Section 500.010 International Building Code.

A. The Board of Aldermen hereby adopts the International Building Code, 2012 Edition, as published by the International Code Council, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, Missouri, as the official Building Code of the City of Lake Ozark, Missouri, for regulating and governing the conditions and maintenance of all property, building and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the City of Lake Ozark, Missouri, are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.

B. The following sections of the International Building Code, 2012 Edition, are hereby revised:

1. Section 101.1, Title. Insert "City of Lake Ozark."

2. Section 105.2, Work exempt from permit. Delete "Building: 1, 2, and 6."

3. Section 107.1, General. Delete text "where required by the statutes of the jurisdiction in which the project is to be constructed."

4. Section 308.4.1, Five (5) or fewer persons receiving care. Delete text "or shall comply with the International Residential Code provided an automatic sprinkler system is installed in accordance with Section 903.3.1.3 or with Section P2904 of the International Residential Code."

5. Section 1612.3, Establishment of flood hazard areas. Insert "City of Lake Ozark" and "May 18, 2009."

6. Section 3412.2 Applicability. Insert "November 10, 1998."

Section 500.020 International Residential Code.

A. The Board of Aldermen hereby adopts the International Residential Code, 2012 Edition, including Appendix Chapters G and H, as published by the International Code Council, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, Missouri, be and is hereby adopted as the Residential Code of the City of Lake Ozark, Missouri, for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings (townhouses) not more than three (3) stories in height with separate means of egress as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said International Residential Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.

B. The following sections of the International Residential Code, 2012 Edition, are hereby revised:

1. Section R101.1, Title. Insert "City of Lake Ozark."

2. Section R101.2, Scope. Delete "Exceptions 1 and 2."

3. Section R105.2, Work exempt from permit. Delete "Building: 1, 2, and 10."

4. Table R301.2(1), Climatic and Geographic Design Criteria. Insert:

a. Ground Snow Load: twenty (20) psf;

b. Wind Speed: ninety (90) mph;

c. Topographic Effects: No;

d. Seismic Design Category: B;

e. Weathering: Severe;

f. Frost Line Depth: twenty-four (24) inches;

g. Termite: Moderate to Heavy;

h. Winter Design Temp: seven degrees Fahrenheit (7° F.);

i. Ice Barrier Underlayment: None;

j. Flood Hazards: 5/12/2009;

k. Air Freezing Index: six hundred forty-nine (649);

l. Mean Annual Temp: fifty-six and five-tenths degrees Fahrenheit (56.5° F.).

5. Section R302.2, Townhouses. Delete "Exception" and insert: "Exception: A common two-hour fire-resistance-rated wall is permitted for townhouses if such walls do not contain plumbing or mechanical equipment, ducts or vents in the cavity of the common wall. Electrical installations shall be installed in accordance with Chapters 34 through 43. Penetrations of electrical outlet boxes shall be in accordance with Section R302.4."

6. Table R302.6, Dwelling/Garage Separation.

a. Delete "Not less than one-half (1/2) inch gypsum board or equivalent applied to the garage side." and insert: "Not less than five-eighths (5/8) inch Type X gypsum board applied to the garage side."

b. Delete: "Not less than one-half (1/2) inch gypsum board or equivalent." and insert: "Not less than five-eighths (5/8) inch Type X gypsum board or equivalent."

c. Delete: "Not less than one-half (1/2) inch gypsum board or equivalent applied to the interior side of exterior walls that are within this area." and insert: "Not less than five-eighths (5/8) inch Type X gypsum board or equivalent applied to the interior side of exterior walls that are within this area."

7. Section R303.4, Mechanical Ventilation. Delete text in its entirety and insert: "In dwellings of unusually tight construction such as the use of insulated concrete forms or structural insulated panels, the dwelling shall be provided with whole-house ventilation in accordance with Section M1507.3."

8. Section R310.1, Emergency Escape and Rescue Required. Insert "Any den, office, exercise room, library, bonus room, or similar space that has a closet or alcove installed shall be provided with an emergency escape and rescue opening meeting the requirements of this section and Sections R310.1.1 through R310.1.4."

