As used in this chapter, the words listed below shall have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
DIRECTOR
The Parks and Recreation Director.
FIRE CHIEF
The Ogunquit Fire Chief.
POLICE CHIEF
The Ogunquit Police Chief.
PUBLIC PROPERTY
Includes but is not limited to parks, the Ogunquit Beach, Marginal Way, and other areas under public control or ownership.
TOWN or OGUNQUIT
The Town of Ogunquit.
VEHICLE
Any wheeled conveyance, whether motor-powered, animal-drawn, or self-propelled. The term shall include, but not be limited to, any trailer in tow, automobile, truck, wagon, snowmobile, motorbike, moped, motorcycle, or trail bike of any size, kind, or description. Exception is made for baby carriages, wheelchairs, bicycles, rescue equipment, and vehicles used in the maintenance and operation of public property.
Except as may be necessitated by construction or maintenance activities, no person shall:
A. 
Disfigure property. Disfigure and remove buildings and other property, including any act to willfully mark, deface, disfigure, injure, tamper with, or displace or remove any building, bridge, table, bench, railing, paving, or paving material, water lines or other public utilities or parts or appurtenances thereof, signs, signal devices, notices or placards, whether temporary or permanent, monuments, stakes, posts, or other boundary markers, or other structures or equipment, playground equipment, or other public property.
B. 
Remove natural resources. Including any act to dig or remove any sand, soil, rock, stones, trees, shrubs or plants, timber or other wood or materials, or any excavation by tool, equipment, blasting or other means or agency, except where authorized by the Town Manager.
C. 
Erect structures or buildings of any kind, whether permanent or temporary in character, or run or string any public service utility into, upon, or across such property except where authorized.
D. 
Injure vegetation. Including any act to damage, cut, carve, transplant, or remove any tree or plant or injure the bark, or pick the flowers or seeds, of any tree or plant; nor shall any person attach a rope, wire, or other contrivance to any tree or plant. A person shall not dig in or otherwise disturb grass areas, such as walking on grass or vegetated areas where public walkways are provided, or in any other way injure or impair the natural beauty or usefulness of any area.
E. 
Climb on structures. Including any act to stand or sit upon monuments, vases, fountains, railings, fences, or upon any other property not designated or customarily used for such purposes.
No person shall:
A. 
Pollute waters. Including any act to throw, discharge or otherwise place or cause to be placed in the waters of any fountain, pool, pond, stream, or other body of water in or adjacent to any public property or any tributary, stream, storm sewer, or drain flowing into such waters any substance, manner or thing, liquid or solid, which will or may result in the pollution of said waters.
B. 
Deposit refuse. Have brought in or shall dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or refuse, or other trash on public property. No such refuse or trash shall be placed in the waters in or contiguous to any public property or highways, or left anywhere on the grounds thereof, but it shall be placed in the proper receptacles where these are provided. Where receptacles are not so provided, all such rubbish or waste shall be carried away by the person responsible for such presence, and properly disposed of elsewhere.
C. 
Deposit excrement. Urinate or defecate anywhere on public property except at public facilities provided for that purpose.
A person shall:
A. 
Obey state motor vehicle laws. Comply with all applicable provisions of the Maine Motor Vehicle Laws with regard to equipment and operation of vehicles together with such regulations as are contained in this chapter and other Ogunquit ordinances. Operation of vehicles shall occur on public ways and paved roads only.
B. 
Obey traffic signs. Observe carefully all traffic signs and pavement markings indicating speed, direction, caution, stopping, or parking, and all other signs posted for proper control and to safeguard life and property. A person shall park only at established or designated parking areas, in accordance with posted directions and/or instructions of any attendant who may be present.
C. 
Bicycles. Ride a bicycle on a paved vehicle road or path designated for that purpose. A bicyclist shall be permitted to wheel or push a bicycle by hand over any grassy area or wooded trail or any paved area reserved for pedestrian use.
A. 
Bathing and swimming. No person shall swim, bathe, or wade in the waters of any fountain, pond, pool, stream, ocean, or other body of water in or adjacent to any public area or any tributary, stream, storm sewer, or drain flowing into such waters, except in such waters and in such places as are specifically provided for swimming or bathing purposes, and in compliance with such regulations as are herein set forth; nor shall any person frequent any waters or places customarily designated for the purposes of swimming or bathing, or congregate thereat in such activities prohibited by this chapter upon finding such use of the water would be dangerous or otherwise inadvisable. A person shall at all times bathe or swim at his or her own risk, whether or not the bathing or swimming is supervised.
B. 
Ice-skating. A person shall ice skate only at designated areas. Where ice-skating is permitted, a person shall ice skate at his or her own risk. No person shall ice skate when ice-skating is unsafe, as indicated by appropriate signs.
C. 
Hunting and firearms. It shall be unlawful for any person, not being a guard or law enforcement official under the laws of the State of Maine, to discharge a firearm within the Town of Ogunquit with the following exceptions:
(1) 
Hunting of wild animals and wild birds is permitted during the legal open hunting season, except that such hunting shall be limited to the use of a shotgun or long bow and arrow within that portion of Town east of the Maine Turnpike (US Route 95), north of the Josias River and south of the Ogunquit River; or at a target range, or in lawful self-defense, or while saluting with blank charges.
