It is the purpose of this article to protect the public interest, health, safety and welfare within the Town of Macedon by prohibiting the consumption of alcoholic beverages upon any lands, facilities, streets, parks, playgrounds owned, operated or controlled by the Town of Macedon or public or private parking lots within the Town of Macedon. The Town Board finds that these purposes can also be accomplished by restricting the possession of an open or unsealed container of alcoholic beverages under circumstances that indicate that the possessor of such open or unsealed container in any fixed location owned, operated or controlled by the Town or in public or private parking lots within the Town intends to consume the same or intends to have it consumed by another person.
For the purpose of this article, the following terms shall have the meanings herein ascribed to them; all other words shall have the meanings normally ascribed to them.
ALCOHOLIC BEVERAGE
Includes alcohol, spirits, liquor, wine, beer, cider and every liquid or solid, patented or not, containing alcohol, liquor, spirits, wine or beer and capable of being consumed by a human being.
CONTAINER
Any bottle, can or receptacle suitable for or used to hold any liquid.
OPEN BOTTLE, CAN OR OTHER CONTAINER
Any bottle, can, glass or other receptacle suitable for or used to hold any liquid, which has been uncapped, uncorked, the tab removed or the top sliced, cut or broken, or its original condition altered in such a way that the liquid can flow out of it.

PARKING LOT
Any area or areas of public or private property, including a driveway, near or contiguous to and provided in connection with premises and used as a means of access to and egress from a public highway to such premises and having a capacity for the parking of four or more vehicles. This definition shall not apply to any area or areas of private property comprising all or part of property on which is situated a one- or two- family residence.

TOWN
The Town of Macedon.
TOWN PROPERTY
Areas owned, operated and/or controlled by the Town of Macedon.

Unless otherwise permitted by the Town Board, it shall be a violation of this article for any person to:
A. 
Consume any alcoholic beverage upon Town property or in any parking lot.
B. 
Have in his or her possession an open or unsealed container of an alcoholic beverage while on Town property or in any parking lot.

A violation of this article shall constitute an offense, and the person violating this article shall be subject to the penalty provided in Chapter 1, General Provisions, Article I.
