Article VIII Shading Devices and Other Fixtures

As used in this article, the following terms shall have the meanings indicated:

A device designed or used to shade infants and small children, such device to be no larger than three feet high by four feet wide by five feet long and without grounding wires or ropes that extend beyond the perimeter of the device.

OTHER SHADING DEVICES

Include, but are not limited to, cabanas, canopies, pavilions, sportsbrellas, tarps, tents, or similar devices, or any materials mounted on supports.

UMBRELLA

A collapsible circular shade no greater than eight feet in diameter stretched over hinged ribs radiating from a central pole no greater than seven feet six inches in height, and without grounding lines, ropes or sides.

§ 223-23 Restrictions on the use of shading devices on the beach.

With the exception of umbrellas and baby tents, as defined in § 223-20, all other shading devices are prohibited on the beach at all times.

Umbrellas and baby tents shall be properly stabilized or secured in a manner consistent with § 223-20, to prevent uncontrolled movement of the devices as potential safety hazards.

§ 223-24 Violations and penalties.

Any person or persons violating any provision of this article, upon conviction thereof, shall be subject to a fine of not less than $50 nor more than $100, as set out in Chapter 1, General Provisions, Article 1, Penalties.
