etc.;
3.
Portable barbecue pits or personal equipment that affixes to any park grounds or structure; and
4.
Other uses having potentially adverse impacts (litter, noise, crowds, etc.) on park facilities, other park users, or adjacent streets or neighbors.
B.
The Director may impose such requirements or restrictions on the issuance or enforcement of special use permits as are reasonably necessary to prevent, mitigate, or ameliorate adverse impacts likely to result from special use permit activities. The political (or other) viewpoint or nature of a person or group shall not be considered in issuing or enforcing special use permits.

The Director, his or her designee, and the City Police Department shall administer and enforce the powers and duties imposed by this Article.

The schedule of fees and charges for facilities, activities, equipment, events and programs may, from time to time, be changed in any respect by ordinance passed by the City Council, which ordinance shall be kept on file in the office of the City Manager. The right to make such change without notice to the individual consumer is expressly reserved.

For purposes of this Article, the term "resident" shall mean an individual resident of the City, a business having a premises located within the City or a group of individuals consisting of fifty percent (50%) or more City residents. The term "resident team" shall mean a sports team registered with the City's Parks and Recreation Department and

D. DAMAGE DEPOSIT ONE-TIME RENTAL ONGOING RENTAL RESIDENT RATE
Definitions. For purposes of this Section, the following definitions shall apply:
A deposit payable in advance by all renters to be returned upon satisfactory inspection of the room following use. Renters may be liable for additional fees if damage or cleaning fees exceed the damage deposit.
A rental of one (1) or more rooms for a single date or function.
A rental made for a regular weekly, monthly or other type of recurring use.
A person or business with a physical address within the City limit of Olivette.

Two (2) people residing in the same household, both age sixty (60) and above.
Up to two (2) adults and three (3) dependents under age twenty-one (21) living in the same home.
A person or business with a physical address within the City limit of Olivette.
Any person under the age of twenty-one (21) years.

Fees Waived.
1.
Government agency or organization and non-profit partner organizations may reserve Five Oaks on Warson and the City Center Community Rooms at no cost to provide direct service to the residents of Olivette; and
2.
Olivette neighborhood, subdivision and/or trustee associations may reserve Five Oaks on Warson and the City Center Community Rooms at no cost for member meetings not more than two (2) times per calendar year.
B. GOVERNMENT AGENCY OR ORGANIZATION NON-PROFIT PARTNER ORGANIZATION DIRECT SERVICE
Definitions. For purposes of this Section, the following definitions shall apply:
Any permanent or semi-permanent agency or entity of Federal, State, or local government.
A not-for-profit agency in good standing and classified as tax-exempt under Section 501(c)(3) of the Internal Revenue Tax Code, and that operates in tandem with the City of Olivette Parks and Recreation Department in maintaining City property and/or providing programs for City residents.
An educational program or community service open to all Olivette residents at no or low cost.
