The purpose of this article is to establish regulations and
standards controlling the development of land in specified areas of
the Township with provisions for the development of low- and moderate-income
housing units in accordance with the provisions set forth below and
in accordance with the New Jersey Fair Housing Act, N.J.S.A. 52:27D-301
et seq., and the regulations of the Council on Affordable Housing
("COAH") for the second round, set forth at N.J.A.C. 5:93.
Permitted principal uses are as follows:
A. Townhouses as permitted and regulated in the Schedule of Zoning Requirements
and as hereinafter regulated.
B. Multifamily dwellings as permitted and regulated in the Schedule
of Zoning Requirements and as hereinafter regulated.
Permitted accessory uses are as follows:
A. Private garages and surface parking areas.
B. Buildings for storage and maintenance equipment.
C. Off-street parking as hereinafter regulated.
D. Signs in accordance with the requirements of §
165-109.
E. Private recreation buildings and facilities, primarily intended for
use by residents of the development. Recreation facilities may be
located within residential buildings.
F. Community center/room serving the residents of the development.
G. Gazebos, pergolas and similar outdoor landscape structures.
H. Uses which are customarily incidental to the principal permitted
uses in the zone, including, but not limited to, leasing, management
and maintenance offices.
The following zone standards shall apply to development in the
AH-6 Affordable Housing District (the "AH-6 zone"). Deviations from
the requirements of this section shall require a conditional use variance
pursuant to N.J.S.A. 40:55D-70d(3).
A. The development of the property situated in the AH-6 zone shall be
substantially similar to the conceptual site plan prepared for the
site by E&LP, dated April 17, 2018.
B. Maximum density: 140 dwelling units, inclusive of the single-family
home existing on the property at the time of adoption of this article.
C. Minimum affordable housing component: 20% but not less than 28 of
the dwelling units shall be made affordable to low- and moderate-income
households in accordance with the Uniform Housing Affordability Controls,
N.J.A.C. 5:80-26.1 et seq. Dwelling units may be included as either
townhouse or multifamily units.
D. Maximum number of units per townhouse building: eight dwelling units,
provided that not more than 50% of townhouse buildings shall contain
more than six townhouse units.
E. Maximum number of units per multifamily building: 36 dwelling units.
F. Minimum tract area: 13 acres.
G. Minimum lot depth: 1,000 feet.
H. Minimum lot width: 450 feet.
I. Minimum setbacks from principal building walls shall be as follows:
50 feet from all property boundary lines. Unenclosed decks, porches
and patios shall be permitted to be attached to any townhome unit,
provided such structure shall not extend greater than 10 feet from
the principal building wall to which it is attached, and provided
further that in the event a deck shall be proposed for units backing
to the Town of Clinton property line, the actual setback from property
boundary line to the main building structure shall be 50 feet. Cantilevered
projections such as bay windows and fireplace chimneys shall be allowed
to extend no more than two feet into a setback.
J. Minimum building setback from internal roads: 20 feet.
K. Minimum distance between building walls and attached structures,
including decks: 30 feet.
L. Minimum distance between building walls and parking areas: 10 feet.
M. Maximum building coverage: 25% of the gross lot area.
N. Maximum impervious coverage: 75% of the gross tract area.
O. Maximum building height for townhouses. No building shall exceed
a height of 2 1/2 stories or 40 feet. Stories shall not include
basements or cellars.
P. Maximum building height for multifamily buildings. Multifamily buildings
shall have a maximum building height of three stories and 45 feet
not to exceed 60% of the building with the remainder of the building
limited to a maximum height of three stories and 40 feet. Three-story
buildings shall include a sloped or variable roofline, the ridgeline
of which may not exceed an uninterrupted length of 50 feet. Stories
shall not include basements or cellars.
Q. Accessory buildings. All accessory buildings shall comply with §
165-97, Accessory buildings and structures, except that gazebos and other garden furniture may be located no closer than 10 feet to tract boundary lines.
Active and passive recreational amenities are required, including
a playground and central green open space as well as other outdoor
recreation opportunities. The requirement to provide active and passive
recreational amenities is a condition of the uses permitted in the
AH-6 District, and deviations from this requirement shall require
a conditional use variance pursuant to N.J.S.A. 40:55D-70d(3).