9. Section R313.1, Townhouse Automatic fire sprinkler systems. Delete "shall be installed in townhouses." and insert: "may be installed in townhouses per Missouri State Law, Section 67.281, RSMo."

10. Section R313.2, One- and two-family dwellings automatic fire systems. Delete "shall be installed in one- and two-family dwellings," and insert: "may be installed in one- and two-family dwellings per Missouri State Law, Section 67.281, RSMo."

11. Section R314.3, Location. Insert: "4. In any office, den, library, bonus room, or similar spaces if such rooms or spaces require an emergency escape and rescue opening in accordance with Section R310.1."

12. Section R507.2.3, Deck lateral load connections. Insert: "Exception: Existing decks. The replacement of an existing one-story deck shall not be required to meet the requirements of this section if the ceiling of the first floor or basement is finished."

13. Chapter 11, Energy Efficiency. Delete in its entirety and insert Chapter 11, Energy Efficiency, from the 2006 International Residential Code.

14. Section M1306.1, Appliance clearance. Insert "Section M1306.1.1 Fuel-gas fireplace appliances. The combustible framing containing fuel-gas fireplace inserts shall be protected by five-eighths (5/8) inch Type X gypsum board on the ceiling and walls of the firebox interior. Gypsum joints shall be tight or shall be sealed with tape and joint compound or approved fire caulking. Appliance clearances shall be maintained in accordance with the manufacturer's installation instructions and the appliance label.

15. Section 1306.2.1, Solid-fuel appliances. Insert Section M1306.2.1.1 Solid-fuel fireplace appliances. The combustible framing containing solid-fuel fireplace inserts shall be protected by five-eighths (5/8) inch Type X gypsum board on the ceiling and walls of the firebox interior. A shaft shall be constructed around the chimney/flue, shall extend continuously to the roof deck, and shall also be lined with five-eighths (5/8) inch Type X gypsum board. All gypsum joints shall be tight or shall be sealed with tape and joint compound or approved fire caulking. Appliance and flue clearances shall be maintained in accordance with the manufacturer's installation instructions and the appliance label."

16. Section 1502.4.2, Duct installation. Delete text in its entirety and insert "Exhaust ducts shall be supported at intervals not to exceed four (4) feet and shall be secured in place. The insert end of the duct shall extend into the adjoining duct or fitting in the direction of airflow. Exhaust ducts shall be sealed in accordance with Section M1601.4.1."

17. Section P2603.5.1, Sewer depth. Insert "eighteen (18) inches" in two (2) places.

18. Section E3601.6.2, Service disconnect location. Delete text in its entirety and insert "The service disconnecting means shall be installed at a readily accessible location outside of a building. Each occupant shall have access to the disconnect serving the dwelling unit in which he/she resides."

Section 500.030 International Property Maintenance Code.

The Board of Aldermen hereby adopts the International Property Maintenance Code, 2012 Edition, as published by the International Code Board, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, as the Property Maintenance Code of the City of Lake Ozark, in the State of Missouri, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said International Property Maintenance Code on file in the office of the City of Lake Ozark are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.

B. The following sections of the International Property Maintenance Code, 2012 Edition, are hereby revised:

1. Section 101.1, Title. Insert "City of Lake Ozark."

2. Section 103.5, Fees. Delete in its entirety.

3. Section 112.4, Failure to comply. Delete text: "to a fine of not less than [AMOUNT] dollars or more than [AMOUNT] dollars." and insert: "for fines in accordance with Section 500.090 of the Lake Ozark Municipal Code."

4. Section 302.4, Weeds. Insert "ten (10) inches."

5. Section 304.14, Insect screens. Insert "March 1 to November 1."

6. Section 602.3, Heat supply. Insert "October 1 to May 1."

7. Section 602.4, Occupiable work spaces. Insert: "October 1 to May 1."

Section 500.040 International Fire Code.

A. The Board of Aldermen hereby adopts the International Fire Code, 2012 Edition, as published by the International Code Council, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, as the Fire Code of the City of Lake Ozark, in the State of Missouri, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the City of Lake Ozark are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.

