The Board of Aldermen hereby adopts the International Building Code, 2012 Edition, as published by the International Code Council, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, Missouri, as the official Building Code of the City of Lake Ozark, Missouri, for regulating and governing the conditions and maintenance of all property, building and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the City of Lake Ozark, Missouri, are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.
B. 
The following sections of the International Building Code, 2012 Edition, are hereby revised:

The Board of Aldermen hereby adopts the International Residential Code, 2012 Edition, including Appendix Chapters G and H, as published by the International Code Council, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, Missouri, be and is hereby adopted as the Residential Code of the City of Lake Ozark, Missouri, for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings (townhouses) not more than three (3) stories in height with separate means of egress as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said International Residential Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.
B.

Section R310.1, Emergency Escape and Rescue Required. Insert "Any den, office, exercise room, library, bonus room, or similar space that has a closet or alcove installed shall be provided with an emergency escape and rescue opening meeting the requirements of this section and Sections R310.1.1 through R310.1.4."

Section R313.1, Townhouse Automatic fire sprinkler systems. Delete "shall be installed in townhouses." and insert: "may be installed in townhouses per Missouri State Law, Section 67.281, RSMo."

Chapter 11, Energy Efficiency. Delete in its entirety and insert Chapter 11, Energy Efficiency, from the 2006 International Residential Code.

Section M1306.1, Appliance clearance. Insert "Section M1306.1.1 Fuel-gas fireplace appliances. The combustible framing containing fuel-gas fireplace inserts shall be protected by five-eighths (5/8) inch Type X gypsum board on the ceiling and walls of the firebox interior. Gypsum joints shall be tight or shall be sealed with tape and joint compound or approved fire caulking. Appliance clearances shall be maintained in accordance with the manufacturer's installation instructions and the appliance label.
15. 
Section 1306.2.1, Solid-fuel appliances. Insert Section M1306.2.1.1 Solid-fuel fireplace appliances. The combustible framing containing solid-fuel fireplace inserts shall be protected by five-eighths (5/8) inch Type X gypsum board on the ceiling and walls of the firebox interior. A shaft shall be constructed around the chimney/flue, shall extend continuously to the roof deck, and shall also be lined with five-eighths (5/8) inch Type X gypsum board. All gypsum joints shall be tight or shall be sealed with tape and joint compound or approved fire caulking. Appliance and flue clearances shall be maintained in accordance with the manufacturer's installation instructions and the appliance label."
16. 
Section 1502.4.2, Duct installation. Delete text in its entirety and insert "Exhaust ducts shall be supported at intervals not to exceed four (4) feet and shall be secured in place. The insert end of the duct shall extend into the adjoining duct or fitting in the direction of airflow. Exhaust ducts shall be sealed in accordance with Section M1601.4.1."
17. 
Section P2603.5.1, Sewer depth. Insert "eighteen (18) inches" in two (2) places.
18.

B. 
The following sections of the International Fire Code, 2012 Edition, are hereby revised:
1. 
Section 101.1, Title. Insert "City of Lake Ozark."
2. 
Section 103.1, General. Wherever "fire code official" appears in this code, it shall be defined as the Building Official of the City of Lake Ozark or his duly authorized representative. In addition to the City of Lake Ozark Building Official's authorized representative, the Lake Ozark Fire Protection District shall qualify and serve as a duly authorized representative.
3. 
Section 105.6, Required operational permits. Delete Sections 105.6.1, 105.6.3, 105.6.5, 105.6.6, through 105.6.12, 105.6.17, 105.6.18, 105.6.19, 105.6.22 through 105.6.29, 105.6.31 through 105.6.33, 105.6.35 through 105.6.38, 105.6.40 through 105.6.42, and 105.6.44 through 105.6.46.
4. 
Section 105.7, Required construction permits. Delete Sections 105.7.2 and 105.7.8.
5. 
Section 109.4, Violation penalties. Applications for burn permits shall only be submitted by and permits issued to the owner of the land upon which the fire is to be kindled."

Section 505.1, Address identification. Delete "Numbers shall be a minimum of four (4) inches (one hundred one and six tenths (101.6) mm) high with a minimum stroke width of one-half (0.5) inch (twelve and seven tenths (12.7) mm)." and insert: "Address numbers shall be sized for residential or commercial premises in accordance with Section 500.070 (E) of the Lake Ozark Municipal Code."

The Board of Aldermen hereby adopts the National Electrical Code, 2011 Edition, as published by National Fire Protection Association, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, Missouri, as the official Electrical Code of Lake Ozark, Missouri, to establish minimum regulations governing the design, installation and construction of electrical systems, to provide reasonable safeguards to protect the public health against the hazards of inadequate or defective electrical installations; and each and all of the regulations, provisions, penalties, conditions and terms of said publication are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.
B. 
The following sections of the National Electrical Code, 2011 Edition, are hereby revised:
1. 
Article 230.70(A)(1), Readily Accessible Location. Delete text in its entirety and insert: "The service disconnecting means shall be installed at a readily accessible location outside of a building or structure. B.

A. 
Any person, whether the owner or agent of a building or premises, where a violation of any provision of this Chapter has been or is being committed or shall exist, or the lessee or tenant of an entire building or entire premises where such violation has been or is being committed or shall exist, or the owner, agent, lessee or tenant of any part of a building or premises in which such violation has been or is being committed or shall exist, or the agent, architect, builder, contractor or any other person who commits, takes part in or assists in any such violation or who maintains any building or premises in which any such violation shall exist, shall be punishable upon conviction by a fine of not less than ten dollars ($10.00) and not more than one hundred dollars ($100.00) for each and every day that such violation continues or exists. However, if the court finds that the offense was willfully committed, then upon conviction the punishment shall be a fine of not less than one hundred dollars ($100.00) and not more than five hundred dollars ($500.00) for each and every day that such violation shall continue or exist, or by imprisonment for ten (10) days for each and every day that such violation shall continue, or by both such fine and imprisonment in the discretion of the court.
B. 
Any person, who having been served with an order or notice from the City to remove or cease any such violations, that fails or refuses to comply with such order or notice within ten (10) days after service thereof or shall continue to violate any provision of the regulations made under the authority of this Chapter in the respect named in such order or notice shall be deemed to have willfully violated such ordinances as referenced in Subsection (A) of this Section, and that person shall be subject to, in addition to the punishment referenced in Subsection (A) of this Section, a mandatory civil penalty of two hundred fifty dollars ($250.00).
