This article shall be known and may be cited as the "Elverson
Borough Street Occupancy Ordinance."
Repair by permittee. Any damage done within a Borough street
right-of-way by the permittee or its agent shall be repaired by the
permittee or its agent, as determined by and to the satisfaction of
the Borough. This shall include damage done as part of the execution
of the work and/or damage done by construction vehicles traveling
to/from the work site.
Any person who violates or permits a violation of this article
shall be subject to a civil penalty not to exceed $600 per violation.
In any case where a penalty for a violation of this article has not
been timely paid and the person upon whom the penalty was imposed
is found to have been liable therefor in civil enforcement proceedings,
the violator shall be liable for the penalty imposed, including additional
daily penalties for continuing violations, plus court costs and reasonable
attorneys' fees incurred by the Borough in the enforcement proceedings.
The civil enforcement proceedings shall be initiated by complaint
or by such other means as may be provided by the Pennsylvania Rules
of Civil Procedure.
Should any section, subsection, sentence, clause or phrase of
this article be declared invalid by a court of competent jurisdiction,
such decision shall not affect the validity of the article in its
entirety or of any other part thereof other than that part declared
to be invalid.