B. The following sections of the International Fire Code, 2012 Edition, are hereby revised:

1. Section 101.1, Title. Insert "City of Lake Ozark."

2. Section 103.1, General. Wherever "fire code official" appears in this code, it shall be defined as the Building Official of the City of Lake Ozark or his duly authorized representative. In addition to the City of Lake Ozark Building Official's authorized representative, the Lake Ozark Fire Protection District shall qualify and serve as a duly authorized representative.

3. Section 105.6, Required operational permits. Delete Sections 105.6.1, 105.6.3, 105.6.5, 105.6.6, through 105.6.12, 105.6.17, 105.6.18, 105.6.19, 105.6.22 through 105.6.29, 105.6.31 through 105.6.33, 105.6.35 through 105.6.38, 105.6.40 through 105.6.42, and 105.6.44 through 105.6.46.

4. Section 105.7, Required construction permits. Delete Sections 105.7.2 and 105.7.8.

5. Section 109.4, Violation penalties. Delete "shall be guilty of [SPECIFY OFFENSE], punishable by a fine of not more than [AMOUNT] dollars or by imprisonment not exceeding [NUMBER OF DAYS], or both such fine and imprisonment." and insert "shall be fined, imprisoned, or both in accordance with Section 500.090 of the Lake Ozark Municipal Code."

6. Section 111.4, Failure to comply. Insert: "one hundred dollars ($100.00)" and "five hundred dollars ($500.00)."

7. Section 307.2, Permit required. Delete text and insert "A burn permit shall be obtained from the Lake Ozark Fire Protection District Fire Marshal prior to kindling a fire for recognized silvicultural or range or wildlife management practices, prevention or control of disease or pests, or a bonfire. Applications for burn permits shall only be submitted by and permits issued to the owner of the land upon which the fire is to be kindled."

8. Section 505.1, Address identification. Delete "Numbers shall be a minimum of four (4) inches (one hundred one and six tenths (101.6) mm) high with a minimum stroke width of one-half (0.5) inch (twelve and seven tenths (12.7) mm)." and insert: "Address numbers shall be sized for residential or commercial premises in accordance with Section 500.070 (E) of the Lake Ozark Municipal Code."

Section 500.050 National Electrical Code.

A. The Board of Aldermen hereby adopts the National Electrical Code, 2011 Edition, as published by National Fire Protection Association, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, Missouri, as the official Electrical Code of Lake Ozark, Missouri, to establish minimum regulations governing the design, installation and construction of electrical systems, to provide reasonable safeguards to protect the public health against the hazards of inadequate or defective electrical installations; and each and all of the regulations, provisions, penalties, conditions and terms of said publication are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.

B. The following sections of the National Electrical Code, 2011 Edition, are hereby revised:

1. Article 230.70(A)(1), Readily Accessible Location. Delete text in its entirety and insert: "The service disconnecting means shall be installed at a readily accessible location outside of a building or structure. Each occupant shall have access to the disconnect serving the building, structure, or space he/she occupies."

Section 500.060 International Plumbing Code.

A. The Board of Aldermen hereby adopts the International Plumbing Code, 2012 Edition, as published by the International Code Council, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, as the Plumbing Code of the City of Lake Ozark, in the State of Missouri, regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Plumbing Code on file in the office of the City of Lake Ozark, Missouri, are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.

B. The following sections of the International Plumbing Code, 2012 Edition, are hereby revised:

1. Section 101.1, Title. Insert "the City of Lake Ozark."

2. Section 106.6.2, Fee schedule. Insert "Permit fees shall be established in accordance with City Code Section 501.030, Permit Fees."

3. Section 106.6.3, Fee refunds. Delete in its entirety.

4. Section 108.4, Violation penalties. Delete "shall be guilty of [SPECIFY OFFENSE], punishable by a fine of not more than [AMOUNT] dollars or by imprisonment not exceeding [NUMBER OF DAYS], or both such fine and imprisonment." and insert "shall be fined, imprisoned, or both in accordance with Section 500.090 of the Lake Ozark Municipal Code."

