The following terms shall have the meanings indicated:
BOROUGH
Shall refer to the Borough of Huntingdon.
YARD SALE
Any public sale of goods on residential property, including, but not limited to, the residential properties, porches, garage, home, lawn or yard.

Any and all goods that were to be or have been displayed for sale or other disposition at any yard sale shall be removed from any area open to public view on the property on which the yard sale took place and/or was to take place within 24 hours of cessation of the sale. The covering of goods with tarps, blankets, plastic coverings (or anything of like material) shall not be deemed as removed from public view.
2. 
No sign or other display advertising the sale shall be placed on the public right-of-way. No lighted or illuminated signs shall be used. No signs shall be permitted that are pasted, stapled, nailed or otherwise temporarily attached to public utility poles, street signs or trees within the right-of-way of any Borough street.

Any person who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of $50 and prosecution costs for the first offense; $100 plus prosecution costs for the second offense; $300 for the third offense and any offense thereafter.

The Huntingdon Borough Code Enforcement Officer and/or Huntingdon Borough Police Department shall administer the provisions of this Part and any violation of this Part shall be prosecuted by the Huntingdon Borough Code Enforcement Officer and/or the Huntingdon Borough Police Department.

If any sentence, clause, phrase or section of this Part is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, phrases, sections or parts of this Part. It is hereby declared as the intention of the Borough Council that this Part would have been adopted had such unconstitutional, illegal or invalid sentence, clause, phrase, section or part thereof not been included therein.
