As used in this chapter, the following terms shall have the meanings indicated:
MIGRATORY WATERFOWL
Includes those species of birds commonly known as "swans," "geese" and "ducks" and any other waterfowl falling under the jurisdiction of the United States Fish and Wildlife Service.
It shall be unlawful for any person to feed any migratory waterfowl on public property in the Borough of Upper Saddle River.
This chapter shall be enforced by the Health Officer and the Police Department of the Borough of Upper Saddle River.
Any person who is guilty of feeding migratory waterfowl shall be punished by a fine not to exceed $10 for the first offense and $25 for the second and subsequent offenses. The Municipal Judge, in his discretion, may impose community service not to exceed two hours for the first offense and up to five hours of community service for the second and subsequent offense.
