This article shall apply to those lands owned by and under the control and supervision of the Town of East Bloomfield,
The park grounds shall be open to the public every day of the year during the period from sunrise to sunset. The opening and closing hours for the park shall be posted at each entrance thereto and shall be subject to amendment from time to time by the rules and regulations of the Town of East Bloomfield. This does not pertain to the main building(s).
All vehicles shall be parked only upon clearly marked designated areas, and not in any green space or fire lanes. Campers, trailers, all-terrain vehicles and RV units are not permitted in any Town park.
A. 
There shall be no willful damage or destruction of park property. No person shall willfully mark, deface, disfigure, injure, tamper with or displace any buildings, tables, benches, grills, railings, pavings or paving materials, waterlines or other public utilities or parts of appurtenances thereof, sign notices, monuments, stakes, posts or other boundary markers, or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal, and including trees and/or plant materials.
B. 
No one shall interfere with any lamp, lamppost or electric light apparatus or extinguish the light therein except upon proper authority.
C. 
Drive or propel or cause to be driven or propelled along or over any road or parking lot within the park any vehicle at a rate greater than five miles per hour unless otherwise posted.
D. 
All pets shall be on a leash and under the control of the owner. Pet waste must be picked up and carried out from the park.
Fires are only permitted in designated grills which have been provided by the park and portable grills and must be controlled during use and extinguished after use. Any other open fire is forbidden at any time. No person shall set fire or assist another to set fire to any timber, trees, shrubs, grass, leaves, growth or other combustible material or suffer any fire upon other land to extend onto any part of the parks.
Littering is prohibited. No one shall bring into, leave behind or dump any materials of any kind in the parks. All persons using the park shall comply with established carry-in and carry-out procedures of the Town Board as from time to time established by resolution of the Town Board. Refuse is not to be dropped, thrown or scattered on park property. All recyclable materials shall be carried out by those persons bringing them into the park. Either within or next to any park, no one shall discharge into, throw, cast, lay, drop or leave in any brook, stream, storm sewer or drain flowing into or through said park any substance, matter or thing, either liquid or solid, which may or shall result in the pollution of such brook or stream, interfere with the conservation of the natural resources of said park or endanger the health of visitors in said park.
No person shall set up tents, shacks or any other temporary shelter for the purpose of overnight camping, nor shall any person leave in the park after closing hours any movable structure or vehicle used or that could be used for such purposes.
Excessive noise is prohibited. No person shall engage in loud, boisterous, abusive, insulting or indecent language or engage in any disorderly conduct or behavior tending to breach the public peace. In this regard, no person shall play any tape player, musical instrument or sound device in a manner which would tend to annoy or disturb the peace and good order of the park or of the properties adjacent thereto.
The following activities are specifically prohibited at all times and at all locations within the park:
A. 
Smoking is not permitted in any building or outdoor areas. This restriction includes the use of all forms of tobacco, including cigarettes, cigars, pipes, e-cigarettes and smokeless tobacco products, such as snuff, snus and chewing tobacco.

B. 
No firearms or weapons of any variety including air rifles, archery equipment and implements, slingshots, splat balls or similar weapons are permitted in any Town Park, except for authorized law enforcement officials.
C. 
No fireworks are permitted on Town park property.
D. 
No peddling, selling or hawking of merchandise of any kind is allowed without prior authorization by the Town Board.

The consumption of alcoholic beverages including beer and wine and the bringing of such items into a park is governed by the following conditions:
A. 
The use and consumption of alcoholic beverages in the park is subject to all New York State laws.
B. 
No alcoholic beverages shall be dispensed from a temporary bar or keg-type apparatus in any location within the Park other than the main building in Veterans Park, for which a permit must be obtained from and issued by the Town Supervisor, or the Town Clerk or Deputy Town Clerk or by Town Board resolution.
Those persons within the boundaries of the park, whether using its facilities or not, are subject to the rules and regulations contained herein and may be ejected from the park in the event that they violate any rule or regulation.
This article shall be enforced by any park attendant that may heretofore or hereafter be authorized to enforce this article by the Town Board. This article shall be enforced by the Police Department having jurisdiction in the Town of East Bloomfield.
Any person committing any offense against any provision of this article or any rule or regulation promulgated pursuant hereto shall, upon conviction, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against a provision of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
Liability insurance, in an amount determined by the Town Board, may be required for groups using the park facilities, buildings and grounds.
A. 
All reservations for use of grounds and/or facilities will be approved by the Town on a first-come-first-served basis with the following conditions:
(1) 
Residents have first priority for use when simultaneous requests are received from both residents and outside users.
(2) 
No single organization or user may request exclusive use of any grounds for more than two consecutive days per week from Mondays through Saturdays when more than one organization is requesting use. (This does not include the Town-operated summer recreation program.)
(3) 
No organization may reserve fields for dates or times that are not actually planned for use at the time of request.
B. 
All final decisions on facility availability will be decided by the Town Parks and Recreation Committee in conjunction with the Town Clerk.
C. 
Responsibilities of any organization using the playing fields are:
(1) 
To maintain and stripe fields, with the exception of mowing which will be done by the Town.
(2) 
Fields must be left in "play" condition during the time of use as well as when the season concludes.
(3) 
Any damage to fields must be reported to the Town Clerk at once.
(4) 
Must not use the fields if there is excessive moisture which would result in damage to the fields.
D. 
When there are multiple groups requesting field usage during the same time frame the following will occur:
(1) 
The Parks and Recreation Committee, along with the Town Clerk, will hold a usage scheduling meeting not more than five business days after sign-ups are complete and game schedules have been submitted to the Town Clerk's Office.
(2) 
In the event that scheduling conflicts are unresolved or any group is not given their first selection of dates and times, every effort will be made to resolve the conflict in a fair and equitable manner.
(3) 
The final schedule will be determined by the Town Parks and Recreation Committee and the Town Clerk.
E. 
Parking shall be permitted only in those areas designated for parking (i.e. parking lots) and not in any green space or fire lanes.
The validity of any section or provision of this article shall not be invalidated by the invalidity of any other section, provision, or part hereof.
This article shall be effective immediately upon its passage, publication, filing and posting of notice of adoption, as prescribed by law.