5. Section 108.5, Stop work orders. Delete: "shall be liable to a fine of not less than [AMOUNT] dollars or more than [AMOUNT] dollars." and insert: "shall be liable for fines as established in Section 500.090 of the Lake Ozark Municipal Code."

6. Section 305.4.1, Sewer depth. Insert "eighteen (18) inches" in two (2) places.

7. Section 903.1, Roof extension. Insert "twelve (12) inches."

Section 500.070 International Fuel Gas Code.

The Board of Aldermen hereby adopts the International Fuel Gas Code, 2012 Edition, as published by the International Code Council, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, as the Fuel Gas Code of the City of Lake Ozark, in the State of Missouri, for regulating and governing fuel gas systems and gas-fired appliances as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fuel Gas Code on file in the office of the City of Lake Ozark are herby referred to, adopted, and made a part hereof, as if fully set out in this Section.

B. The following sections of the International Fuel Gas Code, 2012 Edition, are hereby revised:

1. Section 101.1, Title. Insert "the City of Lake Ozark."

2. Section 106.6.2, Fee schedule. Insert "Permit fees shall be established in accordance with City Code Section 501.030, Permit Fees."

The Board of Aldermen hereby adopts the International Mechanical Code, 2012 Edition, as published by the International Code Council, Inc., a copy of which is on file in the office of the City Clerk of the City of Lake Ozark, as the Mechanical Code of the City of Lake Ozark, in the State of Missouri, for regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Mechanical Code, 2012 Edition, on file in the office of the City of Lake Ozark, Missouri, are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.

B. The following sections of the International Mechanical Code, 2012 Edition, are hereby revised:

1. Section 101.1, Title. Insert "the City of Lake Ozark."

2. Section 106.5.2, Fee schedule. Insert "Permit fees shall be established in accordance with City Code Section 501.030, Permit Fees."

3. Section 106.5.3, Fee refunds. Delete in its entirety.

4. Section 108.4, Violation Penalties. Delete "shall be guilty of [SPECIFY OFFENSE], punishable by a fine of not more than [AMOUNT] dollars or by imprisonment not exceeding [NUMBER OF DAYS], or both such fine and imprisonment." and insert "shall be fined, imprisoned, or both in accordance with Section 500.090 of the Lake Ozark Municipal Code."

5. Section 108.5, Stop work orders. Delete "shall be liable to a fine of not less than [AMOUNT] dollars or more than [AMOUNT] dollars." and insert "shall be liable for fines as established in Section 500.090 of the Lake Ozark Municipal Code."

Section 500.090 Penalty.

[R.O. 1994 § 515.065; Ord. No. 2013-37, 11-26-2013]

A. Any person, whether the owner or agent of a building or premises, where a violation of any provision of this Chapter has been or is being committed or shall exist, or the lessee or tenant of an entire building or entire premises where such violation has been or is being committed or shall exist, or the owner, agent, lessee or tenant of any part of a building or premises in which such violation has been or is being committed or shall exist, or the agent, architect, builder, contractor or any other person who commits, takes part in or assists in any such violation or who maintains any building or premises in which any such violation shall exist, shall be punishable upon conviction by a fine of not less than ten dollars ($10.00) and not more than one hundred dollars ($100.00) for each and every day that such violation continues or exists. However, if the court finds that the offense was willfully committed, then upon conviction the punishment shall be a fine of not less than one hundred dollars ($100.00) and not more than five hundred dollars ($500.00) for each and every day that such violation shall continue or exist, or by imprisonment for ten (10) days for each and every day that such violation shall continue, or by both such fine and imprisonment in the discretion of the court.

B. Any person, who having been served with an order or notice from the City to remove or cease any such violations, that fails or refuses to comply with such order or notice within ten (10) days after service thereof or shall continue to violate any provision of the regulations made under the authority of this Chapter in the respect named in such order or notice shall be deemed to have willfully violated such ordinances as referenced in Subsection (A) of this Section, and that person shall be subject to, in addition to the punishment referenced in Subsection (A) of this Section, a mandatory civil penalty of two hundred fifty dollars ($250.00).
