Section 3-302 of the Village Law, as amended,
is amended by adding thereto the following:
Except that the term of office of the Village
Clerk and Village Treasurer of the Village of Canton, heretofore combined,
shall be indefinite and such position is hereby placed in the competitive
class of the classified civil service. An incumbent who has been employed
in such position for a period of not less than five years immediately
prior to the adoption of this chapter shall continue to hold such
position as a competitive class employee without further examination.
The Village Clerk-Treasurer of the Village of Canton shall not perform
any duties inconsistent with the status as a classified civil service
employee, but such duties shall be assigned by the Board of Trustees
to officers other than the Village Clerk.

Section 4-402 of the Village Law is further
amended to read as follows:
The Clerk-Treasurer of the Village of Canton
shall, subject to the direction and control of the Board of Trustees,
have custody of the Corporate Seal and of the books, records and papers
of the village and of all the official reports and communications
to the Board. He shall keep an indexed record in a separate book of
all village ordinances. He shall keep an accurate account of all orders
drawn on the Treasurer of the village, showing the persons to whom,
and the fund from which, the amount of each order is to be paid, unless
the Board of Trustees shall by resolution determine that such accounts
shall be kept by an auditor. He shall at all reasonable hours, on
demand of any person, produce for inspection the books, records and
papers of his office and shall furnish a copy of any portion thereof,
certified in the proper form to be read in evidence, upon the payment
of his fees therefor, at a rate of $0.20 per folio. If the Board of
Trustees shall, by resolution, determine that the taxes and assessments
of the village shall be collected by the Clerk, he shall collect the
same as provided by this act. He shall also perform such other duties
not inconsistent with his office as shall be determined by resolution
of the Board of Trustees and shall as Village Clerk-Treasurer perform
all the duties consistent with the office of Treasurer as prescribed
by § 4-408, Treasurer, of the Village Law.

The Board of Trustees, by resolution duly adopted,
may create the office of Deputy Clerk and authorize the Clerk to appoint
one or more deputies. Each Deputy Clerk shall receive an annual compensation
to be fixed by the Board of Trustees and shall perform such official
duties as may be assigned to him by the Clerk. In case of absence
or disability of the Clerk, the Deputy Clerk shall perform all of
the duties of the Clerk as the Board of Trustees shall direct.

A. Village Law § 3-302 includes the following provisions:
(1) Village Law § 3-302(1) provides that the Village's
official year begins at noon 12:00 on the first Monday in the month
following the date of the general Village election.
(2) Village Law § 3-302(3) provides that the term of office
of the Clerk and Treasurer shall be two official years.
(3) Village Law § 3-302(6)(a) provides that the Board of Trustees
of any village in which a resolution or local law has been adopted
extending the term of office of the Mayor and Trustees to four years,
by resolution or local law, and subject to permissive referendum,
may extend the term of office of the Clerk or Treasurer, or both,
to four years, except that the first term shall be of the required
number of years so that it shall expire at the end of the term of
office of the Mayor then in office. If such resolution or local law
shall become effective, the offices, the term or terms of which have
been extended, shall thereafter be filled for terms of four years,
commencing at the expiration of the term of office of the Clerk or
Treasurer, or both, in office at the time the resolution or local
law is adopted.
B. Pursuant to the authority provided by the Village Law and the Municipal
Home Rule Law, the Board of Trustees of the Village of Canton hereby
extends to four years the term of office of the Clerk and Treasurer
of the Village of Canton, to commence at the expiration of the current
terms of said offices, subject to the following. The first such term
shall expire at the end of the term of the Mayor then in office, with
each succeeding term to be filled for four years.
C. This section is subject to permissive referendum pursuant to Village
Law Article 9. Accordingly:
(1) Within 30 days after the adoption of this section there may be filed
with the Village Clerk a petition signed and acknowledged by at least
20% of the electors of the Village of Canton, as shown on the register
of electors for the previous general Village election, protesting
against this section and requesting that it be submitted to the electors
of the Village for their approval or disapproval. In such event, this
section shall not take effect until approved by the affirmative vote
of a majority of the qualified electors of the Village voting on such
proposition for its approval.
(2) If a valid petition section is not filed with the Village Clerk,
then this section shall take effect 30 days after its adoption and
upon filing with the Secretary of State.
D. This section shall be effective upon the date it is filed with the
Secretary of State.
