1. The Planning Commission of East Fallowfield is hereby reconstituted and its creation in 1959 is reaffirmed. It shall have seven members and it shall have all of the powers, duties, and authority as provided in §
1-202.
2. Prior Acts. All acts of the existing Planning Commission done heretofore
are hereby expressly approved, ratified, and confirmed in all respects.

1. The Planning Commission shall, at the request of the Board of Supervisors,
have the power to undertake the following tasks with Board assent:
A. Prepare the comprehensive plan for the development of the Township
as set forth in the Pennsylvania Municipalities Planning Code, 53
P.S. § 10101 et seq., and present it for the consideration
of the Board of Supervisors.
B. Maintain and keep on file records of its action. All records and
files of the Planning Commission shall be in the possession of the
Board of Supervisors.
2. The Planning Commission at the request of the Board of Supervisors
may:
A. Make recommendations to the Board of Supervisors concerning the adoption
or amendment of an Official Map.
B. Prepare and present to the Board of Supervisors a zoning ordinance,
and make recommendations to the Board of Supervisors on proposed amendments
to it, as set forth in the Pennsylvania Municipalities Planning Code,
53 P.S. § 10101 et seq.
C. Prepare, recommend, and administer subdivision and land development
and planned residential development regulations, as set forth in the
Pennsylvania Municipalities Planning Code, 53 P.S. § 10101
et seq.
D. Prepare and present to the Board of Supervisors a building code and
make recommendations concerning proposed amendments thereto.
E. Do such other acts or make such studies as may be necessary to fulfill
the duties and obligations imposed by the Pennsylvania Municipalities
Planning Code, 53 P.S. § 10101 et seq.
F. Prepare and present to the Board of Supervisors an environmental
study.
G. Submit to the Board of Supervisors a recommended capital improvements
program.
H. Prepare and present to the Board of Supervisors a water survey, which
shall be consistent with the State Water Plan and any applicable water
resources plan adopted by a river basin commission. The water survey
shall be conducted in consultation with any public water supplier
in the area to be surveyed.
I. Promote public interest in, and understanding of, the comprehensive
plan and planning.
J. Make recommendations to governmental, civic, and private agencies
and individuals as to the effectiveness of the proposals of such agencies
and individuals.
K. Hold public hearings and meetings.
L. Present testimony before any board.
M. Require from other departments and agencies of the municipality such
available information as relates to the work of the Planning Commission.
N. In the performance of its functions, enter upon any land to make
examinations and surveys with the consent of the owner.
O. Prepare and present to the governing body of the municipality a study
regarding the feasibility and practicability of using renewable energy
sources in specific areas within the municipality.
P. Review the zoning ordinance, subdivision and land development ordinance,
Official Map, provisions for planned residential development, and
such other ordinances and regulations governing the development of
land no less frequently than it reviews the comprehensive plan.

1. The Board of Supervisors may appoint by resolution at least one but
no more than three residents of the Township to serve as alternate
members of the Planning Commission.
2. The term of office of an alternate member shall be four years.
3. The Chairman of the Planning Commission may designate an alternate
member or members to participate in a Planning Commission meeting
in the event that any other member of the Planning Commission is absent,
recused, abstained or disqualified. In such circumstances, the alternate
shall be entitled to participate in the meeting to the same and full
extent as provided by law as any other Planning Commission member,
including specifically the right to cast a vote as a voting member
on recommendations to the Board of Supervisors.
4. Alternates shall not serve as a member of the Zoning Hearing Board,
as Zoning Officer or any other incompatible office by law.

There is hereby created a Park and Recreation Board, the existence
of which is authorized by the Second Class Township Code, 53 P.S.
§ 67204.

The Park and Recreation Board shall consist of five or seven
persons, to be appointed by the Board of Supervisors. The terms of
office of each member of the Park and Recreation Board will be for
a five-year term, except that such members as are initially appointed
shall serve a term of a length so that not more than two members'
terms expire annually. Members will serve without pay, but may be
reimbursed by the Township for all expenses incurred in performing
their duties. All persons appointed shall serve their full terms,
except in the event of a voluntary resignation or removal by the Board
of Supervisors for dereliction or neglect of duty. Vacancies occurring
other than by expiration of a term of office shall be for the unexpired
term and shall be filled in the same manner as original appointments
by the Board of Supervisors of East Fallowfield Township.

