The Board of Supervisors of Exeter Township is hereby authorized
to execute the Trust Agreement and any other agreements necessary
for its participation in the Delaware Valley Health Trust. The Delaware
Valley Health Trust Agreement is attached hereto as Exhibit A and incorporated herein by reference. The Trust Agreement
attached hereto is on file for inspection and review at the Exeter
Township office, 4975 DeMoss Road, Reading, Pennsylvania 19606. This
Trust Agreement may be subsequently modified or amended but in no
event shall such amendments or modifications materially adversely
affect the right of Exeter Township to participate in the Delaware
Valley Health Trust.
The participation of Exeter Township in the Delaware Valley
Health Trust is authorized for the purpose of obtaining high quality
health benefits at the most reasonable cost to Exeter Township and
its employees, retirees and their dependents.
As set forth in the Trust Agreement and as otherwise stated
herein, the following conditions apply to the participation of Exeter
Township in the Delaware Valley Health Trust:
A. That each trust participant must meet the admission and eligibility
requirements set forth therein;
B. That each trust participant agrees to pay all annual premiums, contributions,
and assessments when due as provided in the trust agreement and bylaws;
C. That each trust participant uses its best efforts to provide appropriations
for the payment of any contributions, premiums, and assessments required
by the Trust;
D. That each trust participant cooperate fully in achieving the purposes
and objectives of the Trust; and
E. That each trust participant comply with all other terms and conditions
of the Trust Agreement.
Exeter Township agrees to participate in the Delaware Valley
Health Trust for a minimum period of three years from the effective
date of its participation and thereafter may withdraw for any reason
whatsoever provided that it has fulfilled all the applicable conditions
in the Trust Agreement and satisfies all its financial obligations
to the Trust upon withdrawal.
The effective date of the participation of Exeter Township in
the Delaware Valley Health Trust will be January 1, 2018.
The organizational structure of the Trust consists of a Board
of Trustees and Executive Committee selected by the Board of Trustees
in accordance with the Trust Agreement.
Exeter Township delegates to the Board of Trustees of the Delaware
Valley Health Trust the powers enumerated in the Trust Agreement.
All contributions, premiums, and assessments paid by Exeter
Township shall be made with funds appropriated for that purpose.
As set forth in the Trust Agreement, the funds required for
the operation of the Trust shall be provided by the trust participants
through annual appropriations.
The Delaware Valley Health Trust is empowered to enter into
contracts for policies of group insurance and employee benefits, including
social security, for any of its employees.
This article is being enacted pursuant to the Pennsylvania Intergovernmental
Cooperation Law, 53 Pa.C.S.A. § 2301 et seq., and the Pennsylvania
Second Class Township Code, 53 P.S. § 66507.
All ordinances or parts of ordinances inconsistent herewith
or in conflict with any of the specific terms enacted hereby, to the
extent of said inconsistencies or conflicts, are hereby specifically
repealed. This article shall in no other way alter or modify Exeter
Township's Code of Ordinances (the "Code") except as specifically
stated herein. Any other terms and provisions of the Code that are
unaffected by this article are hereby reaffirmed and ratified.
The provisions of this article are severable, and if any section,
sentence, clause, part or provision herein shall be held illegal,
invalid or unconstitutional by any court of competent jurisdiction,
such decision of the court shall not effect or impair the remaining
sections, sentences, clauses, parts or provisions of the article.
It is hereby declared to be the intent of Exeter Township that this
article would have been adopted as if such illegal, invalid or unconstitutional
section, sentence, clause, part or provision had not been included
herein.
This article shall become effective immediately.
