The Village of Woodridge hereby establishes the positions of
Village Constables, members of which shall be authorized to act in
the capacity of uniformed Court Officers and Traffic Control Officers.
Village Constables shall have the powers and the responsibilities
consistent and generally associated with Traffic Control and Court
Officers in the State of New York, including but not necessarily limited
to:
A. Attending sessions of the Village Court to maintain order and decorum
in the courtroom.
B. Calming disruptive individuals.
C. Barring entry into secure areas in and about the courtroom.
D. Addressing and attending to disruptive prisoners, litigants and spectators
involved in court proceedings.
E. Escorting, and delivering jurors, witnesses and other participants
of court proceedings to and from the courtroom.
F. Escorting, guarding and delivering the Judge and/or Clerk to and
from the courtroom, as may be required.
G. Delivering materials to sequestered jurors.
H. Escorting court clerks with bank deposits to and from court offices
and the courthouse to the bank.
I. Using the established search procedures and equipment to assure that
no weapons, contraband or other prohibited items or materials are
brought into the courthouse or courtroom.
J. Assisting police officers in the Village of Woodridge with traffic
control as needed, including directing traffic and issuing parking
tickets in addition to writing tickets for violations of the New York
State Vehicle and Traffic Law.
K. Assist in traffic control at special events and proceedings under
the supervision and direction of the Village of Woodridge Chief of
Police.
L. Assist in crowd control and security at special events and in proceedings
as deemed necessary and under the supervision and direction of the
Village of Woodridge Chief of Police.
M. Carrying, displaying and using a firearm subject to any permit, training
and certification requirements and qualifications otherwise imposed
by law.
N. Affecting and assisting in an arrest as required and authorized by
the Village of Woodridge Chief of Police.
No person holding the position of Village Constable shall carry
or otherwise possess a firearm in their capacity as a Village Constable
on Village property other than in conformity with state and federal
law, and after having successfully completed such initial training
and instruction, and any required in-service or follow-up training
and instruction, required for a peace officer authorized to carry
a firearm under the laws of the State of New York.
The Village Constables shall serve at whatever compensation
that will be determined by the Village Board, if any, and compensation
shall be fixed at a rate commensurate with the task assigned, as determined
by the Village Board in their sole discretion.
The Village shall purchase uniforms and equipment for Constables
and provide any and all necessary training as deemed necessary and
required by the Village Board and the Village of Woodridge Chief of
Police. There shall be a provision in the annual budget for the estimated
expenditures incurred in providing uniforms, equipment and training.
Pursuant to the laws of the State of New York and specifically
Municipal Home Rule Law § 10, the Village of Woodridge will
waive the residency requirements set forth in New York State Public
Officers Law § 3 for Constables of the Village of Woodridge.
This chapter shall take effect immediately upon filing with
the New York State Secretary of State.