(2) 
The use of "air rifles," "air pistols," "pellet guns" or "BB guns," so-called, is prohibited within the Town of Ogunquit except in such places provided on private property or by some organization in the Town.

D. 
Camping. No person shall set up tents, shacks, or other temporary shelter for the purpose of overnight camping, nor shall any person leave in a public area any movable structures or special vehicles that could be used for such purposes such as a house trailer, camp trailer, tent or the like.
A. 
Public decency. No person shall uncover or expose his or her genitals, pubic hair, perineum, anus, or buttocks, or uncover or expose any portion of the female breasts at or below the areola.
B. 
Fires.
(1) 
No person shall build or attempt to build a fire, except at such areas and under such regulations as may be designated by the Select Board, pursuant to local and state fire laws and ordinances.
(2) 
The Ogunquit Fire Chief shall issue any fire permits that are required by state fire laws or Town ordinances. No person shall drop, throw, or otherwise scatter lighted matches, burning cigarettes or cigars, tobacco or other inflammable material within public property or on any highway, road or street.
C. 
Closed areas. No person shall enter an area posted as "closed to the public," nor shall any person use or let the use of any area in violation of posted notices.
D. 
Obstructing passage.
(1) 
No person shall loiter, loaf, wander, stand or remain idle either alone and/or in consort with others in a public place within the Town in such a manner so as to:
(a) 
Obstruct any public street, public highway, public sidewalk or any other public place or building by hindering or impeding or tending to impede the free and uninterrupted passage of vehicles, traffic or pedestrians.
(b) 
Commit in or upon any public street, public highway, public sidewalk or any other public place or building any act or thing which is an obstruction or interference to the free and uninterrupted use of property by anyone in or upon or facing or fronting on any such public street, public highway, public sidewalk or any other public building, all of which prevents the free and uninterrupted ingress, egress, and regress therein, thereon, and thereto.
(2) 
When any person causes or commits any of the conditions enumerated herein, a police officer or any law enforcement officer shall order that person to stop causing or committing such conditions and to move on or disperse. Any person who fails or refuses to obey such orders shall be guilty of a violation of this chapter.
E. 
Throwing objects. No person shall throw stones or other missiles on any public property or street in Ogunquit.
F. 
Playing games. No person shall play a game or participate in any like activity in which a ball, Frisbee®, or other similar object is used, on U.S. Route 1, Beach Street, Shore Road, River Road, Hoyt's Lane or Berwick Road, and no such object, activity or game shall, otherwise or elsewhere, interfere with the orderly flow of vehicular and pedestrian traffic.

No person shall announce, advertise, or call the public attention in any way to any article or service for sale or hire while on public property except where authorized by the Town Manager. No person shall place circulars or other printed matter on vehicles anywhere in Ogunquit.
No person shall paste, glue, tack or otherwise post any sign, placard, advertisement, or inscription whatever, nor shall any person erect or cause to be erected any sign whatever, on any Town-owned lands or highways or roads. Exception from the prohibitions of this section is made for the posting of such notices as may be required by this chapter, or those notices having been approved by the Town Manager. Exception to these prohibitions shall also include those commercial vehicles having advertisement permanently affixed to them and which are parked while the driver and/or passengers participate in any functions or properly utilize public facilities.
A. 
The restrictions contained in §§ 147-10 and 147-11 shall not apply to newsracks, which may be placed on the inside edge of the public sidewalks in Ogunquit, provided they do not impede the safe passage of pedestrians. Newsracks may not be placed within 10 feet of any marked crosswalk, fire hydrant, driveway entrance or handicap ramp. Newsracks may not be chained, bolted or otherwise attached to any fixture located in the public right-of-way, except to other newsracks. Newsracks may not be placed within 100 feet of any other newsrack on the same side of the street containing the same issue or edition of the same publication. A "newsrack" shall be defined as any container which is used to dispense newspapers and/or magazines. It shall be the responsibility of the owner or distributor of the newsrack to maintain it in good repair and in accordance with this section. No newsrack may be placed in Ogunquit without the owner or distributor (or agent thereof) first obtaining a permit from the Town Manager.
B. 
The Town Manager shall issue a permit for any newsrack which will be placed in conformance with this section, provided that the application for the newsrack describes it, specifies the location or locations involved, contains an agreement to indemnify and hold harmless the Town and its officers and employees for any loss, liability or damage, including expenses and costs for bodily or personal injury, and contains the name and address of the person responsible for it. Whenever a newsrack is found to be in disrepair or in violation of this section, notice of same shall be provided to the owner or distributor (or agent thereof) of the newsrack. Failure to take corrective action within five business days may result in the newsrack being removed by the Town Manager. In addition, the Town Manager may remove any newsrack that creates a public danger. Permits granted under this section shall be issued for a twelve-month period. Anyone aggrieved by the decision or action of the Town Manager may appeal that decision or action to the Select Board.
