The provisions of this chapter shall apply to all radio and television antennas and satellite dish antennas hereafter erected, constructed, or installed so as to protect the health, safety and welfare of all residents of the Township of Watervliet and to protect the rights of property owners by permitting the use of property owners of their property subject to reasonable regulations.
As used in this chapter, the following terms shall have the meanings indicated:
RADIO AND TELEVISION ANTENNAS
A based station whose purpose is to receive communications or other signals from earth-based stations.
SATELLITE DISH ANTENNA
An earth-based station whose purpose is to receive communications or other signals from orbiting satellites and other extraterrestrial sources, together with other equipment used for such purposes.

No radio or television antenna or satellite dish antenna shall be erected, constructed or installed on property located within the Township of Watervliet without the property owner and occupant or tenant first obtaining from the Watervliet Township Building Official a permit for said installation or construction. The fee for such permit shall be established by resolution of the Township Board from time to time and shall be payable to Watervliet Township Clerk.
All applications for a permit to erect, construct or install an antenna shall be submitted to the Watervliet Township Building Official. The application shall include a site plan showing the proposed location of the installation, including building locations, of the lot or premises on which the same is to be installed, and of all abutting properties, including properties abutting on the other side of the street of the proposed location. The application shall also include a detailed description of the proposed installation, including a picture or sketch of all elements with sizes or dimensions thereof which would be exposed to view from adjacent properties, and shall contain a statement as to the visual impact of the installation on such abutting properties. The application shall also state the proposed coloration of the antenna and contain detailed information as to the erection, construction, installation and stability thereof, together with such other pertinent information as may be required by the Building Official, including the height and diameter of said antenna.
A. 
No permit shall be issued for the erection, construction or installation of antennas on property located within the Township of Watervliet unless said proposed antenna is in compliance with the following provisions:
(1) 
No satellite dish antenna erected, constructed or installed in the Township shall be of a size greater than 12 feet in diameter or other maximum dimensions and shall not rise from ground level in excess of 15 feet in height, at a maximum point, if installed on the ground; provided that if the elevation at a point at which the satellite dish antenna is to be erected is lower than the ground level of the adjacent properties, measured at the closest property line on said adjacent properties, the highest point on the satellite dish antenna shall not rise from the ground in excess of 15 feet in height at its maximum point or in excess of 12 feet in height above the ground level of the adjacent properties at said closest property lines, whichever is greater.
(2) 
All erections, constructions or installations of satellite dish antennas shall be located in the rear yard of the premises and shall not be located in the front or side yards of said premises. All erections, construction or installation of radio and television antennas shall be located in the side or rear yard of the premises. An antenna shall not be located nearer to the rear lot line than a minimum of five feet. No antenna shall be located nor placed on a public or private easement.
(3) 
No antenna shall be linked, physically or electronically, to a receiver which is not located on the same lot, premises or parcel of land as is the satellite dish antenna.
(4) 
Any driving motor shall be limited to 110 volts maximum power design and be encased in a protective enclosure.
(5) 
All satellite dish antennas shall be of a neutral color or black and of a nonglare finish, with no advertising, message, writing or any other graphic representations located thereon.
(6) 
No satellite dish antenna erected, constructed, or installed on a building or the roof of a building shall be of a size greater than three feet in diameter or other maximum dimensions and shall not project higher than five feet above the highest peak or point of said roof or building. Satellite dish antennas shall not be erected, constructed or installed on balconies, terraces, landings, or other building projections.
B. 
Variations to the above provisions may be made by the Building Official in cases where provisions cannot be adhered to, or by the Board of Appeals when the Building Official requests it.
