A local law to establish the residency requirements for the appointed offices of Code Enforcement Officer, Building Inspector and Deputy Town Clerk.
This article is adopted pursuant to New York State Municipal Home Rule Law § 10, Subdivision 1(ii)(a)[1], that grants to local governments the authority to enact local laws regarding the qualifications of local officers.
This article shall supersede New York State Town Law § 23(1) in its application to the appointed offices of Code Enforcement Officer, Building Inspector and Deputy Town Clerk for the Town of Walton.
The persons holding the offices of Code Enforcement Officer, Building Inspector and Deputy Town Clerk for the Town of Walton need not be residents or electors of the Town of Walton; provided, however, that such persons shall reside in Delaware County or in an adjoining county in New York State.

This article is adopted pursuant to the authority of Article 2 of the Municipal Home Rule Law and shall be known as the "Waiver of Residency Requirement for Town Attorney."
This article is intended to eliminate the requirement that the Town Attorney be a resident of the Town of Walton.
Notwithstanding any law, statute, rule or regulation to the contrary and pursuant to the powers invested by Article 2 of the Municipal Home Rule Law, the Town Attorney of the Town of Walton need not be a resident of said town.
This article shall take effect immediately upon filing with the New York State Secretary of State.
