Except under emergency conditions, defined as unforeseen events
that prevent safe travel or effective emergency access, no forestry,
repair, maintenance, reconstruction or paving work done with respect
thereto shall involve or include the cutting or removal of trees,
or the tearing down or destruction of stone walls, or portions thereof,
within the layout of a Scenic Road except with prior written consent
of the Planning Board after a public hearing held in accordance with
MGL c. 40, § 15C. In addition to the notice requirements
of the statute, notice of the public hearing shall be sent no less
than 14 days prior to the hearing by first class mail to abutters
within 300 feet of the site of the work, as determined by current
Assessors' records.
