The County Clerk is authorized to impose a convenience fee of $2 on all documents filed through the DSMS portal and paid by a credit card, debit card, or electronic funds transaction as authorized pursuant to N.J.S.A. 40A:5-43 et seq., and N.J.A.C. 5:30-9.
The convenience fee shall be listed separately on an invoice or receipt provided to the submitter.
The County Finance Officer shall work with the County Clerk to implement internal controls consistent with N.J.A.C. 5:30-9.5.
The fees collected under this procedure shall be deposited into a dedicated trust fund and shall be used to pay the costs of the DSMS portal and for the technology needed to access and transact on the portal. The use of the dedicated trust fund is subject to the approval of the Division of Local Government Services, which shall be separately requested.
The Board of County Commissioners does hereby request permission of the Director of the Division of Local Government Services to pay expenditures for the electronic receipt fees authorized by N.J.A.C. 5:30-9.
The Clerk of the Board of County Commissioners of Atlantic County is hereby directed to forward two certified copies of this article to the Director of the Division of Local Government Services.
A. 
This article is to be liberally construed to effectuate its purposes.
B. 
If any section, subsection, paragraph, sentence, clause, phrase, or word contained in this article shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this article which shall remain in full force and effect.
Any article or portion thereof enacted by the County that contains any subject matter governed by this article, which is inconsistent with or which stands as an obstacle to the effective implementation of this article shall be superseded by this article and is hereby repealed and set aside.
