The following-enumerated list is a list of examples of uses that are prohibited in each and every zone in the Borough of Upper Saddle River. The following list of such examples of prohibited uses is not intended to make any use not listed a permitted use. The list is to provide examples of the types of prohibited uses and is not intended to limit the types of uses that are prohibited. In each zone in this chapter there is a list of uses permitted within the zone with the express intention that all other uses not listed as a permitted use for the zone are prohibited. It is not intended that the following list of examples of prohibited uses shall furnish any indication whatsoever that a use is not prohibited unless listed herein as a prohibited use:
Acetylene gas manufacture
Ammonia, chlorine or bleaching powder manufacture
Animal black, lampblack or bone black manufacture
Asphalt manufacturing or refining
Automobile junkyard, dump or any other establishment for the storage, reduction or deposit of junk or other waste materials of any kind
Blast furnace
Boiler works
Brick pottery, tile or terra-cotta manufacture
Celluloid for film manufacture, extraction of products therefrom
Cement and cinder block manufacture
Coke ovens
Creosote treatment or manufacture
Crematory
Disinfectant, insecticide or poison manufacture
Distillation of coal, petroleum, refuse, grain, wood or bone
Dye manufacture; laundry other than hand laundry; cleaning and dyeing establishment, provided that this shall not apply to a dry-cleaning store in which the work is done off premises
Emery cloth and sandpaper manufacture
Explosives, manufacture or storage of
Fertilizer manufacture
Manufacture or storage of fireworks or matches, arms, ammunition
Forge plant
Gas storage, except as an incident to a permitted use in a business or industrial zone
Glue, size or gelatin manufacture where the processes include the refining and recovering of products from fish, animal, refuse or offal
Grease, lard, fat or tallow rendering or refining
Grain drying or food manufacture from refuse, mash or grain
Incineration reduction, storage or dumping of slaughterhouse refuse; rancid fats, garbage, dead animals or offal, except by the municipality or its agents
Iron, steel, brass or copper foundry
Lime, cement, plaster of paris or potash manufacture
Motel
Oilcloth, linoleum or cork insulation manufacture
Paint, oil, varnish, turpentine, shellac, enamel or solvents manufacture
Paper pulp manufacture
Petroleum refining
Petroleum storage except as an accessory use to a permitted service station or filling station
Power forging, riveting, hammering, punching, chipping, drawing, rolling or tumbling of metals except as a necessary incident of manufacture of which these processes form a minor part and which are carried on without objectionable noise audible beyond the limits of the lot
Printing ink manufacture
Pyroxylin plastic storage and manufacture or the manufacture of articles therefrom
Quarry, sandpit, gravel pit, topsoil stripping
Rawhides or skins: storage, cleaning, curing or tanning
Rock and stone crusher
Rubber latex or gutta-percha manufacture or treatment
Shoeblackening or stove polish manufacture
Slaughtering of animals
Smelting
Soap manufacture
Starch, glucose or dextrose manufacture
Steel furnace, blooming or rolling mill
Stockyards
Storage or display of any goods or materials except in a building enclosed on all sides
Structural steel or pipe works
Sugar refining
Sulfurous, sulfuric, acetic, nitric, picric, carbolic or hydrochloric acid manufacturing
Tar distillation or manufacture
Tar roofing manufacturing
Tobacco manufacture or treatment
Trailer camp or mobile home establishment
New or used car motor vehicle sales or rental establishment of any kind
Wool pulling or scouring
Yeast plant
Trucking terminals or depots
Any other use from which there is any emission of odor, dust, smoke, gas, toxic materials, noise or glare beyond the boundaries of the lot on which such use is located or which by reason of vibration or any other characteristic is noxious or offensive or would tend to impair or hinder the most appropriate use of land in the vicinity in accordance with the comprehensive plan of land use set forth in this chapter or any other ordinance
Miniwarehouses or other compartmented storage facilities

A. 
In every zoning district referred to in § 150-6 of this chapter, no land or building shall be used or allowed to be used for the sale or distribution of marijuana, which includes retail and wholesale marijuana stores, retail and wholesale marijuana cultivation facilities, retail and wholesale marijuana products manufacturing facilities, retail and wholesale marijuana testing facilities, and the operation of retail and wholesale marijuana social clubs. All activities related to the abovementioned retail and wholesale uses, such as, but not limited to, cultivation, possession, extraction, manufacturing, processing, storing, laboratory testing, labeling, transporting, delivering, dispensing, transferring and distributing, are expressly prohibited within the Borough. In addition, the sale of vaping products shall be prohibited, and the sale of vaping devices known as "JUUL®" and "JUUL® Pods" shall also be prohibited. The foregoing shall not be construed to limit any privileges or rights of a qualifying patient, primary caregiver, registered or otherwise, or registered dispensary pursuant to the New Jersey Compassionate Use Medical Marijuana Act, N.J.S.A. 24:6I-1.
B. 
Violations and penalties. The maximum penalty for violation of any provision of this section shall, upon conviction, be a fine not exceeding $2,000 or imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, at the discretion of the Municipal Court Judge.