The members of the Park and Recreation Board shall elect a chairman
and a secretary, and may select such other officers as considered
necessary to discharge the responsibilities of the Park and Recreation
Board. The selection and service in the position of a chairman, secretary,
or other office shall be for a period of one year, provided that any
individual may succeed themselves in the capacity of any given office,
if selected by majority vote of a quorum of the membership of the
Park and Recreation Board. The Park and Recreation Board may adopt
such rules and regulations for the conduct of its business, within
its jurisdiction, and exercise such powers and functions concerning
parks and recreation facilities as may be delegated to it by the Board
of Supervisors, through the adoption of an ordinance or resolution.
Certain responsibilities and authorizations are described in this
Part. Additional responsibilities and authorizations may be conferred
through the subsequent adoption of resolutions by the Board of Supervisors
of East Fallowfield Township. Certain ministerial or administrative
responsibilities and authorizations may be conferred by the member
of the Board of Supervisors serving as liaison to the Park and Recreation
Board.

The Park and Recreation Board will develop and recommend for
adoption by the Board of Supervisors, policies, rules, and regulations
pertaining to the supervision, regulation, equipment procurement,
and maintenance of Township-funded recreation programs and facilities.

The Park and Recreation Board shall submit written recommendations
for the adoption of ordinances regulating the use and enjoyment by
the public of any park or recreation grounds owned and operated by
East Fallowfield Township, or any park or open space the use of which
is made open to the public under the terms of any conditional use
order or subdivision or land development application approval, or
any land owned by any charitable organization which is made available
for the use by the public, and any facilities and amusements connected
therewith, as well as posting of rules at conspicuous places in any
such parks or recreation grounds, as authorized by § 2203
of the Second Class Township Code, 53 P.S. § 67203.

The Park and Recreation Board shall prepare written recommendations for the adoption of an ordinance to be included in the Township Subdivision and Land Development Ordinance [Chapter
22] in order to implement and exercise the authorizations set forth in § 503(11) of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10503(11), relating generally to public dedication of land suitable for recreational uses, the payment of fees in lieu thereof, the private reservation of land for park or recreational purposes, and the administration of funds received in lieu of the dedication of land through the course of the approval of a subdivision or land development application.

The Park and Recreation Department will develop written recommendations
for the adoption of a recreation plan by the Board of Supervisors,
as contemplated by the Pennsylvania Municipalities Planning Code,
§ 503(11)(iv), 53 P.S. § 10503(11)(iv).

The Park and Recreation Board will develop written recommendations
for adoption by the Board of Supervisors of an Open Space Plan or
such other formal growth and development plan including, but not limited
to, amendments to the Township Comprehensive Plan, as may be necessary
for East Fallowfield Township to obtain eligibility for land acquisition,
recreational, or other funding or grants as may be available from
the County of Chester, the Commonwealth of Pennsylvania, the United
States of America, and/or any agency or instrumentality thereof, as
well as any private benefactor who/which may disburse funds for the
purpose of securing parkland, recreational equipment for other forms
of reimbursement for recreation-related activities and facilities.

The Park and Recreation Board shall submit an annual report
to the Board of Supervisors, including an analysis of the adequacy
and effectiveness of the community recreation areas, facilities, and
leadership, as contemplated by § 2204 of the Second Class
Township Code 53 P.S. § 67204.

Residents of East Fallowfield Township who have attained the
age of 18 qualify as members of the Park and Recreation Board. The
selection and appointment to membership in the Park and Recreation
Board, and the designated initial terms to be served, shall be at
the discretion of the Board of Supervisors. The formation of the Parks
and Recreation Board shall be publicly announced at a meeting at which
this Part is adopted, and through publication in the East Fallowfield
Township Newsletter, through which interested persons may submit brief
written applications to serve as members of Park and Recreation Board.
